HUSTON, CITY MANAGER OFFICE OF THE CITY CLERK CONFLICT OF INTEREST CODE - DESIGNATED POSITIONS RECOMMENDATION Adopt Resolution No. 98-3 modifying the Appendix, Designated Positions, contained in the City's Conflict of Interest Code to add the position of Accounting Supervisor and delete the position of Senior Accountant. FISCAL IMPACT None BACKGROUND The Appendix (Designated Positions) defines those officials and employees who are required to file Statements of Economic Interests (Form 700). Annually, the Designated Positions should be modified to reflect changes that have occurred in the City's Classification Plan or to reflect the addition or deletion of positions as determined by the City Attorney. The positions of Councilmember, City Manager, City Attorney, City Treasurer, Finance Director and Planning Commissioner, are required to file Form 700 pursuant to Government Code Section 87200 and, therefore, are not included as Designated Positions in the Appendix. With the adoption of Resolution No. 98-3, the position of Accounting Supervisor will be added to Appendix, Designated Positions, of the Conflict of Interest Code; and the Senior Accountant position will be deleted. Bi That the Appendix of the Conflict of Interest Code of the City of Tustin, approved by the City Council with the adoption of Resolution No. 97-53, should be modified and updated to delete the position of Senior Accountant from those positions required to file a Statement of Economic Interests. Gl That the revised Appendix, attached hereto, be approved and the Conflict of Interest Code be modified accordingly. De That pursuant to Section 4 of the Conflict of Interest Code of the City of Tustin, the City Council, as the Code-reviewing body, hereby instructs all persons occupying a designated position to file with the City Clerk's office a Statement of Economic Interests as required: assuming position, annually, and leaving position. If the City Manager determines that a particular consultant must comply with the above disclosure requirements, the City Manager shall notify the consultant in writing. The written notification shall include a description of the consultant's duties and, based upon those duties, a statement of the extent of the disclosure requirements. The City Manager's notification is a public record and shall be retained for public inspection by the City Clerk in the same manner and location as this Conflict of Interest Code. DISCLOSURE CATEGORIES: The foregoing positions (Consultants excluded) will be assigned Disclosure Categories of I, II, and III. Category I: Category I1: Category II1: Investment and real property disclosure. Personal income disclosure. Business Income, Commissions' and Position Disclosure. * The City Council, City Manager, City Attorney, City Treasurer, Finance Director, and Planning Commissioners are required to file Statement of Economic Interests Form 700 pursuant to Government Code Section 87200 and are, therefore, not included as designated positions in this Appendix, 2:DESGPOSA
