That the Planning Commission adopt Resolution No. 4245 approving Conditional Use Permit (CUP) 201316 to authorize establishment of a master sign plan for the Amalfi Apartment homes as required in the Tustin City Sign Code. APPROVAL AUTHORITY: Pursuant to the Tustin City Code (T CC 9403h), the proposed project requires approval of a master sign plan through a Conditional Use Permit (CUP). The Planning Commission is the review authority for a Conditional Use Permit. A master sign plan is required for developments in specific plan, planned development and planned community districts, multiuse sites, multi - tenant centers and mixed use districts in the City. The purpose of a master sign plan is to encourage coordinated and quality sign design (integrated with architectural style of project) on sites where a large number of signs will occur. In addition, the master sign plan should include permanent directional /information signs to facilitate smooth internal circulation by motorists. 13ACKGROUND: Location and Surrounding Properties Amalfi Apartment domes (formerly Legacy villas) consists of 533 apartments that are currently under construction on a 21,735 acre site. The project site is located at Disposition Parcel 2A, Planning Area 13, Neighborhood D at Tustin Legacy. The proposal includes project identification signs, permanent directional and temporary signs. Project Directory PC Report January 14, 2014 CUP 2013 -16 Page 4 Sign Type A- Sign Type A is a Primary Community Entry Sign and is proposed to be located at the corner of Legacy Road and Tustin Ranch Road. It is a cube type sign with 4 sides and is proposed at 12 ft tall and 11 ft wide. I,�_ (G, /,(( ''`( Only one sign of this type is proposed and is intended to identify the apartment community from the main arterial at Legacy Road and Tustin Ranch Road. Sign 1 ype A Sign Typo B and Cs Sign Type B is a double sided project identification monument sign and Type C is a single sided monument sign. Two Type B signs are proposed to be located at the two entries off of Warner Avenue and Legacy Road. The signs are proposed at 6 feet in height and 12 feet in length. Two Type C signs are proposed and are a maximum of 7 feet in A M A L F I height and 12 feet in length. The first is proposed at the corner of APARTMENT HOMES Tustin Ranch Road and Warner Avenue and the second is proposed at the corner of Warner Avenue and Legacy Road. These signs will be internally illuminated through the sign copy Sign type B and C only and may be externally illuminated as well. Sign Type Do Sign Type D are permanent leasing signs which are intended to inform potential tenants of leasing opportunities and availability. A total of three signs are proposed. One along Warner Avenue prior to the north entrance; one on Legacy Road prior to the west entrance; and one on Tustin Ranch Road on the south side of the property. PC Report January 14, 2014 CUP 201316 Page 5 Sign Typo C Sign Type E consists of permanent flags which are proposed to flank each of the entrances. These flags are intended to identify the project entries and to enliven the entry drives. The overall height of the pole is 21 feet and the flags are designed with a rectilinear shape. A maximum of up to 8 flags (four on each side of the entry drive aisle) are proposed along each of the entries (total of 16 flags). A note has been included that flags will be kept in good condition and free of warping, fraying and sun damage. N W W o S Jy 4� e Sign Type F- A decorative construction fence sign is proposed along Tustin Ranch Road to provide interest to the temporary construction fence while the project is under construction. The temporary sign is designed with information and pictures informing potential tenants of the project name and opening dates for the apartment homes. Example of style of allowed sigii design Sign Typo Go Sign Type G is a project directory sign which is intended to provide direction within the apartment community to visitors. A total of two signs are proposed and will be located at each entry. The wall on which the directory will be mounted is proposed to be up to 7 feet in height and 9 feet in width. Although the proposal is for a maximum of 63 square feet of signage, these signs are typically designed to provide a direction finding map with a voice call entry keypad for visitors to contact residents within the apartment community. Sign Type Ho Example of allowed sign design Miscellaneous on -site signs have been proposed as part of Sign Type H. 