UAILITY ACT That the Planning Commission adopt Resolution No. 4231 determining that the location, purpose, and extent of the proposed acquisition of future extension of Myford Road and adjacent land as depicted in Exhibit A is in conformance with the Tustin General Flan. APPROVAL AUTHORITY Pursuant to Section 65402(a) of the Government Code, the Planning Commission is authorized to determine whether the location, purpose, and extent of the proposed acquisition of real property is consistent with the General Plan. Section 9311.G.2.g of the Tustin City Code authorizes the City Engineer to accept dedications and conveyances of real property and interest in real property offered at no cost to the City. Planning Commission Report CPC Determination — Myford Road Extension October 8, 2013 Page 2 i ACKGROUND /©OSCCUSSilON In 1988, The Irvine Company offered a portion of land adjacent to the Tustin Market Place shopping center for dedication to the City for future extension of Myford Road (Figure 1 -= highlighted in Green). Since the extension of Myford Road is not foreseen in the near future, the area in the interim has been used for the ,auto Center overflow parking of vehicles. The grant of the land to the City is to be used for the operation, maintenance, repair and replacement of public roadway/right- of-way purposes; and in the interim may include landscaping, fences, gates, lighting and parking of vehicles for Tustin Auto Center dealerships. The area will be granted via a Grant Deed to be accepted by the City Engineer as authorized in the recent amendment to the Subdivision Code (Ordinance No. 1430). Pursuant to Section 66402(c) of the California Government Code (Planning and Development Law), a general plan conformity determination from local planning agencies prior to acquisition or disposition of real property by a local agency is required. The proposed acquisition in fee title of future extension of Myford Road and the adjacent remnant parcel supports General Plan Land Use and Circulation Elements, including the following: 1. Land Use Element Goal 9: Continue to provide for a planned community in East Tustin compatible with the land use characteristics by reserving and maintaining the site for future extension of Myford Road while in the interim being used to support local dealerships within the East Tustin Specific Plan area. 2. Circulation Element Goal 1: Provide a system of streets that meets the need of current and future inhabitants and facilitates the safe and efficient movement of people and goods throughout the City consistent with the City's ability to finance and maintain such system by accepting the land in fee title for future construction of Myford Road. Based upon the City's adopted General Plan, the location, purpose, and extent of the proposed acquisition in fee title of the future extension of Myford Road and the adjacent parcels is in conformance with the approved General Plan Land Use and Circulation Elements. The Planning Commission does hereby resolve as follows: The Planning Commission finds and determines as follows: A. That the Irvine Company, owner of the property set aside for the future extension of Myford Road and the adjacent remnant parcel desires to grant the land to the City in fee title to be used for the operation, maintenance, repair and replacement of public roadway /right -of -way and associated landscaping, fences, gates, lighting and parking of vehicles for Tustin Auto Center dealerships. S. That on July 6, 1999 the City Council adopted Resolution No. 9950 accepting offer of dedication of real property on Myford Road between El Camino Real and the Santa Ana (1 -5) Freeway for public highway, utility, and other public purposes. C. That the extension of Myford Road is not foreseen in the near future and the site area in the interim has been used for the Auto Center overflow parking of vehicles from the Tustin Auto Center. U. That the City wishes to accept the dedication in fee title. E. That Section 65402(a) of Government Code provides that no real property shall be acquired until the location, purpose, and extent of the project has been reported upon by the local planning agency as to the conformity with the adopted general plan. F. The proposed acquisition in fee title supports several General Plan Band Use Element goals, including the following: 1. Land Use Element Goal 9: Continue to provide for a planned community in East Tustin compatible with the land use characteristics by reserving and maintaining the site for future extension of Myford Road while in the interim being used to support local dealerships within the East Tustin Specific Plan area. H. That the general plan conformity determinations required by Government Code Section 65402 (a) are not "projects" requiring environmental review pursuant to the California Environmental Quality Act. II. The Planning Commission hereby determines that the location, purpose, and extent of the proposed acquisition of future extension of Myford Road and the adjacent remnant parcel to be used for the operation, maintenance, repair and replacement of public roadway /right -of -way and associated landscaping, fences, gates, lighting and parking of vehicles for Tustin Auto Center dealerships, as shown in Exhibit A attached hereto, is in conformance with the Tustin General Plan.
