REGULAR MEETING
TUSTIN PLANNING COMMISSION
SEPTEMBER 24, 2013

Approved CONSENT CALENDAR:
1. APPROVAL OF MINUTES – AUGUST 13, 2013,
PLANNING COMMISSION MEETING.
RECOMMENDATION:
That the Planning Commission approve the minutes of the
August 13, 2013, meeting as amended.
Motion: It was moved by Smith, seconded by Altowaiji, to move the
Consent Calendar as amended. Motion carried 5-0.
PUBLIC HEARINGS:
Continued to a date 2. CONDITIONAL USE PERMIT 2013-11 – RESIDENTIAL
certain CONSTRUCTION.
The applicant is requesting authorization to enclose an
existing patio and establish a detached guest quarters with
no cooking facilities.
Tustin City Code (TCC) Section 9223b2 conditionally
allows accessory buildings to be used as guest quarters
provided no cooking facilities are installed or maintained.
Tustin City Code Section 9297 defines guest quarters as
“detached living quarters of a permanent type of
construction and without kitchens or cooking facilities and
where no compensation in any form is received or paid”. In
accordance with TCC 9291, a Conditional Use Permit is
subject to a public hearing before the Planning
Commission wherein the Commission may impose such
conditions as it deems necessary to ensure the purposes
of the Zoning Code are met.
The project has been noticed for a public hearing in the
newspaper; however, notices were not mailed out timely to
property owners within 300 feet of the project site. In
addition, on September 19, 2013, the applicant provided a
written request to table this item; however, they did not
provide a date certain. A copy of the staff report is attached
herewith to provide the Commission with information related
to this item since the project has been noticed in the
newspaper.
APPLICANT/

PROJECT LOCATION: 155 S. Myrtle Avenue
ENVIRONMENTAL:
The project is categorically exempt pursuant to Section
15301, Class 1, and 15303, Class 3 of title 14, Chapter 3
of the California Environmental Quality Act (CEQA).
RECOMMENDATION:
That the Planning Commission continue the item to the
October 8, 2013, public hearing to allow time for the
notification to property owners.
Stonich Gave a presentation of the item.
The Director stated that the item may be continued to a further
date, and there would be a separate request to continue the item
provided at the next meeting if this is the case. The item will be
noticed once again if the hearing is continued at the next regular
meeting.

The public hearing was opened and closed at 7:08 p.m. No
members of the audience stepped forward to speak.
Chair Kozak called for a motion to continue the item as
recommended by staff.
Motion: It was moved by Kozak, seconded by Thompson, to continue the
item to the Planning Commission’s regular meeting of October 8,
2013. Motion carried 5-0.
None REGULAR BUSINESS
STAFF CONCERNS:
The Director reported as follows:
Introduced and welcomed Vera Tiscareno, who will become
the Community Development Department’s Executive
Secretary, and will support the Planning Commission.
Stated Adrianne DiLeva-Johnson will continue to work in the
Community Development Department in her new capacity
as a Senior Management Assistant;
Announced that staff will be registering for the 2013
Planning Officials Forum. Hopes all of the Commissioners
will be able to attend.
COMMISSION CONCERNS:
Smith
Had no concerns to report on this evening.
Lumbard
Congratulated Adrianne and welcomed Vera. Looks forward
to working with her.
Altowaiji
Echoed his fellow Commissioner’s comments;
Reported that he completed the historic preservation
modules training as well as ethics training;
Attended the rededication of Rawlings Reservoir.
Thompson
Attended the OCBC’s infrastructure meeting where an ISO
presentation was given;
Stated Tustin Tiller Days and the Old Town Historic Art Walk
are both upcoming. Added that he will be conducting tours
of Old Town during the Art Walk;
Welcomed Vera and congratulated Adrianne;

Asked that the Commission adjourn this evening in Honor of
Beverly Staley. She was survived by her husband Tom
Staley who was the chief engineer of Rancho Mission Viejo.
She was also survived by her two daughters and five
grandchildren. Beverly and Tom were married for 50 years;
Recognized that there was a journalism student and reporter
for the Orange County Register in the audience this
evening. Thanked them for attending the meeting.
Kozak
Welcomed Vera and congratulated Adrianne, is glad that
she will still be a part of the Community Development
Department;
Attended the public hearing for Wilcox Manor, the Cedar
Grove Park playground rededication, Mayor Murray’s 9/11
Remembrance Ceremony; and, the rededication ceremony
at Rawlings Reservoir.
Congratulated Saddleback Chapel for 50 years of dedicated
service to the Tustin Community;
Congratulated the Aeros Corporation on the trial runs of their
new airship.
7:18 p.m. ADJOURNMENT:
The next regular meeting of the Planning Commission is
scheduled for Tuesday, October 8, 2013, at 7:00 p.m. in the City
Council Chamber at 300 Centennial Way.
