CLOSED SESSION Mayor Thomas announced the City
Council would convene in closed session to:
1 ) Confer with the City Attorney regarding pending litigation to
which the City is a party, Santa Ana Unified School District
vs. City of Tustin, Case Number 01CC02595 (state court
matter).
2) Consider a performance evaluation pursuant to Government
Code Section 54957 (City Manager).
3) Confer with the City's labor negotiator pursuant to
Government Code Section 54957.6, Agency negotiator is
Mayor or Mayor Pro Tem, unrepresented employee (City
Manager).

Thanked Council and Parks and Recreation Commission for
listening and acting on concerns to issues opposing skatepark at
Frontier Park.
Announced he was recently sworn in as a Senior Assemblyman
and served on the Orange County Advisory Council and Senior
Advisory Board; expressed appreciation for Tustin's senior center
and senior meal program; described upcoming SMART Program
as a dial-a-ride service for seniors in Orange County; encouraged
planning for senior population.

ORDINANCE NO. 1262- ADOPTING BY REFERENCE
VARIOUS CONSTRUCTION CODES WITH
AMENDMENTS AND APPENDICES
Mayor Thomas opened the public hearing at 7:20 p.m.
There were no speakers on the subject and the public
hearing was closed.
It was moved by Worley, seconded by Kawashima, to adopt
the following Resolution No. 02-100, setting forth findings

with respect to local conditions within the City of Tustin
which make certain modifications and changes to the
California Building, Plumbing, and Electrical Codes as
amended by the State of California:
RESOLUTION NO. 02-100 - A RESOLUTION OF THE
CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA,
SETTING FORTH FINDINGS WITH RESPECT TO LOCAL
CONDITIONS WITHIN THE CITY OF TUSTIN WHICH
MAKE CERTAIN MODIFICATIONS AND CHANGES TO
THE CALIFORNIA BUILDING CODE, THE CALIFORNIA
PLUMBING CODE, AND THE CALIFORNIA ELECTRICAL
CODE AS AMENDED BY THE STATE OF CALIFORNIA
REASONABLY NECESSARY FOR HOUSING
OCCUPANCIES
Motion carried 5-0.
It was moved by Doyle, seconded by Worley, to introduce
and have first reading by title only of Ordinance No. 1262,
adopting by reference various construction codes with
amendments and appendices.

AMENDING SPECIFIED CHAPTERS OF ARTICLE 8 OF
THE TUSTIN CITY CODE TO ADOPT THE 2001
EDITIONS OF THE CALIFORNIA CODES AND RELATED
MODEL CODES WITH APPENDICES AND
AMENDMENTS THERETO
REVISIONS TO HOUSING ELEMENT UPDATE
Mayor Thomas opened the public hearing at 7:28 p.m. The
following members of the audience spoke in opposition to
the Housing Element Update and both submitted materials
to Council:

There were no other speakers on the subject and the public
hearing was closed at 7:38 p.m.

Update approved on February 4, 2002, is adequate for the
revision to the Housing Element Update:

FINDING THAT THE ENVIRONMENTAL
DETERMINATION FOR THE HOUSING ELEMENT

ADEQUATE FOR THE REVISION TO THE HOUSING
ELEMENT UPDATE

It was moved by Doyle, seconded by Kawashima, to adopt
the following Resolution No. 02-74, approving General Plan
Amendment 02-001, revising the adopted Tustin Housing
Element:

COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA,
APPROVING AN AMENDMENT TO GENERAL PLAN

CONSENT CALENDAR (ITEMS 3 THROUGH 8 )
Item No. 7, Approval Of Consultant Services Agreement For
Architectural Design Services And Construction Documents For
The Centennial Park Restroom, Picnic Shelter And Tot Lot
Renovation Project, was removed from the Consent Calendar by
Councilmembers Bone and' Kawashima.
It was moved by Worley, seconded by Doyle, to approve the
remainder of the Consent Calendar as recommended by staff.
Motion carried 5-0.

Recommendation: Approve the City Council Minutes of
October 21,2002.

Recommendation: Approve Demands in the amount of
$322,839.77 and ratify Payroll in the amount of
$458,235.91.

