SUBJECT: ACCEPTANCE OF PUBLIC IMPROVEMENT AND AUTHORIZATION TO
FILE THE NOTICE OF COMPLETION FOR THE CEDAR GROVE PARK
PLAYGROUND RENOVATION (CIP NO. 20071)
SUMMARY:
The Cedar Grove Park playground renovations have been completed and the project is
ready for acceptance and filing of the Notice of Completion.
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt Resolution No. 13 -75 accepting the Cedar Grove Park Playground
Renovation (CIP No. 20071), and
2. Authorize the City Clerk to file the Notice of Completion with the County
Recorder's office.
FISCAL IMPACT:
The Columbus Tustin Park Playground Renovation (CIP No. 20071) was in the 2012-
2013 Capital Improvement Program budget as a Park Development funded project.
The original engineer's estimate for this project, including the cost of equipment and
installation was $221,000.00. On April 2, 2013, as part of the Award of Bid, City Council
approved an additional appropriation of $15,000.00 to fully fund this project. Upon
completion, the total project cost was $233,959.00.
BACKGROUND:
The scope of work included the replacement of the fifteen old playground at Cedar
Grove Park (11385 Pioneer Road). The work completed consisted of demolition and
removal of existing play equipment and sand, installation of new playground equipment,
play surfacing, and an ADA concrete entry ramp.
The project was completed on August 5, 2013. The City has retained 10% of the contract
amount, which ill be released no sooner than 35 days after the recordation of the Notice
ok6.ompletion with the County Recorder's Office.

RESOLUTION NO. 13-75
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN
CALIFORNIA ACCEPTING THE WORKS OF IMPROVEMENT AND
AUTHORIZING THE RECORDATION OF THE NOTICE OF
COMPLETION FOR THE CEDAR GROVE PARK PLAYGROUND
RENOVATION (CIP NO. 20071)
WHEREAS, Cicero Engineering, having a contract with the City of Tustin to
construct the hereinafter described public works and improvement; and
WHEREAS, the Project Manager has duly certified to the construction and
completion of said public improvement hereinafter mentioned in a manner satisfactory
to the City Council of the City of Tustin; and
WHEREAS, the City Council finds that said contractor has completed said public
improvement hereinafter more particularly described in accordance with the provisions
of the contract documents and the Notice of Completion, and acceptance of said public
work and improvement should be filed and payment of the balance due said contractor
authorized in accordance with the contract documents;
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin
that said public work and improvement be accepted, and the same is hereby accepted.
Said public work and improvement is more particularly described as follows:

CIP No. 20071
BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin is
hereby authorized to execute and file a Notice of Completion for the acceptance of said
public works and improvement described herein as required by law.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Tustin held on the 3rd day of September 2013.
