CALL TO ORDER ROLL CALL PUBLIC INPUT CLOSED SESSION - The City Council shall convene in closed session to: 1) Confer with the City Attorney regarding pending litigation to which the City is a party, Santa Ana Unified School District vs. City of Tustin, Case Number 01CC02595 (state court matter). 2) Consider a performance evaluation pursuant to Government Code Section 54957 (City Manager). 3) Confer with the City's labor negotiator pursuant to Government Code Section 54957.6, Agency negotiator is Mayor or Mayor Pro Tem, unrepresented employee (City Manager). CALL TO ORDER INVOCATION PLEDGE OF ALLEGIANCE ROLL CALL CLOSED SESSION REPORT PROCLAMATION/CERTIFICATE OF RECOGNITION- None FIRST PUBLIC INPUT Spoke on issues opposing skatepark at Frontier Park. Expressed appreciation for Tustin's senior center and senior meal program; described upcoming SMART Program as a dial-a-ride Action Agenda - City Council November 4, 2002 - Page 1 Adopted Resolution No. 02-100, and introduced Ordinance No. 1262 service for seniors in Orange County; encouraged planning for senior population. PUBLIC HEARING (ITEMS I THROUGH 2) . ORDINANCE NO. 1262- ADOPTING BY REFERENCE VARIOUS CONSTRUCTION CODES WITH AMENDMENTS AND APPENDICES The State's Health and Safety code requires local governments to adopt the most recent editions of the model codes related to construction. The construction codes include: the California Building, Fire, Mechanical, Plumbing, and Electric Codes, and other related codes. If the City Council approves Ordinance No. 1262, the most recent editions of the construction codes with the applicable amendments will be in effect within the City of Tustin as required by state law. Recommendation by the Community Development Department: . Adopt the following Resolution No. 02-100, setting forth findings with respect to local conditions within the City of Tustin which make certain modifications and changes to the California Building, Plumbing, and Electrical Codes as amended by the State of California: RESOLUTION NO. 02-100- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, SETTING FORTH FINDINGS WITH RESPECT TO LOCAL CONDITIONS WITHIN THE CITY OF TUSTIN WHICH MAKE CERTAIN MODIFICATIONS AND CHANGES TO THE CALIFORNIA BUILDING CODE, THE CALIFORNIA PLUMBING CODE, AND THE CALIFORNIA ELECTRICAL CODE AS AMENDED BY THE STATE OF CALIFORNIA REASONABLY NECESSARY FOR HOUSING OCCUPANCIES 1 Introduce and have first reading by title only of the following Ordinance No. 1262, adopting by reference various construction codes with amendments and appendices: ORDINANCE NO. 1262- AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING SPECIFIED CHAPTERS OF ARTICLE 8 OF THE TUSTIN CITY CODE TO Action Agenda - City Council November 4, 2002 - Page 2 Adopted Resolution Nos. 02-73 and 02-74 Richard Spix Matt Fletcher . ADOPT THE 2001 EDITIONS OF THE CALIFORNIA CODES AND RELATED MODEL CODES WITH APPENDICES AND AMENDMENTS THERETO REVISIONS TO HOUSING ELEMENT UPDATE California State Law Section 65588 requires that cities and counties update their Housing Element at least every five (5) years. The Housing Element sets forth the City's five- year strategy to preserve and enhance the community's character, expand housing opportunities for the City's various economic segments, and provide the policy guidance for local decision making related to housing. On February 4, 2002, the City Council adopted the Housing Element Update. The State Department of Housing and Community Development (HCD) reviewed the Update and recommended revisions. All of the HCD revisions have been incorporated into the proposed revised Housing Element Update recommended for adoption. Representation for Mr. Juan Garcia, spoke regarding concerns of adequate housing sites within MCAS Tustin, and funding source constraints and affordability constraints. Opposed the Housing Element Update with respect to the SAUSD letter of credit and terms of settlement agreement. Recommendation of the Community Development Department: . Adopt the following Resolution No. 02-73, finding the environmental determination for the Housing Element Update approved on February 4, 2002, is adequate for the revision to the Housing