CLOSED SESSION - 5:30 P.M. ROLL CALL PUBLIC INPUT - Members of the public may address the City Council on items on the Closed Session Agenda. CLOSED SESSION - The City Council shall convene in closed session to: 1 ) Confer with the City Attorney regarding pending litigation to which the City is a party, Santa Ana Unified School District vs. City of Tustin, Case Number 01CC02595 (state court matter). 2) Consider a performance evaluation pursuant to Government Code Section 54957 (City Manager). 3) Confer with the City's labor negotiator pursuant to Government Code Section 54957.6, Agency negotiator is Mayor or Mayor Pro Tem, unrepresented employee (City Manager). REGULAR MEETING- 7:00 P.M. CALL TO ORDER INVOCATION PLEDGE OF ALLEGIANCE ROLL CALL CLOSED SESSION REPORT PROCLAMATION/CERTIFICATE OF RECOGNITION - None FIRST PUBLIC INPUT - At this time members of the public may address the City Council regarding any items not on the agenda, and within the subject matter jurisdiction of the City Council (no action can be taken on off-agenda items unless authorized by law). If you wish to address the City Council on any matter, please fill out one of the blue forms located on the Agenda - City Council November 4, 2002 - Page 1 speaker's podium and submit to the City Clerk so that your remarks on the digital recording of the meeting can be attributed to you. When you start to address the City Council, please state your full name for the record. Total time allotted for public input on non-agenda items is limited to thirty (30) minutes to one (1) hour, at the discretion of the presiding officer. A speaker may not relinquish her/his time to another speaker. A Public Input portion is provided both at the beginning and end of the meeting. PUBLIC HEARING (ITEMS 1 THROUGH 2 ) . ORDINANCE NO. 1262- ADOPTING BY REFERENCE VARIOUS'CONSTRUCTION CODES WITH AMENDMENTS AND APPENDICES The State's Health and Safety code requires local governments to adopt the most recent editions of the model codes related to construction. The construction codes include: the California Building, Fire, Mechanical, Plumbing, and Electric Codes, and other related codes. If the City Council approves Ordinance No. 1262, the most recent editions of the construction codes with the applicable amendments will be in effect within the City of Tustin as required by state law. Recommendation by the Community Development Department: . Adopt the following Resolution No. 02-100, setting forth findings with respect to local conditions within the City of Tustin which make certain modifications and changes to the California Building, Plumbing, and Electrical Codes as amended by the State of California: RESOLUTION NO. 02-100 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, SETTING FORTH FINDINGS WITH RESPECT TO LOCAL CONDITIONS WITHIN THE CITY OF TUSTIN WHICH MAKE CERTAIN MODIFICATIONS AND CHANGES TO THE CALIFORNIA BUILDING CODE, THE CALIFORNIA PLUMBING CODE, AND THE CALIFORNIA ELECTRICAL CODE AS AMENDED BY THE STATE OF CALIFORNIA REASONABLY NECESSARY FOR HOUSING OCCUPANCIES . Introduce and have first reading by title only of the folloWing Ordinance No.1262, adopting by reference various construction codes with amendments and appendices: ORDINANCE NO. 1262 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING SPECIFIED CHAPTERS OF ARTICLE 8 OF THE TUSTIN CITY CODE TO ADOPT THE 2001 EDITIONS OF THE CALIFORNIA CODES AND RELATED MODEL CODES WITH APPENDICES AND AMENDMENTS THERETO 2. REVISIONS TO HOUSING ELEMENT UPDATE California State Law Section 65588 requires that cities and counties update their Housing Element at least every five (5) years. The Housing Element sets forth the City's five-year strategy to preserve and enhance the community's character, expand housing Agenda - City Council November 4, 2002 - Page 2 opportunities for the City's various economic segments, and provide the policy guidance for local decision making related to housing. On February 4, 2002, the City Council adopted the Housing Element Update. The State Department of Housing and Community Development (HCD) reviewed the Update and recommended revisions. All of the HCD revisions have been incorporated into the proposed revised Housing Element Update recommended for adoption. Recommendation of the Community Development Department: , Adopt the following Resolution No. 02-73, finding the environmental determination for the Housing Element Update approved on February 4, 2002, is adequate for the revision to the Housing Element Update: RESOLUTION NO. 02-73- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, FINDING THAT THE ENVIRONMENTAL DETERMINATION FOR THE HOUSING ELEMENT UPDATE APPROVED ON FEBRUARY 4, 2002, IS ADEQUATE FOR THE REVISION TO THE HOUSING ELEMENT UPDATE 2. Adopt the following Resolution No. 02-74, approving General Plan Amendment 02- 001, revising the adopted Tustin Housing Element: RESOLUTION NO. 02-74 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING AN AMENDMENT TO GENERAL PLAN AMENDMENT 02-001, REVISING THE ADOPTED TUSTI!N HOUSING ELEMENT CONSENT CALENDAR (ITEMS 3 THROUGH 8 ) All matters listed under Consent Calendar are considered routine and will be enacted by one motion. There will be no separate discussion of these items prior to the time of the voting on the motion unless members of the Council, staff or public request specific items be discussed and/or removed from the Consent Calendar for separate action. , APPROVAL OF MINUTES - OCTOBER 21,2002 REGULAR MEETING Recommendation: Approve the City Council Minutes of October 21,2002. . APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL Recommendation: Approve Demands in the amount of $322,839.77 and ratify Payroll in the amount of $458,235.91. o PLANNING COMMISSION ACTION AGENDA- OCTOBER 28, 2002 All actions of the Planning Commission become final unless appealed by the City Council or member of the public. Recommendation: Ratify the Planning Commission Action Agenda of October 28, 2002. , RESOLUTION NO. 02-97 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AUTHORIZING THE DESTRUCTION OF CERTAIN CITY RECORDS AND PAPERS IN THE POSSESSION OF THE CITY CLERK OF THE CITY OF TUSTIN NO LONGER REQUIRED FOR THE CONDUCT OF CITy BUSINESS, As:enda - City Council November 4, 2002 - Pase 3 . , Recommendation: Authorize the Mayor and City Clerk to execute a Consu Agreement with the firm of Purkiss Rose-RSl for the Centennial Park Ret amount not to exceed $47,500 as recommended by the Director of Parks a~ Services. PURSUANT TO THE AUTHORITY GRANTED BY THE CITY OF TUSTIN!S RECORDS RETENTION SCHEDULE Recommendation: Adopt Resolution No. 02-97, authorizing the destruction of records in the possession of the City Clerk as recommended by the Office of the City Clerk.