'These signs would be located within the interior of the community and would not be visible from the PC Report January 14, 2014 CUP 201316 Page 6 public right -of -way. These signs are intended to provide legal information; interior directional information; addressing; and other necessary signage (i.e. handicap parking, directional signs to the leasing office, private property, etc.). The proposed master sign plan for Amalfi Apartment Homes will provide a coordinated and quality sign design for the community. Staff has worked with the developer to provide adequate permanent and temporary signage which is consistent with other developments within the City of Tustin and other master planned communities. The proposed signage has been designed for consistency with the architectural style of the apartment home project. In addition, the master sign plan will provide permanent directional and informational signs to facilitate smooth internal circulation by motorists to access the apartment community and navigate throughout the complex safely. FINDINGS- In determining whether to approve the Conditional Use Permit for the proposed master sign plan, the Planning Commission must determine whether or not the proposed signage will be detrimental to the health, safety, morals, comfort, or general welfare of the persons residing or working in the neighborhood, nor be injurious or detrimental to the property and improvements in the neighborhood of the subject property, or to the general welfare of the City of Tustin. A decision to approve this request may be supported by the following findings: 1. Pursuant to Section 9403(h) of the Tustin City Code, a master sign plan is required for developments in specific plan, planned development and planned community districts, multiuse sites, multi - tenant centers and mixed use districts with the approval of a Conditional Use Permit from the Planning Commission. The Amalfi Apartment Homes are within a residential district of the MCAS Tustin Specific Plan and therefore meets the necessary threshold to allow signs throughout the residential community. 2. The Amalfi Apartment Homes project is a self- contained apartment community which has the necessary components to support flexible sign design. Adequate sign standards are contained within the master sign plan to reflect a common theme, incorporate design elements in terms of sizing, scale, massing, materials, letter styles, colors, illumination, sign type and sign shape to ensure that signage has been coordinated throughout the project site. 3. The master sign plan, as proposed, would not have an adverse impact on adjacent properties in that the signage design and locations have been oriented to minimize the overall number of signs while maximizing the project identification and directional signs for the apartment community. As proposed, the signs would be compatible with the visual characteristics of the development, compatible with other signs in the surrounding area, and would not detract from PC Report January 14, 2014 CUP 201316 Page 7 adjacent developed properties. 4. The scale and massing of the proposed signs reflect the architecture of the buildings /structures on the site and are consistent with the size and scale of the site and the overall development within the community. That a proper application, Conditional Use Permit 201316, was filed by Baab & Associates on behalf of Legacy Villas, LLC, requesting authorization to establish a master sign plan for the Amalfi Apartment Homes located at 16000 Legacy Road. SIGNS (1) 2.1 A sign permit shall be applied for and obtained from the Community Development Department prior to constructing, erecting, altering, replacing, moving, or painting any sign, except for signs exempt from a permit according to the Tustin Sign Code. (1) 2.3 All signs shall be structurally safe and maintained in good condition at all times. The Community Development Director shall have the authority to order repair, replacement, or removal of any signs which constitute a hazard or nuisance to the safety, health, or public welfare by reason of inadequate maintenance, dilapidation, or obsolescence. (1) 2.4 All signs shall be constructed of a noncorrosive, rust - resistant finish so as not to degrade in adverse weather conditions. (1) 2.6 The locations for any signs shall comply with the City of Tustin Guidelines for Determining Sign Location Visual Clearance and Public Safety Areas. Signs shall not be placed in a manner that will obstruct or inhibit sight distance or visibility for the motorist. At plan check submittal, all signs shall be clearly identified on plans as to the exact locations. Any signs in proximity to the public right -of -way that could impact driver sight shall be shown at a larger scale that will be adequate for plan check purposes. (3) 2.7 At the time of building permit application, the plans shall comply with the current edition of the codes (2013 California Building Standards Code), City Ordinances, State, Federal laws, and other regulations as adopted by the City Council of the City of Tustin. (1) 2.8 All signs shall be located on --site within the property boundaries. All signs, both temporary and permanent, shall riot be erected, posted, or displayed within the pi blic right -of -way. Failure to comply with these requirements specified will result in the issuance of an administrative citation pursuant to TCC 1162(a). FEES (2) 3.1 Within forty -eight (48) hours of approval of the subject project, the applicant shall deliver to the Community Development Department, a cashier's cheek payable to the COUNTY CLERK in the amount of fifty dollars ($50.00) to enable the City to file the appropriate environmental documentation for the project. If within such forty -eight (48) hour period that applicant has not delivered to the Community Development Department the above-noted check, the statute of limitations for any interested party to challenge the environmental determination under the provisions of the California Environmental Quality Act could be significantly lengthened.
