The project is a request to construct 375 single family detached units, a focal
park, and other neighborhood amenities. The site is located within Planning
Area 15 (Neighborhood G) of the MCAS Tustin Specific Plan and generally
bounded by future Moffett Drive to the north, Jamboree Road to the east,
Warner Avenue off -ramp to the south, and future Park Avenue to the west. The
proposed project requires approval of Specific Plan Amendment, Concept Plan,
Tentative Tract Map, Design Review, Development Agreement, and Disposition
and Development Agreement. On December 10, 2013, the Planning
Commission adopted Resolution No. 4239 recommending that the City Council
approve the proposed project.
The City and the applicant requested that the City Council continue the item tc
the February 4, 2014 meeting to allow respective Attorneys to finalize the rea
estate transaction documents and the Disposition and Development Agreement.

3. APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL
The City Council has approved the use of Government Code Section 37208 to
expedite the payment of City of Tustin and Successor Agency to the Tustin
Community Redevelopment Agency obligations that are in accordance with the
approved budget or continued operations authorizations.
Recommendation: Approve Payroll in the amounts of $10,200.00 and
$1,035,873.88; and Demands in the amount of $2,165,974.38.
4. APPROVAL OF PLANS & SPECIFICATIONS AND AUTHORIZATION TO
ADVERTISE FOR BIDS FOR PEPPERTREE PARK BOCCE BALL COURTS
This project includes construction and installation of two (2) synthetic turf Bocce
Ball Courts in Peppertree Park.
Recommendation: Staff recommends that the City Council approve Resolution
No. 14 -04, approving plans and specifications for the construction of the
Peppertree Park Bocce Ball Courts and authorize the City Clerk to advertise for
bids.

In accordance with the first paragraph of the December 31, 2008 Promissory
Note ( "Note ") between the City of Tustin ( "City ") and the Successor Agency to
the Tustin Community Redevelopment Agency ( "Successor Agency "), the City
and Successor Agency are amending the Note.
Recommendation:
It is recommended that the City Council adopt Resolution No. 14 -06,
amending the December 31, 2008 Promissory Note between the City
of Tustin and the Successor Agency to the Tustin Community
Redevelopment Agency and authorize the City Manager to execute
the amended Promissory Note.

between the City of Tustin and the Successor Agency to the Tustin
Community Redevelopment Agency and authorize the Mayor to
execute the Third Amendment to the Reimbursement Agreement.

THE TUSTIN AVENUE /ROSE DRIVE TRAFFIC SIGNAL SYNCHRONIZATION
PROJECT
Staff is requesting that the City Council approve Amendment No. 1 to
Cooperative Agreement No. C -1 -3024 with the Orange County Transportation
Authority (OCTA) for implementation of the Tustin Avenue /Rose Drive Traffic
Signal Synchronization Project. The original agreement was approved on May
21, 2012 with the anticipation that the State of California would also participate
in the project. However, the State will not be participating and the agreement is
being amended to include only the cities of Santa Ana, Anaheim, Orange,
Placentia and Tustin. Also, the term of the agreement is being extended and
Tustin's share of the cost has increased. The OCTA will continue leading with
the implementation of the project.
Recommendation: It is recommended that the City Council approve
Amendment No. 1 to Cooperative Agreement No. C -1 -3024 with the Orange
County Transportation Authority for the Tustin Avenue /Rose Drive Traffic Signal
Synchronization Project, and authorize the Mayor and City Clerk to execute the
amendment on behalf of the City.
10. APPROVE AMENDMENT NO. 1 TO COOPERATIVE AGREEMENT NO. C -1-
3023 WITH THE ORANGE COUNTY TRANSPORTATION AUTHORITY FOR
THE WARNER AVENUE TRAFFIC SIGNAL SYNCHRONIZATION PROJECT
Staff is requesting that the City Council approve Amendment No. 1 to
Cooperative Agreement No. C -1 -3023 with the Orange County Transportation
Authority (OCTA) for implementation of the Warner Avenue Traffic Signal
Synchronization Project. The original agreement was approved with the
anticipation that the State of California would also participate in the project.
However, the State will not be participating and the agreement is being

