Adopt Resolution No. 97-109 approving Vesting Tentative Parcel Map 97-164. City Council Report ZC 97-002 and TPM 97-164 November 3, 1997 Page 2 FISCAL IMPACT. ' The applicant has paid application fees to recover the cost of processing this application. REOUESTS 1. ZONE CHANGE 97-002- A request to: A. Amend the Jamboree Plaza District Regulations to modify the Planning Area boundaries for the undeveloped portion of the Jamboree Plaza Center at the northwestern corner of Jamboree Road and Edinger Avenue; and, g. Amend the Jamboree Plaza District Regulations text to modify the Statistical Summary/Land Use Designations to reflect the above noted changes and provide consistency between the Planning Areas and the text of the District Regulations.' e VESTING TENTATIVE PARCEL MAP 97-164 - A request to subdivide the undeveloped portion of the Jamboree Plaza center (not including the future service station, carwash, or the commuter-rail station site) into 20 numbered lots and 3 lettered parcels to accommodate approximately 122,000 square feet of new retail, commercial and industrial/business park development. INTRODUCTION In June 1991, the Planning Commission and City Council approved the Jamboree Plaza District Regulations for the property located at~ the northwest corner of Jamboree Road and Edinger Avenue. These regulations, which divide the project site into four "Planning Areas" to separate the different land uses, are intended to provide for a cohesive, mixed-use center of retail, auto service, office and ~ight industrial uses with a maximum floor area of approximately 230,000 square feet. To date, a total of 26,110 square feet ha.s been developed, including a 3,000 square foot fast food restaurant in Planning Area A (Free-standing commercial) and 23,110 square feet City Council Report ZC 97-002 and TPM 97-164 November 3, 1997 Page 3 of auto service uses in Planning Area C (Auto Services). Plans for the anticipated service station in Planning Area A at the center entrance were recently approved. No development has occurred within Planning Area B (Retail/Commercial) or Planning Area D (Industrial/Office). The applicant proposes to subdivide and develop the ~:emaining 8.2 acres of the Jamboree Plaza center consistent with the allowed' uses identified in the District Regulations, which would include retail, commercial, office and industrial uses. Surrounding Uses Surrounding uses include the MCAS-Tustin helicopter station to the south and west, the Irvine Industrial Complex-Tustin' to the north across the AT & SF and OCTA railroads, and vacant land to the east across jamboree Road, zoned Public & Institutional (P&I). DISCUSSION The following discussion includes analyses of: the proposed zone change/modifications to the Jamboree Plaza District Regulations; the site plan and tentative map; access, parking and circulation; architecture; landscaping; and environmental impacts. Zone Change Approval of Zone Change 97-002 would amend the Jamboree Plaza District Regulations to reflect changes in the physical configuration of the subject site. The District Regulations currently divide the site into four distinct "Planning Areas", allowing for individual pad development along Edinger Avenue, strip retail uses, auto service uses, .and office/industrial uses. Recently, 3.67 acres of land desi~m~ated for office and industrial uses were subdivided from the Jamboree Plaza Center and sold to develop a commuter rail station. The primary difference between the existing and the proposed District Regulations will be a reconfiguration of the Planning Area boundaries to reflect the changes in the project site. The amount of land devoted to each use and the total amount of square footage has changed. The changes maximize the use of the available .land area while maintaining adequate parking for all proposed uses. The amount of building space devoted to the different Planning Areas is noted in the following Table. No City Council Report ZC 97-002 and TPM 97-164 November 3, 1997 Page 4 changes to the other aspects of the Planning Areas, such as allowed/prohibited uses and building site development standards, are proposed. Section 2.0 of the District Regulations is proposed to be amended as follows with new text shaded and deleted text struck. There are four (4) separate land use categories provided within' the Jamboree Plaza Planned Community. Land Use designations are shown on Exhibit 1 with a statistical summary of each planning area as follows' PLANNING AREA TOTAL AUTHORIZED BUILDING SQUARE FOOTAGE A 1..,~ n 20,000 C 2.0 23,200 The existing version of Exhibit 1 delineating the Planning Area boundaries is proposed to be replaced with Exhibit 1 as shown in City Council Ordinance No. 1191. Project Description, Site Plan and Tentative Parcel Map Tentative Parcel Map 97-164 would subdivide the balance of the Jamboree Plaza site (approximately 8.2 acres) into twenty numbered parcels and three lettered parcels. Parcels A and C are to be reserved for reciprocal parking and internal ingress/egress. Parcel B is intended to be an ingress/egress parcel for the-proposed commuter rail station adjacent to the northeastern City Council Report. The site is proposed to be divided into two development phases. A copy of Planning Commission Resolution No. 3556 has been included as Attachment D. Access, Circulation and Parking 'Access to the site