PLANNING COMMISSION ACTION AGENDA-OCTOBER
28, 2002
All actions of the Planning Commission become final unless
appealed by the City Council or member of the public.
Recommendation: Ratify the Planning Commission Action
Agenda of October 28, 2002.
RESOLUTION NO. 02-97- A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA,
AUTHORIZING THE DESTRUCTION OF CERTAIN CITY
RECORDS AND PAPERS IN THE POSSESSION OF THE
CITY CLERK OF THE CITY OF TUSTIN NO LONGER
REQUIRED FOR THE CONDUCT OF CITY BUSINESS,
PURSUANT TO THE AUTHORITY GRANTED BY THE
CITY OF TUSTIN'S RECORDS RETENTION SCHEDULE
Recommendation: Adopt Resolution No. 02-97, authorizing
the destruction of records in the possession of the City Clerk
as recommended by the Office of the City Clerk.
CANINE SALES AGREEMENT
Recommendation: Approve the Sales Agreement between
the City of Tustin and Officer Alex Kiilehua releasing the City
of responsibility and/or liability concerning Police canine,
Morres as recommended by the Police Department.

APPROVAL OF CONSULTANT SERVICES AGREEMENT
FOR ARCHITECTURAL DESIGN SERVICES AND

RENOVATION PROJECT
Councilmember Bone asked that a construction completion
date be given on the contract.
Pat Sanchez, Director of Parks and Recreation, responded
the project would be completed by July 1,2003 and it would
be stated in the construction contract.
Councilmember Kawashima noted the workshop would be
held on November 21,2002.
It was moved by Worley, seconded by KawaShima, to
approve the consultant services agreement with Purkiss
Rose-RSl.

OTHER BUSINESS
SOCIAL SECURITY
Councilmember Doyle commented on Social Security.
ELECTION
Councilmember Doyle spoke on negative political mailers for local election.
Mayor Pro Tem Worley commented on recent campaign mailers and encouraged voters
to ignore the negative literature.
Councilmember Kawashima announced election day tomorrow; encouraged all to vote;
disappointed in campaign process this year; and urged voters to ignore negative mailers.
Mayor Thomas commented on election and campaign process; stated discontentment
towards a school board member confronting a candidate in a public meeting.
DEPUTY CITY CLERK, BEVERLEY WHITE
Council thanked Beverley White for her contribution to the City; commented that she
would be missed; and wished her luck at the City of Fullerton.
TUSTIN GREEN
Councilmember Bone asked City Manager status of traffic situation at Tustin Green.
Bill Huston, City Manager, responded that Tustin Police Department was coordinating
with Tustin Unified School District to rectify problem.
HALLOWEEN HOWL
Councilmember Bone thanked staff for efforts at Tustin High School's Halloween Howl.
Councilmember Kawashima stated Halloween event at Tustin High School was a huge
success,
ANAHEIM ANGELS
Councilmember Bone congratulated Anaheim Angels baseball team on World Series win.

WATER ADVISORY COMMITTEE OF ORANGE COUNTY (WACO)
Councilmember Bone noted he and Tim Serlet, Director of Public Works, attended a
WACO meeting; Tustin using more water than last year and importing 60%; ocean
bacteria has improved over last 43 years; more focus was needed on infrastructure
improvements to alleviate problem; Southern California average temperature up from 4 to
5% in last 100 years due to population increases and shopping center developments;
California would be out of usable water within next 20-25 years; and heavy rains
projected from January through March followed by a 20 year drought.
ORANGE COUNTY SANITATION DISTRICT
Councilmember Kawashima commented that the Ground Water Replenishment System
and recycling programs prevented water shortages.
DINO DASH
Councilmember Kawashima remarked that Dino Dash well attended.
Mayor Thomas thanked Tustin Schools Foundation for Dino Dash success and stated
1,000 more participants attended this year.
PARK WORKSHOP
Councilmember Kawashima announced workshop to be held on November 21,2002 for
Pioneer Park and others; and welcomed public to attend and provide input to process.
PRAYER BREAKFAST
Mayor Thomas announced Mayor's Prayer Breakfast November 7, 2002 at 7:00 a.m. at
Marconi Museum; Sheriff Mike Carona would speak on child protection.
VETERAN'S DAY PARADE
Mayor Thomas announced that Monday, November 11,2002 was the Veteran's Day
Parade.
TREE LIGHTING CEREMONY
Mayor Thomas stated the Tree Lighting Ceremony was scheduled for December 6, 2002
and invited everyone to attend.
POSTAL FRAUD
Mayor Thomas commented on a memo from Chief Foster concerning postal fraud in
Tustin Ranch.

ADJOURNMENT- Mayor Thomas adjourned the meeting at 8:19 p.m. The next regular meeting of
the City Council was scheduled for Monday, November 18, 2002, at 7:00 p.m. in the Council Chamber
at 300 Centennial Way.
