SUBJECT: AWARD OF CONTRACT FOR NEW HYDRAULIC HAMMER
SUMMARY
Award the contract for the purchase and installation of one hydraulic hammer onto a city-owned
backhoe to Eberhard Equipment in the amount of $21,334.50.
RECOMMENDATION
It is recommended that the City Council reject the Iow bid as non-responsive and award the
contract for the purchase and installation of one hydraulic hammer onto a city-owned backhoe to
Eberhard Equipment.
FISCAL IMPACT
Total funds required including all taxes and all applicable fees are $21,334.50. These funds are
included in the fiscal year 2002/03 budget under the Water Division's Construction and
Maintenance fund, account number 70-452-9850.
BACKGROUND
On October 21, 2002 City Council authorized the City Clerk to advertise and solicit bids for the
purchase and installation of one hydraulic hammer for a city-owned backhoe. Bid Proposal
packages were sent to seven construction and equipment companies. The bid package was also
advertised in the TUstin News and appeared in the Dodge Green Sheet. Four sealed bid
proposals were received and publicly opened on November 12, 2002 at 10:00 a.m. in the City
Council Chambers, and are summarized below.

UB Equipment Corporation (UBE) submitted the apparent Iow bid for the hydraulic hammer.
However, the bid package submitted was incomplete. UBE did not submit the required Hydraulic
Hammer specification sheet which indicates whether the proposed unit complies with the various
city requirements for the unit and its components. In addition, UBE failed to indicate which of their
hydraulic hammer models was being bid, and also failed to have an authorized signature on the

bid sheet. It is therefore recommended that the City Council reject the UB Equipment Corporation
bid as non-responsive and award the contract for the hydraulic hammer to Eberhard Equipment of
Santa Ana, California, in the amount of $21,334.50
