If you wish to address the Commission on any matter, please fill out one of the forms located at the speaker’s podium so that your remarks within the recording of the meeting can be attributed to you. Completion of this form is not mandatory, but accurately provides your information for the record. CONSENT CALENDAR: All matters listed under the Consent Calendar are considered routine and will be enacted by one motion. There will be no separate discussion of these items prior to the time of the voting on the motion unless members of the Commission, staff, or public request specific items to be discussed and/or removed from the Consent Calendar for separate action. 1. APPROVAL OF MINUTES – AUGUST 13, 2013, PLANNING COMMISSION MEETING. RECOMMENDATION: That the Planning Commission approve the minutes of the August 13, 2013, meeting as provided. Any writings or documents provided to a majority of the Planning Commission regarding any item on this agenda will be made available for public inspection in the Community Development Department located at 300 Centennial Way, Tustin, California, during normal business hours. IIn compliance with the Americans With Disabilities Act, if you need special assistance to participate in this meeting, please contact the office of the City Clerk at (714) 573-3025. Notification 72 hours prior to the meeting will enable the City to make reasonable arrangements to assure accessibility to this meeting. Agenda – Planning Commission September 24, 2013 – Page 1 of 3 PUBLIC HEARINGS: 2. CONDITIONAL USE PERMIT 2013-11 – RESIDENTIAL CONSTRUCTION. The applicant is requesting authorization to enclose an existing patio and establish a detached guest quarters with no cooking facilities. Tustin City Code (TCC) Section 9223b2 conditionally allows accessory buildings to be used as guest quarters provided no cooking facilities are installed or maintained. Tustin City Code Section 9297 defines guest quarters as “detached living quarters of a permanent type of construction and without kitchens or cooking facilities and where no compensation in any form is received or paid”. In accordance with TCC 9291, a Conditional Use Permit is subject to a public hearing before the Planning Commission wherein the Commission may impose such conditions as it deems necessary to ensure the purposes of the Zoning Code are met. The project has been noticed for a public hearing in the newspaper; however, notices were not mailed out timely to property owners within 300 feet of the project site. In addition, on September 19, 2013, the applicant provided a written request to table this item; however, they did not provide a date certain. A copy of the staff report is attached herewith to provide the Commission with information related to this item since the project has been noticed in the newspaper. APPLICANT/ PROPERTY OWNER: Arman Rasoolian PROJECT LOCATION: 155 S. Myrtle Avenue ENVIRONMENTAL: The project is categorically exempt pursuant to Section 15301, Class 1, and 15303, Class 3 of title 14, Chapter 3 of the California Environmental Quality Act (CEQA). RECOMMENDATION: That the Planning Commission continue the item to the October 8, 2013, public hearing to allow time for the notification to property owners.
