CALL TO ORDER/PLEDGE OF ALLEGIANCE The meeting was called to order by Mayor Puckett at 7:00 p.m. in the City Council Chambers, 300 Centennial Way. The Pledge of Allegiance was led by Councilmember Prescott. II. INVOCATION The Invocation was given by Rev. Alan Waterson, Aldersgate United Methodist Church. III. PROCLAMATIONS 1. NATIONAL VOLUNTEER WEEK, APRIL 27 -MAY 1 Mayor Puckett read and presented a proclamation declaring National Volunteer Week. James Kane, Parks and Recreation Commission Chairperson, accepted the proclamation and thanked all volunteers who had served the community. 2. COMMUNITY COLLEGE MONTH - APRIL Mayor Puckett read and presented a proclamation acknowledging Community College Month. Dr. Donald Rickner, Dean of Community Relations, Irvine Valley College, accepted the proclamation on behalf of all students attending community colleges in the area. 3. CLEAN AIR WEEK, MAY 2-9 Mayor Puckett read and presented a proclamation supporting Clean Air Week. Kathy Santoro, American Lung Association Board Member, thanked the Council for the proclamation and encouraged everyone to implement steps to improve air quality. V. PUBLIC HEARING 1. CODE AMENDMENT 92-004, TEMPORARY SIGNS Rita Westfield, Assistant Director of Community Development, reported that in February 1992, the Chamber of Commerce requested the Council relax the Sign Code provision related CITY COUNCIL MINUTES Page 2, 4-21-92 to banner signs and other temporary signs due to freeway construction and the recession. She stated that the Planning Commission, Chamber of Commerce, and staff had formed a Chamber Business Promotion Committee to discuss banner and sign code alternatives. She summarized the proposed code amendment including: modifying time limits, height limits, and bond requirements for business banner signs. Mayor Puckett opened the public hearing at 7:18 p.m. There were no speakers on the subject and the public hearing was closed. It was moved by Edgar, seconded by Pontious, that Ordinance No. 1085 have first reading by title only. Motion carried 5-0. Following first reading by title only of Ordinance No. 1085 by the City Clerk, it was moved by Edgar, seconded by Pontious, that the following Ordinance No. 1085 be introduced: ORDINANCE NO. 1085 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING SUBSECTIONS 9403B1. AND 9403C1. OF ARTICLE 9, CHAPTER 4 OF THE TUSTIN CITY CODE RELATING TO TEMPORARY SIGNS Motion carried 5-0. 680-40 VI. PUBLIC INPUT 1. PROCLAMATION PRESENTED TO COUNCILMEMBER EDGAR Janet Hester, California League of Cities representative, presented a proclamation to Councilmember Edgar in recognition of service given to Orange County cities during his 16 years as a member of the City Council. — Councilmember Edgar accepted the proclamation and thanked the League of Cities for the honor. He stated the past 16 years of service as a councilmember were rewarding and he was proud of the following accomplishments: the Tustin Ranch development; Jamboree Road extension through the Marine Corps Air Station; the City's fiscal stability; and his work with numerous County agencies. He thanked the citizens of Tustin for the opportunity to serve the community. VII. CONSENT CALENDAR Item No. 6 was removed from the Consent Calendar by Mayor Puckett. It was moved by Prescott, seconded by Potts, to approve the remainder of the Consent Calendar as recommended by staff. Motion carried 5-0. 1. APPROVAL OF MINUTES - APRIL 6, 1992 REGULAR MEETING Recommendation: Approve the City Council Minutes of April 6, 1992. 2. APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL Recommendation: Approve Demands in the amount of $753,396.21 and ratify Payroll in the amount of $333,769.32. 368-82 3. RESOLUTION NO. 92-56 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AUTHORIZING THE DESTRUCTION OF CERTAIN CITY RECORDS, DOCUMENTS, AND PAPERS IN THE POSSESSION OF THE POLICE DEPARTMENT OF THE CITY OF TUSTIN NO LONGER REQUIRED FOR THE CONDUCT OF CITY BUSINESS PURSUANT TO THE AUTHORITY GRANTED BY SECTIONS 34090, 34090.5 AND 34090.7 OF THE GOVERNMENT CODE OF THE STATE OF CALIFORNIA Recommendation: Adopt Resolution No. 92-56 allowing the destruction of selected records, documents and papers as allowed by law as recommended by the Police Department. 