Ord. 1435 — Adopting the 2013
California Building, Residential,
Fire,, Green Building Standards,
Electrical, Mechanical,, Plumbing
and related construction and
property maintenance codes.
Ordinance No. 1435
■ The State is required to adopt and publish the California
Building Standards Code every 3 years. The codes become
effective January 1, 2014.
■ Local agencies routinely proactively adopt the State Code and
concurrently make local amendments when supported by
findings clarifying the existence of climactic, geological,
topographical, etc., conditions for the area.
■ Local agencies may also adopt modifications to clarify past
conflicts or to ensure consistency with other adopted ordinances.
■ Local amendments may not be less restrictive than State Code.

■ Staff is proposing that the following codes be adopted:

2013 California Residential Code
2013 California Plumbing Code
2013 California Mechanical Code
2013 California Electrical Code
2013 California Existing Building Code
2013 California Historical Building Code
2013 California Green Building Standards Code
2013 California Fire Code
2012 International Property Maintenance Code
1997 Uniform Housing Code
1997 Uniform Code for the Abatement of Dangerous Buildings
Ordinance No. 1435
■ This cycle, staff and the Orange County Fire Authority
is recommending that certain technical changes and
modifications be made to the Codes due to local
conditions in the City of Tustin. These changes are
supported by the International Code Council Orange
County Chapter. For example:
Building Code Section 105.3.2 — Continue extending the time
line for permit application from 180 days to 360 days. This
provision was enacted two adoption cycles ago.
Building Code Section 403 - Due to Fire Authority logistical
limitations and local high winds, the requirement of the high rise
buildings is amended to apply to buildings over 55 feet high instead
of over 75 feet high. This provision exists from previous adoption
cycles.

Recommendation
City Council adopt Resolution 13-79 setting forth and
making local conditions findings that support the City
of Tustin's proposed modification of the State
Building Standards Code;
■ City Council introduce and have first reading of
Ordinance No. 1435, adopting various building and
construction codes with amendments and appendices.
■ City Council set the matter for public hearing and
adoption at the regular City Council meeting on
December 3, 2013.