is proposed via three driveways from Edinger Avenue, two of which are "right-in/right-out"'and the middle driveway is a signalized three-phase intersection. The eastern most driveway, constructed as part of the original Jamboree Plaza development, has a right-of- way width of thirty feet and is situated six hundred feet west of the centerline of Jamboree Road. Acceleration and deceleration lanes are also incorporated into the design of this access point. The signalized intersection has a right-of-way of seventy-four feet and is situated approximately five hundred fifty feet west of the eastern most driveway. The western 'most driveway has a right-of-way of twenty-seven and-a-half feet and is nine hUndred feet west of the si~alized intersection. City Council Report ZC 97-002 and TPM 97-164 November 3, 1997 Page 6 All internal access roads are private streets with a minimum drive aisle width of twenty-five feet. Sidewalk areas and walkways are also provided throughout the entire project site in accordance with the Americans with Disabilities Act. For Planning Areas A, C and D, parking ratios are calculated at three spaces for every thousand square feet of gross floor area. Parking ratiOs for Planning Area B, which consists primarily of retail uses, are calculated at a ratio of five spaces for every thousand square feet of gross floor area. The Uniform Building Code requires a total of eight handicap-accessible parking spaces. The proposed site plan provides twelve accessible parking spaces. Combining the parking spaces already developed and the proposed spaces, the applicant proposes to have five hundred fifteen (515) spaces on site. Architecture and Landscaping A number of buildings have been approved and/or developed within the Jamboree Plaza Center since the District Regulations were adopted in 1991. All proposed buildings are required to be architecturally compatible with .the existing buildings and to use materials and colors similar to those on the existing buildings. The buildings.proposed to have Edinger Avenue frontage will incorporate more dramatic design elements, such as vaulted entry foyers and an increased use of accent tiles. A conceptual landscaping plan has been prepared which identifies the basic plant palette and desired character of the center. The landscaping plan, including the parking lot trees, the entry accent trees, the street frontage trees, and the shrubbery all conform to the original-landscape plan and are compatible with the existing landscaping. Environmental Analysis A Tiered Negative Declaration/Initial Study has been prepared for the project and is attached to this report (Attachment C). Based upon review of the proposed project and the previously certified Negative Declaration for Jamboree Plaza, it has been determined that environmental issues relating to this project have previously been addressed. Mitigation measures identified in the original Negative Declaration are included as conditions of approval. Therefore, staff City Council Report ZC 97-002 and TPM 97-164 November 3, 1997 Page 7 recommends that the City Council certify the Tiered Negative Declaration as adequate and find that the requirements of the California Environmental Quality Act have been satisfied. ~Y (J'/EVA~s i s hn~~e r~l/ / Elizabeth A. PM5 3702A ATTAC~IMENT A TIERED INITIAL STUDY RESPONSE JAMBOREE PLAZA - NEGATIVE DECLARATION DR 97-016, TPM 97-164, ZC 97-002 PROJECT DESCRIPTION SUPPLEMENT - on June 3, 1991, ~he Tustin City Council adopted Resolution 91-75 which authorized the creation of the Jamboree Plaza District Regulations for the project site. The project site originally consisted of· approximately 24.4 acres subdivided to support approximately '202,000 square feet of retail, aut'o service, office' and industrial uses. A Negative Declaration was certified for the project. Since the project approval in 1991, approximately 26,000 square feet of building space has been developed, and approximately 3.67 acres of land originally planned for approximately 47,800 square feet of industrial/business park building space.has been sold to create, a commuter rail station. The remaining land had been configured to accommodate approximately 128,000 square feet of. industrial/business park and' retail uses. The proposed project is a Zone Change to amend the existing Jamboree Plaza District Regulations, regarding the configuration and amount, of proposed uses. The proposed project would result in a net decrease in total building area, with the amount of square footage per use changing. Building area' devoted to potential retail uses would increase from approximately 28,000 square feet to approximately 35,000 square feet, while the space devOted to industrial/business park uses would decrease from approximately t00,000 square feet to 85,000 square feet.