170-40 CITY COUNCIL MINUTES Page 3, 4-21-92 4. REJECTION OF CLAIM NO. 92-18 EDISON CO.; DATE OF LOSS, 3/11/92 - CLAIMANT, SOUTHERN CALIFORNIA 9/19/91; DATE FILED WITH CITY, Recommendation: Reject subject claim for property damage in the amount of $3,668.12 as recommended by the City Attorney. 180-10 S. REJECTION OF CLAIM NO. 91-55 - CLAIMANT, CHRIS TWOGOOD; DATE OF LOSS, 12/10/91; DATE FILED WITH CITY, 12/17/91 Recommendation: Reject subject claim for property and personal injury damages in the amount of $1,000 as recommended by the City Attorney. 180-10 7. RESOLUTION NO. 92-55 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING WORKS OF IMPROVEMENT AND AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR THE WATER MAIN REPLACEMENT ON THEODORA DRIVE, LIVINGSTON AVENUE, LILLIAN WAY, CANDEDA PLACE, ROMANZA PLACE, LEON PLACE AND LEON WAY Recommendation: Adopt Resolution No. 92-55 accepting the subject improvements constructed and authorizing the recordation of the Notice of Completion for said improvements as recommended by the Public Works Department/Engineering Division. 400-45 8. RESOLUTION NO. 92-57 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING THE APPLICATION FOR BICYCLE AND/OR PEDESTRIAN FACILITY FUNDS UNDER SB 821 Recommendation: Adopt Resolution No. 92-57 approving the application for Bicycle and/or Pedestrian Facility Funds under SB 821 as recommended by the Public Works Department/Engineering Division. 730-45 CONSENT CALENDAR NO. 6 - AWARD OF BID FOR MISCELLANEOUS FURNITURE FOR POLICE FACILITY Mayor Puckett stated this item was agendized under the Tustin Community Redevelopment Agency. VIII. ORDINANCES FOR INTRODUCTION - None IK. ORDINANCES FOR ADOPTION 1. ORDINANCE NO. 1083, OUTDOOR BOUND AMPLIFYING DEVICES It was moved by Pontious, seconded by Edgar, that Ordinance No. 1083 have second reading by title only. Motion carried 5-0. Following second reading by title only of Ordinance No. 1083 by the City Clerk, it was moved by Pontious, seconded by Edgar, that the following Ordinance No. 1083 be passed and adopted: ORDINANCE NO. 1083 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING SECTION 4616, A PORTION OF CHAPTER 6 OF ARTICLE 4 OF THE TUSTIN CITY CODE, TO ALLOW OUTDOOR SOUND AMPLIFYING DEVICES AS AUTHORIZED BY THE TUSTIN CITY COUNCIL OR PLANNING COMMISSION Motion carried 5-0 (roll call vote). 230-65 X. OLD BIISINESS - None %I. NEW BIISINESS 1. OUTDOOR LOUDSPEAKERS - CRAB COOKER RESTAURANT, 17260 E. SEVENTEENTH STREET Christine Shingleton, Assistant City Manager, reported that the Crab Cooker restaurant requested authorization to install outdoor loud speakers in the outside waiting area. She noted recommended conditions to be included should Council grant the request. - _-..C.I.TSF--EOUNCIL_.MINUTES- Page 4, 4-21-92 It was moved by Edgar, seconded by Potts, to approve outdoor loudspeakers at the Crab Cooker restaurant with the following conditions: installation of outdoor loudspeakers shall be subject to approval of Ordinance 1083, effective May 20, 1992; loudspeakers shall be directed away from Vandenberg Lane and nearby residential areas; all exterior sound amplifying devices shall comply with exterior noise standards, stated in Section 4614 of the Tustin City Code; and should the Community Development Department receive written complaints or objections to noise caused by the outdoor loudspeakers, the Director of Community Development shall require a noise study and/or tests by a qualified professional to determine compliance with Section 4614 of the Tustin City Code and develop mitigation measures. The applicant for the loudspeaker request shall pay the cost of the study and/or tests, as well as implementation of any mitigation measures required by the Director. Motion carried 5-0. 