HomeMy WebLinkAboutPC RES 4231RESOLUTION NO. 4231 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN DETERMINING THAT THE LOCATION, PURPOSE, AND EXTENT OF THE PROPOSED ACQUISITION IN FEE TITLE OF THE FUTURE EXTENSION OF MYFORD ROAD FROM EL CAMINO REAL TO THE INTERSTATE 5 FREEWAY ALONG WITH THE ADJACENT REMNANT PARCEL CONFORMS WITH THE TUSTIN GENERAL PLAN. The Planning Commission does hereby resolve as follows: The Planning Commission finds and determines as follows: A. That the Irvine Company, owner of the property set aside for the future extension of Myford Road and the adjacent remnant parcel desires to grant the land to the City in fee title to be used for the operation, maintenance, repair and replacement of public roadway /right -of -way and associated landscaping, fences, gates, lighting and parking of vehicles for Tustin Auto Center dealerships. B. That on July 6, 1999 the City Council adopted Resolution No. 99 -50 accepting offer of dedication of real property on Myford Road between El Camino Real and the Santa Ana (1 -5) Freeway for public highway, utility, and other public purposes. C. That the extension of Myford Road is not foreseen in the near future and the site area in the interim has been used for the Auto Center overflow parking of vehicles from the Tustin Auto Center. D. That the City wishes to accept the dedication in fee title. E. That Section 65402(a) of Government Code provides that no real property shall be acquired until the location, purpose, and extent of the project has been reported upon by the local planning agency as to the conformity with the adopted general plan. F. The proposed acquisition in fee title supports several General Plan Land Use Element goals, including the following: 1. Land Use Element Goal 9: Continue to provide for a planned community in East Tustin compatible with the land use characteristics by reserving and maintaining the site for future extension of Myford Road while in the interim being used to support local dealerships within the East Tustin Specific Plan area. Circulation Element Goal 1: Provide a system of streets that meets the need of current and future inhabitants and facilitates the safe and efficient movement of people and goods throughout the City consistent with the City's ability to finance and maintain such system by accepting the land in fee title for future construction of Myford Road. G. That Section 65402 (a) of the Government Code authorizes the Planning Commission to determine whether the location, purpose, and extent of the proposed disposition of real property is consistent with the General Plan. H. That the general plan conformity determinations required by Government Code Section 65402 (a) are not "projects" requiring environmental review pursuant to the California Environmental Quality Act. II. The Planning Commission hereby determines that the location, purpose, and extent of the proposed acquisition of future extension of Myford Road and the adjacent remnant parcel to be used for the operation, maintenance, repair and replacement of public roadway /right -of -way and associated landscaping, fences, gates, lighting and parking of vehicles for Tustin Auto Center dealerships, as shown in Exhibit A attached hereto, is in conformance with the Tustin General Plan.
