HUSTON, CITY MANAGER COMMUNITY DEVELOPMENT DEPARTMENT FINAL TRACT PL~PS 15504 & 15505 (RICHMOND AMERICAN HOMES) RECOMMENDATION That the City Council adopt Resolution No. 98-37 approving Final Tract Maps 15504 and 15505. FISCAL IMPACT The Final Map is an applicant initiated project. The applicant has paid application fees to recover the cost of processing this application. DISCUSSION On July 14, 1997, nhe Planning Commission adopted Resolution No. 3529 recommending nhat the City Council approve Vesting Tentative' Tract Map 15380. Vesting Tentative Tract 15380 includes 162 numbered lots to accommodate the development of 162 single family dwellings on a 30.? gross acre site. The subject site is bordered by Tustin Ranch Road on the north and west, Portola Parkway on the south and Jamboree Road on the east. As permitted by tke Subdivision Map Act, the developer intends to record the subdivision in multiple maps for financing purposes. Each map will be recorded as a separate Final Tract MaP as follows- Tract 15502 - Tract 15503 - Tract 15504 - 4.35 acres Bldg. Phase 1 - Previously Recorded 3.67 acres Bldg. Phase 1 - Previously Recorded 2.93 acres Building Phase 2 & 3 City Council Report FTM 15504 and 15505 April 20, 1998 Page 2 Tract. 15505 - Tract 15506 - Tract 15507 - Tract 15380 - 4.98 acres Building Phase 2 & 3 4.42 acres Building Phase 4 & 5 4.31 acres Building Phase 4 & 5 & 6 6.23 acres Building Phase '6 & 7 Total 30.89 acres Pursuant to the approved phasing plan for Tentative Tract 15380, each building phase includes the landscaping-improvements on the portions of Tract 15380 adjacent to that phase. The City council has previously approved Tracts 15502 and 15503 (Phase 1) on November 3, 1997. Final Map 15504 consists of 2.93 acres and includes sixteen (16) numbered lots. Final Map 15505 consists'of 4.98 acres and consists of twenty six (26) numbered lots. Final Maps 15504 and 15505 (Phase 2 & 3)'are shown in context with the overall project on the attached Phasing Plan. The Final Maps are in substantial conformance with the Tentative Tract Map approvals, the City's Zoning Code and Subdivision Code, and the State Subdivision Map Act. Based upon. this conformance, staff, recommends that the .City Council approve Final Tract .Maps 15504 and 15505.' NOTES AND EASEMENT NOTES. ]4 16 17 20 2! 22 24 26 27 25 29 RESOLUTION NO. 98-37 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING FINAL TRACT MAPS 15504 AND 15505 LOCATED WEST OF JAMBOREE ROAD BETWEEN TUSTIN RANCH ROAD AND PORTOLA PARKWAY. The City Council of the City of Tustin does her. eby resolve as follows: I . The City Council finds and determines as3follows: A. That Final Tract Maps 15504 and 15505 have been submitted by Richmond American Homes Inc., ("the Subdividers"); B. That a public hearing was held by the Planning' Commission on July 14, 1997. At this hearing, the Planning Commission recommended that the City Council approve Vesting Tentative Tract· Map 15380. Subsequently, the City Council approved Vesting Tentative Tract Map 15380 on July 21, 1997; C. That, pursuant to Section 66456.1 of the Subdivision Map Act, the Subdivider intends to file multiple final maps in relation to approved Tentative Tract Map 15380. Final Tract Maps 15504 and .15505 are the third and fourth of such final maps; D. pursuant to Section 15268(b) (Ministerial Projects) of .the California Environmental Quality Act (CEQA), the Final Maps are considered statutorily exempt from the requirements of CEQA; E. That the proposed subdivision is in substantial conformance with the Tustin General Plan, the Tustin Zoning Code· and Subdivision ~Map Act subject to all subdivision bonds as approved by the City Engineer and the City Attorney; F. The 1.6524 acres of parkland required for this development was previously dedicated with recordation of Tract 13627; G. That the City has reviewed the status of the School Facilities Agreements between the Irvine Company and the Tustin Unified. School District for the impact of Tensative Tract 15380 on School District facilities, and changes in state law. Impacts associated with this approval on School District facilities are adequately 2O 24 26 Resolution No. 98-3/ Page 2 H · I · J· K, L · M. addressed; That the site is physically suitable for the type of development proposed; That the site is physically suitable for the proposed density of development; That the design of the subdivision or -the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife in their habitat; That the design, of the subdivisi'on or the tyPe or improvements proposed will not conflict with easements acquired by the public-at-large, for access through or use of the property within the proposed subdivision; That the design of the subdivision or the types of improvements proposed are not likely to cause serious public health problems; and, That the Final Maps are in substantial conformance with the Vesting Tentative Tract Map. II. The City Council hereby approves Final Tract Maps 15504 and 15505, subject to final approval by the City'Engineer.