230-65 XII. REPORTS 1. PLANNING COMMISSION ACTION AGENDA - APRIL 13, 1992 It was moved by Pontious, seconded by Edgar, to ratify the Planning Commission Action Agenda of April 13, 1992. Motion carried 5-0. 120-50 RECESS At 7:25 p.m., the meeting was recessed to the Redevelopment Agency and reconvened at 7:26 p.m. MAYOR'S ADDRESS AND PRESENTATIONS Mayor Puckett reported the status of April 1991 to April 1992 major projects and activities including: Marine Corps Air Station closure; residential and commercial recycling program; Columbus Tustin Park gymnasium; Community Improvement Partnership Program; Tustin Unified School District partnership to provide youth anti- drug and anti -gang programs; negotiations for creation of fire district; Newport Avenue underpass to Edinger Avenue; Transportation and Growth Management plans required by Measure M and Proposition 111; the Old Town Tustin Study, comprehensive review of the City's General Plan; development agreement for the Pacific Center East project; proposed alignments and EIR for the Eastern -Foothill Transportation Corridor; fiscal stability of the City; financing of major water system capital improvement projects; financing unfunded parks and recreational facilities; the Ad Hoc Child Care Committee; and several key capital improvement projects. Mayor Puckett thanked Council, staff, and his wife, Donna, for their support during the past year. Mayor Puckett presented a plaque to Councilmember Prescott for his years of service to the community from 1987 to 1992. Councilmember Prescott thanked his supporters and family and stated it had been an honor to serve as a Councilmember. Mayor Puckett presented a plaque to Councilmember Edgar for his years of service to the community from 1974 to 1978, and 1980 to 1992. Councilmember Edgar thanked the residents for the privilege of serving the City for the past 16 years. XIII. DECLARE RESULTS OF GENERAL MUNICIPAL ELECTION - APRIL 14, 1992 It was moved by Edgar, seconded by Potts, to adopt the following Resolution No. 92-54 declaring the results and other such matters as provided by law for the April 14, 1992 General Municipal Election: P- CITY COUNCIL MINUTES Page 5, 4-21-92 RESOLUTION NO. 92-54 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, RECITING THE FACT OF THE GENERAL MUNICIPAL ELECTION HELD ON APRIL 14, 1992, DECLARING THE RESULT AND OTHER SUCH MATTERS AS PROVIDED BY LAW Motion carried 5-0. 450-50 Mary Wynn, City Clerk, issued the Oath of Office to newly elected Councilmembers Jim Potts, Jeff Thomas, and Thomas R. Saltarelli. Councilmembers Potts and Thomas expressed appreciation to their supporters. Councilmember Saltarelli thanked Earl Prescott and Richard Edgar for their years of service to the City, and thanked all the candidates for maintaining a positive, issued -oriented campaign. Valerie Whiteman, Chief Deputy City Clerk, issued the Oath of Office to City Clerk, Mary Wynn. Mary Wynn thanked the residents for the honor of being elected as City Clerk. SIV. SELECTION OF MAYOR AND MAYOR PRO TEM Mayor Puckett nominated Mayor Pro Tem Pontious to serve as Mayor. There were no other nominations and she was unanimously selected as Mayor. Mayor Pontious presented a plaque to Councilmember Puckett in recognition of his term as Mayor from April 15, 1991 to April 21, 1992. Councilmember Puckett stated it had been a tremendous honor to serve as Mayor for the past year, and pledged his support to Mayor Pontious. Mayor Pontious nominated Councilmember Potts to serve as Mayor Pro Tem. There were no other nominations and he was unanimously selected as Mayor Pro Tem. 420-75 XV. PUBLIC INPUT 1. CONGRATULATIONS TO NEW COUNCIL Fabby Combs, Tustin Meadows, congratulated new Councilmembers and wished the Council harmonious, effective terms. XVI. OTHER BUSINESS - None XVII. ADJOURNMENT Mayor Pontious adjourned the meeting at 7:55 p.m. The next regular meeting of the City Council was scheduled for Monday, May 4, 1992, at 7:00 p.m. L� MARY E.