Element Update: RESOLUTION NO. 02-73- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, FINDING THAT THE ENVIRONMENTAL DETERMINATION FOR THE HOUSING ELEMENT UPDATE APPROVED ON FEBRUARY 4, 2002, IS ADEQUATE FOR THE REVISION TO THE HOUSING ELEMENT UPDATE . Adoptthe following Resolution No. 02-74, approving General Plan Amendment 02-001, revising the adopted Tustin Housing Element: RESOLUTION NO. 02-74- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING AN AMENDMENT TO Action Agenda - City Council November 4, 2002 - Page 3 Approved Approved Ratified Adopted Resolution No. 02-97 Approved Approved GENERAL PLAN AMENDMENT 02-001, REVISING THE ADOPTED TUSTIN HOUSING ELEMENT CONSENT CALENDAR (ITEMS 3 THROUGH 8 ) , APPROVAL OF MINUTES - OCTOBER 21, 2002 REGULAR MEETING Recommendation: Approve the City Council Minutes of October 21, 2002. , APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL Recommendation: Approve Demands in the amount of $322,839.77 and ratify Payroll in the amount of $458,235.91. , PLANNING COMMISSION ACTION AGENDA- OCTOBER 28, 2002 All actions of the Planning Commission become final unless appealed by the City Council or member of the public. Recommendation: Ratify the Planning Commission Action Agenda of October 28, 2002. , RESOLUTION NO. 02-97- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AUTHORIZING THE DESTRUCTION OF CERTAIN CITY RECORDS AND PAPERS IN THE POSSESSION OF THE CITY CLERK OF THE CITY OF TUSTIN NO LONGER REQUIRED FOR THE CONDUCT OF CITY BUSINESS, PURSUANT TO THE AUTHORITY GRANTED BY THE CITY OF TUSTIN'S RECORDS RETENTION SCHEDULE Recommendation: Adopt Resolution No. 02-97, authorizing the destruction of records in the possession of the City Clerk as recommended by the Office of the City Clerk. , APPROVAL OF CONSULTANT SERVICES AGREEMENT FOR ARCHITECTURAL DESIGN SERVICES AND CONSTRUCTION DOCUMENTS FOR THE CENTENNIAL PARK RESTROOM, PICNIC SHELTER AND TOT LOT RENOVATION PROJECT Recommendation: Authorize the Mayor and City Clerk to execute a Consultant Services Agreement with the firm of Purkiss Rose-RSI for the Centennial Park Renovation in an amount not to exceed $47,500 as recommended by the Director of Parks and Recreation Services. o CANINE SALES AGREEMENT Recommendation: Approve the Sales Agreement between the City of Tustin and Officer Alex Kiilehua releasing the City of responsibility and/or liability concerning Police canine, Action Agenda - City Council November 4, 2002 - Page 4 Morres as recommended by the Police Department. REGULAR BUSINESS - None SECOND PUBLIC INPUT- None OTHER BUSINESS/COMMITTEE REPORTS MD Comments concerning Social Security. Spoke on political mailers for local election. Thanked Beverley White for her contribution to the City. Commented on campaign mailers and election tomorrow. LB Asked City Manager status of traffic situation at Tustin Green. Thanked Pat Sanchez for efforts at Tustin High School's Halloween Howl. Congratulated Anaheim Angels on World Series win. Thanked Beverley White. Tim Serlet and Lou Bone attended Water Advisory Council and commented on the following areas from the meeting: 1) Ocean bacteria 2) Infrastructure improvements in cities 3) Water usage depletion. TK Commented that the Ground Water Replenishment System and recycling programs prevent water shortages. Dino Dash well attended. Halloween event at Tustin High School was a huge success. Announced workshop to be held on Nov. 21,2002 for Pioneer Park, and welcomed public to attend and provide input to process. Thanked Beverley White for her work in Tustin and commented. that she will be missed. JT Announced election day and encouraged all to vote. Commented on election and campaign process. Stated discontentment towards a school board member confronting a candidate in a public meeting. Mayor's Prayer Breakfast at 7am at Marconi Museum - Sheriff Action Agenda - City Council November 4, 2002 - Page 5 Carona speaking on Child Protection. Monday, Nov. 11, 2002 is the Veteran's Day Parade. Thanked Tustin Schools Foundation for Dino Dash success. Tree Lighting Ceremony is scheduled for December 6, 2002. Commented on a letter from Chief Foster concerning postal fraud in Tustin Ranch.
