PARKER, CITY MANAGER FROM: PAMELA ARENDS -KING, FINANCE DIRECTOR /INTERIM CITY TREASURER SUBJECT: EXTENSION OF AGREEMENT WITH THE DEPARTMENT OF TOXIC SUBSTANCES CONTROL AND BUDGET APPROPRIATION SUMMARY: Approval by the City Council is requested to authorize the extension of the agreement with the Department of Toxic Substances Control (DTSC) for the former MCAS Tustin project area (Tustin Legacy) environmental remediation and approve a budget appropriation to fund the extended agreement. RECOMMENDATION: It is recommended that City Council: a. Authorize the extension of the City's agreement with DTSC through December 2014. b. Authorize a budget appropriation of $50,000 to fund the agreement's extension from The Proceeds from Land Sale Fund 189. FISCAL IMPACT: The fiscal impact will be a decrease in fund balance for the Proceeds from Land Sale Fund of $50,000; however, depending on the nature of DTSC's involvement certain expenditures may be reimbursed by the City's environmental insurance policy. CORRELATION TO THE STRATEGIC PLAN: The recommendations correlate to the City's strategic plan by implementing Goal B, item number three to protect the City's public assets. BACKGROUND: The City currently has an environmental policy covering City property at the Tustin Legacy through December 2016. To facilitate existing and unknown environmental insurance claims the City requires DTSC's coordination with completing these claims. As a result, the City is required to reimburse DTSC staff for their time spent coordinating these claims. Depending on the nature of DTSC's involvement certain expenditures may be reimbursed by the insurance company. Pamela Arends -King Finance Director /Interim City Treasurer
