RECOMMENDATION:
It is recommended that the City Council, at their meeting of March 16, 1998 approve an amendment to the
agreement between Accurate Landscape & Maintenance and the City of Tustin for landscape maintenance services.
This contract amendment would extend the agreement from July 1, 1997 to July 30, 1998, would add the landscape
maintenance of additional public right-of-ways, and would grant the contractor a 8% increase in the monthly base
price of the contract, effective February 1, 1998.
FISCAL IMPACT:
The State of Califomia has adopted three minimum wage increases in the period March 1, 1997 to March 1, 1998.
These adjustments' have raised the minimum wage from $4.75/hour to $5.75/hour, an increase of 21%. Accurate
Landscape & Maintenance employs a number of individuals at this pay scale, and the ability of this finn to
maintain service levels without an increase in the monthly contract cost is not possible. Staff has negotiated an
adjustment to the contract of 8% effective February 1, 1998, which will increase the monthly contract price by
$834.00/month. The increase in the monthly service fee was anticipated, and was incorporated into the 1997/98
Budget.
In addition, new development has added the landscape maintenance of the right-of-way at the southeast comer of
Irvine Blvd. and Tustin Ranch Road, and the Regional Horse Trail north of Pioneer Rd., to the Lighting and
Landscape District. This will increase the contract by a total, of $1,375.00/month for five months, adding an
additional $6,875 to the total yearly contract price. The funding for the additional maintenance will come from the
reallocation in Assessment District Funds due to new development.
The twelve-month contract, including all items will amount to a total of $134,000.
DISCUSSION:
The City has contracted with Accurate Landscape & Maintenance since August 1, 1996 for maintenance of the
East Tustin Assessment District Landscape. During this period, new development has caused the addition of the
Regional Horse Trail from Pioneer Rd to Peters Canyon Rd., and the public fight-of-way at the southeast comer of
Tustin Ranch Rd. and Irvine Blvd. to their scope of work. The original agreement was for a one-year period, with
one (1) year term extensions that may be granted for (3) additional years. Accurate Landscape & Maintenance has
provided consistent.service of a reasonably high quality for the last seven months, and has been very responsive to
correct areas when maintenance was not up to city standards.
The maintenance of the Regional Horse Trail and the southeast comer of Tustm Ranch Rd. 'and Irvine Blvd. sites
will increase the contract by $1,375.00 per month, effective February 1, 1998. The funding for this work will come
from the assessments collected in Tustin Landscape and Lighting Assessment District.

FIRST AMENDMENT TO AGREEMENT
THIS FIRST AMENDMENT is entered into this day of ,
1998, by and between the City of Tustin, a Municipal Corporation (herein referred to as
"City"), and Accurate Landscape & Maintenance Corporation, a California Corporation
(herein referred to as "Contractor").
RECITALS
WHEREAS, City and Contractor entered into an Agreement dated July 15, 1996,
the "Agreement", wherein Contractor 'agreed to perform landscape maintenance
services for Assessment District Areas in accordance with the plans and
specifications entitled: "Landscape Maintenance Services for Assessment District
Areas";

WHEREAS, the initial term of the agreement was one year, with the option to be
extended for three additional one-year terms by written agreement of the parties;

WHEREAS, City and Contractor desire to exercise the extension clause pursuant
to Section B, Page B-2, Paragraph 4, Item B, to extend the Agreement for one
year;

WHEREAS, City and Contractor also desire to add the landscape maintenance of
additional areas to the Agreement; and

WHEREAS, City and Contractor also desire to adjust Contractor's compensation
under the Agreement to reflect the increased mandatory minimum wage.
AGREEMENT
The Agreement is hereby amended as follows:

The term of the Agreement is extended through June 30, 1998, unless sooner
terminated pursuant to Section B, Page B-32, Paragraph 48 of the Agreement.
B.
The areas of landscape maintenance services to be provided by Contractor is
amended to include the following additional areas:
Irvine Blvd Parkway (south side, Tustin Ranch Road to Robinson Dr.)
Tustin Ranch Road Parkway (east side, Irvine Blvd to Kinsman Circle)
Regional Horse Trail (Pioneer Road to Peters Canyon Regional Park)
C.
City shall pay the Contractor the following sums for the periods indicated:
(1) From July 1, 1997, to January 31, 1998, the City shall pay the Contractor,
on a monthly basis, an amount equal to $10,423.00.
(2)
From February 1, 1998 to June 30, 1998, the City shall pay the Contractor,
on a monthly basis, an amount equal to $12,207.00.

Except as expressly amended by this First Amendment, all other terms, conditions
of the Agreement and all attachments, and exhibits thereto, shall remain in full
force and effect.
IN WITNESS WHEREOF, the parties have hereunto set their hands and seals the year
