HUSTON, CITY MANAGER NO. 6 11-18-02 ~ FROM: PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION SUBJECT: ADOPTION OF FINAL NEGATIVE DECLARATION AND APPROVAL OF PLANS AND SPECIFICATIONS AND AUTHORIZATION TO ADVERTISE FOR BIDS- IRVlNE BOULEVARD STORM DRAIN PROJECT (CIP NO. 5024) SUMMARY The project will provide for drainage improvements on Irvine Boulevard. The plans and specifications include only Phase I of the project, which involves drainage improvements between El Modena-lrvine Channel east of Newport Avenue and the intersection of Holt Avenue and Irvine Boulevard. A Final Negative Declaration has been prepared for the entire project and it has been determined that there will not be significant impacts pending incorporation of appropriate mitigation. RECOMMENDATION It is recommended that the City Council take the following actions: 1. Adopt Resolution No. 02-101, approving the Final Negative Declaration for the Irvine Boulevard Storm Drain Project (CIP No. 5024). 2. Adopt Resolution No. 02-102, approving the plans and specifications for the Irvine Boulevard Storm Drain Project- Phase I (CIP No. 5024), and authorizing and directing the City Clerk to advertise for bids. FISCAL IMPACT The City's FY 2002-2003 Capital Improvement Program (CIP) budget provides funding for the construction and contract administration of the Irvine Boulevard Storm Drain Project- Phase I (CIP No. 5024). The engineer's construction estimate to complete this work is $600,000. Funding will be provided from a combination of CIP and Redevelopment Agency funds. Pending receipt of bids, a supplemental appropriation may be needed to fully fund the Phase I construction effort. If such an appropriation is necessary it will be requested at the time of award. ENVIRONMENTAL ANALYSIS A Final Negative Declaration has been prepared for the Irvine Boulevard Storm Drain Project (ClP No. 5024). The Draft Negative Declaration was circulated for public review from September 5, 2002, to September 25, 2002, and two comment letters were received. These comments, and responses to the comments, have been included in the Final Negative Declaration. As stated in the Final Negative Declaration, all potential impacts of the project can be mitigated to a level of insignificance with appropriate mitigation. All mitigation measures have been incorporated into the project. A copy of the Final Negative Declaration is available for review in the Public Works Department. Irvine Boulevard Storm Drain Project (CIP No. 5024) November 18, 2002 Page 2 BACKGROUND The Irvine Boulevard Storm Drain Project (CIP No. 5024) will be constructed in multiple phases. Phase I of the improvements includes constructing the inlet structure to the El Modena Irvine Channel east of Newport Avenue and increasing the drainage capacity in the vicinity of Holt Avenue. Phase II will continue the improvements along Irvine Boulevard from Holt Avenue to Prospect Avenue, and Phase III will continue further west along Irvine Boulevard and complete the drainage capacity enhancements at the SR-55 Freeway underpass. Phases II and III will be constructed as separate projects at a later date. Since construction of the Phase I drainage improvements will impact parking and access to the commercial businesses within the property bounded by Holt Avenue, Irvine Boulevard, and Newport Avenue, an Agreement with the impacted businesses has been prepared. The Agreement identifies the City's intentions to accommodate the parking and accessibility needs of the impacted businesses during Phase I construction and limits these businesses from making claims against the City. Approval of the Agreement is to be considered by the City Council under a separate agenda item. The City has obtained an encroachment permit from the Orange County Flood Control District authorizing the City to construct the proposed improvements within its boundary. For the portion of Phase I construction across Newport Avenue, the construction will occur in sections to minimize disruption of traffic. Similarly, on Irvine Boulevard and at the intersection of Holt Avenue and Irvine Boulevard, the contractor will be required to maintain a minimum of one through lane of traffic in each direction during construction. It should be noted that during construction, traffic in this area will be heavily congested. Attachments: Resolution No. 02-101 and No. 02-102 Location Exhibit 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 RESOLUTION NO. 02-101 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ADOPTING THE FINAL NEGATIVE DECLARATION AS ADEQUATE FOR THE IRVINE BOULEVARD STORM DRAIN PROJECT (CIP No. 5024) AS REQUIRED BY THE CALIFORNIA ENVIRONMENTAL QUALITY ACT. The City Council of the City of Tustin does hereby resolve as follows' I. The City Council finds and determines as follows: A, That Irvine Boulevard Storm Drain Project (CIP No. 5024)is considered a "project" pursuant to the terms of the California Environmental Quality Act; and Bo A Negative Declaration has been prepared for this project and has been distributed for public review. II. A Final Negative Declaration has been completed in compliance with CEQA and state guidelines. The City Council has received and considered the information contained in the Negative Declaration prior to recommending approval of the proposed project, and found that it adequately discussed the environmental effects of the proposed project. Further, the City Council finds the project involves no potential for any adverse effects, whether individually or cumulatively, on wildlife resources; and, therefore, makes a De Minimis Impact finding related to the California State Department Fish and Game Code Section 711.4. Thomas, Mayor City Clerk 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 02-102 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA APPROVING PLANS AND SPECIFICATIONS FOR THE IRVlNE BOULEVARD STORM DRAIN PROJECT- PHASE I (CIP NO. 5024) AND AUTHORIZING ADVERTISEMENT FOR BIDS WHEREAS, it is the intention of the City Council of the City of Tustin, California to contract for the Irvine Boulevard Storm Drain Project - Phase I (CIP No. 5024); and WHEREAS, the City Engineer has presented plans and specifications for the construction of said work; and WHEREAS, the project will not have a significant effect on the environment with the incorporation of mitigation measures and a Final Negative Declaration has been adopted for the project. NOW, THEREFORE, BE IT RESOLVED that the plans and specifications presented by the City Engineer are hereby approved as the plans and specifications for: Irvine Boulevard Storm Drain Project- Phase I (CIP No. 5024) BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and directed to advertise as required by law for the receipt of sealed bids or proposals for the performance of the work specified in the aforesaid plans and specifications; PASSED AND ADOPTED at a regular meeting of the City Council of the City of Tustin held on the 18th day of November 2002.
