Miller Community Center — 300 Centennial Way, Tustin, CA 92780 TAMIL ill_PLCL PUBLIC INPUT — Members of the public may address the Building Board of Appeals on the items listed on the agenda for this special closed session meeting. CLOSED SESSION ITEMS - The Brown Act permits local governmental bodies to discuss certain matters without members of the public present. The Building Board finds, based on advice from the City Attorney, that discussion in open session of the following matters will prejudice the position of the City in potential or anticipated litigation: 1. CONFERENCE WITH LEGAL COUNSEL — EXPOSURE TO LITIGATION [Government Code § 54956.9(d2)] — One Case SPECIAL MEETING OF THE BUILDING BOARD OF APPEALS (City Council Chambers) 6:00 P.M. CALL TO ORDER: 6:00 p.m. in the City Council Chambers, 300 Centennial Way, Tustin, CA 92780 ROLL CALL: Board Members Altowaiji, Kozak, Lumbard, Smith, Thompson CONSENT CALENDAR: 1. APPROVAL OF MINUTES — JANUARY 14, 2014 BUILDING BOARD OF APPEALS MEETING. RECOMMENDATION: That the Board approve the minutes of the January 14, 2014 meeting as provided. Any writings or documents provided to a majority of the Planning Commission regarding any Item on this agenda will be made available for public inspection in the Community Development Department located at 300 Centennial Way, Tustin, California, during normal business hours. In compliance with the Americans With Disabilities Act, IT you need special assistance to participate In this meeting, please contact the office of the City Clerk at (714) 573.3025. Notification 72 hours prior to the meeting will enable the City to make reasonable arrangements to assure accessibility to this meeting. 979716,1 PUBLIC HEARING: 2. APPEAL OF SCHOOL FEE CALCULATION —THE IRVINE COMPANY On October 22, 2013, the Tustin Building Official forwarded correspondence to The Irvine Company with a determination concerning the City of Tustin's interpretation of Government Code Section 65995(b)(1). Specifically in question is the interpretation of the term "Assessable Space' and the Building Division's standard practice in calculating a building's square footage for the purpose of determining required school fees. A comparison of the disputed fee calculation will be provided. On November 21, 2013, The Irvine Company filed an appeal of this determination. Resolutions have been prepared for the Board's consideration. Presentation: Elizabeth A.