amended to include only the cities of Huntington Beach, Fountain Valley, Santa
Ana and Tustin, while also extending the term an additional one year and nine
months to June 30, 2016. The OCTA will take the lead in implementing the
project.
Recommendation: It is recommended that the City Council approve
Amendment No. 1 to Cooperative Agreement No. C -1 -3023 with the Orange
County Transportation Authority for the Warner Avenue Traffic Signal
Synchronization Project, and authorize the Mayor and City Clerk to execute the
amendment on behalf of the City.
11. APPROVE COOPERATIVE AGREEMENT NO. C -3 -2007 WITH THE ORANGE
COUNTY TRANSPORTATION AUTHORITY FOR THE NEWPORT AVENUE
REGIONAL SIGNAL SYNCHRONIZATION PROJECT
Staff is requesting that the City Council approve Cooperative Agreement No. C-
3 -2007 with the Orange County Transportation Authority (OCTA) for
implementation of the Newport Avenue Regional Signal Synchronization
Project. Engineering and construction will be performed in collaboration with the
City of Orange and the County of Orange. The OCTA will take the lead in
implementing the project. Work will be performed under the OCTA Competitive
Measure M2 Traffic Signal Synchronization Program (Project P).
Recommendation: It is recommended that the City Council approve
Cooperative Agreement No. C -3 -2007 with the Orange County Transportation
Authority for the Newport Avenue Regional Signal Synchronization Project, and
authorize the Mayor and City Clerk to execute the agreement on behalf of the
City.
12. APPROVE HOMEOWNER AGREEMENT AND MEMORANDUM FOR
CERTAIN PROPERTY IN CONJUNCTION WITH THE TUSTIN RANCH ROAD
EXTENSION PROJECT BETWEEN WALNUT AVENUE AND VALENCIA
AVENUE (CIP No. 70100)
Staff is requesting the City Council approve certain agreements associated with
the required applicable noise mitigation measures as identified in the Final
Supplement #1 to the Final EIS /EIR for the Tustin Ranch Road Extension
Project CIP No. 70100 & 70206 on or adjacent to the property located at 2381
Silk Tree Drive (Receptor 14).
Recommendation: It is recommended that the City Council:
Approve the documents for 2381 Silk Tree Drive (Receptor 14) including
the Project Implementation Agreement and Memorandum of Project
Implementation Agreement, and authorize the Mayor or the City Manager
to execute the agreement on behalf of the City, subject to approval as to
City Council and Successor Agency January 21, 2014

form with any minor non - substantive modifications required by the City
Attorney; and
2. Appropriate $7,335 of unreserved funds in the CFD 06 -01 Fund (434) to
the Tustin Ranch Road Extension Project (CIP No. 70100).
13. GRANT APPLICATION FOR HOUSING RELATED PARKS PROGRAM
The State Department of Housing and Community Development (HCD) recently
announced the availability of $25 million in grant funds that may be used by
eligible local governments to fund park - related capital asset projects though the
Housing - Related Parks (HRP) Program. The HRP Program, funded by
Proposition IC, provides grant funds based on the number of bedrooms in
qualifying affordable housing units permitted between January 1, 2010, and
June 30, 2013.
The grant funds are .required to be used for the costs of park and recreation
facility creation, development, or rehabilitation, including the acquisition of land
and the construction, rehabilitation, and acquisition of park equipment and
physical property. Staff recommends that the estimated grant funds of up to
$259,800 be allocated to proposed improvements at Frontier Park.
One of the requirements of the HRP Program is a resolution from the City
Council, authorizing the submittal of the application to HCD and the execution of
an agreement with the State of California to secure the grant from HCD.
Recommendation: Adopt Resolution No. 14 -11, authorizing the submittal of a
grant application for the Housing - Related Parks Program to HCD, and the
execution of an agreement with the State of California to secure the grant from
HCD if the application is approved.

THE CITY PURCHASING SYSTEM
Ordinance No. 1438 amends Part 2 of Chapter 6 of Article 1 of the Tustin City
City Council and Successor Agency January 21, 2014

Code to satisfy a management comment finding in relation to the City's June 30,
2012 independent audit and to provide staff with a purchasing section of the
Tustin City Code that is relevant and provides clear guidance.
It was moved by Mayor Murray and seconded by Councilmember Nielsen to
have second reading by title only and adoption of Ordinance No. 1438 (roll call
vote).

15. EXCHANGE AGREEMENT BY AND BETWEEN THE SECRETARY OF THE
ARMY AND THE CITY OF TUSTIN

The United States (acting by and through the Secretary of the Army,
represented by the U.S. Army Corps of Engineers, or the "Army ") and the City
of Tustin executed a Letter Agreement and Term Sheet, dated July 30, 2013,
outlining the terms for negotiating a potential land exchange of the existing
Tustin Army Reserve Center for another similar parcel at Tustin Legacy. The
City is interested in completing such an exchange to potentially enhance the
development potential of The District at Tustin Legacy which desires to expand
its retail shopping center, including facilitating additional parking and circulation,
while also relocating the Tustin Army Reserve Center adjacent to other public
and institutional uses. Following months of negotiations, approval is requested
to execute an exchange agreement between the two parties that will implement
the exchange of real property at Tustin Legacy (the "Exchange Agreement ").
It was moved by Councilmember Nielsen and seconded by Councilmember
Gomez to adopt the revised Resolution No. 14 -05, approving an Exchange
Agreement By and Between the Secretary of the Army and the City of Tustin for
the exchange of land between Planning Areas 1 and 18 within the boundaries of
the MCAS Tustin Specific Plan.