- A total of 8.2' acres are proposed to be built upon.. As a companion to the Zone Change, a Tentative Parcel Map and Design Review are also included in the proposed project. They will allow for the.subdivision of the project area into twenty numbered parcels for the building sites and three lettered parcels for ingress/egress/parking purposes, as well as providing aesthetic review to the projeqt. This is a tiered initial'study that is based on and incorporates, by reference, the environmental'analysis included in the Negative Declaration adopted for Design Review 90-40, Zone Change 90-01, and Tentative parcel Maps 90-292 and 90-293 (certified on June 3, 1991) and supplements and addenda, as it relates to the subject property. In conformance with CEQA, the purpose of this tiered initial'study is to identify and focus the environmental analysis for the project on any significant new environmental impacts that were not previously considered in the June 3, 1991 Negative Declaration. The Negative Declaration identified'several impact'categories where impacts could be lessened to a level of insignificance .with the imposition of mitigation measures. Staff has reviewed each'of these impact Categories to ensure that no new project impacts associated with the project would occUr that were not identified in the June 3, 1991 Negative Declaration. LAND USE AND PLANNING a,b,c,d,e "No Impact" ~- The proposal would not result in any.substantial alterations to'the planned land uses for the area. 'This site has been .previously designated by' General Plan Amendment 89-02(b) as I (Industrial) and Zone Change 88-03 as PC-IND (Planned Community - industrial). Zone Change 90-01 maintained the PC-. IND designation while allowing for individual land use designations on the sites within the project area. Tentative Parcel Maps 90-292/293 and Design Review 90-40 placed the .project site under the' Jamboree Plaza District. Regulations, 'and a Negative Declaration was certified for those actions. Zone Change 97-002, Tentative Parcel Map 97-164 and Design Review 97-016 would'reconfigure the internal use designations and land divisions to reflect changes in and around, the project site. The types of uses intended for the site under the current proposal are intended to be consistent with the uses currently allowed under the existing Jamboree Plaza District Regulations, and ' those are consistent with surrounding uses. In addition, the district r~gulations will continue to reinforce the specifically prohibited uses within the Browning and GCA Corridor Easements as establiShed .by USMCAS-Tustin and recorded against the property. However, the employment generated by the project may lead to an indirect population increase, ~thereby increasing demands upon housing. It is more.likely that a substantial portion of .the employees generated by the proj'ect will already reside in the City or neighboring communities and not create a large demand for additional housing. The proposed development would not affect housing as.no housing units would be displaced or proposed. Existing neighborhood and new residential areas are presently being developed in the area known as Tustin Ranch which are anticipated to support the project. A number improvements have 'been made to the circulation system within the vicinity of Jamboree Plaza, including some of the original mitigation measures. These include: the opening of Jamboree Road between Edinger Avenue and Barranca Parkway; the creation of the Edinger Avenue/Plaza Entrance a~dEdinger Avenue/Jamboree Road intersections; and widening, raised medians, and acceleratiOn/deceleration lanes on Edinger .Avenue. KHR Associates recently completed an. updaSe to the original · Traffic ~mpact Study for Jamboree Plaza, to reflect the changes in the. development plan for Jamboree Plaza.. The KHR Associates Traffic Study Update is incorporated by reference and attached hereto as Appendix A. Jamboree Road and Edinger Avenue~re within the Orange County Transportation Authority's Cohgestion Management Program (CMP) which means that future projects ~that add more than 2,400 trips total to a CMP roadway, or more. than 1,600 trips directly onto a CMP highway, are required to prepare a detailed CMP Traffic Impac~ Analysis (TIA~. The original Jamboree Plaza development plan was Attachment A '. The proposed District Regulations-closely resemble existing standards for both the Irvine Industrial Complex-Tustin ,properties to the ~north, as well as the existing Phase I development at Jamboree Plaza. .All aesthetic Concerns of the. City have been incorporated into the project plans or included as conditions of approval. The proposed project would add new lighting to the property, primarily as.a result of parking lot, pedestrian arcade and service drive lighting for security and safety purposes. Since that time, a portion of the plaza has been constructed, while much of the plaza has yet to be developed. Subsequently, a new development plan for the remaining portion of the plaza has been 'prepared and the City of Tustin has expressed concern over the possible increase' in traffic impacts. This analysis provides a · update of potential' traffic impacts that may occur with the new Jamboree Plaza development plan. The fOllowing sections of this ar~alYsis describe the project location and newly proposed development plan, findings from the original traffic impact study, an update of existing conditions (since 1991),. and description of anticipated impacts that may result from the new proposal. Jamboree Plaza is i(~cated on the northwest quadrant of Edinger Avenue.and Jamboree Road in the City of Tustin,'California. The triangularly:shaped site is approximately 17.5 acres in size and bounded by Edinger Avenue to the south, the OCTNSCRRA railwaY to the north, and Jamboree Road to the east: Adjacent land uses inclUde the Tustin U.S. Marine Corps Air Station to the south (across'Edinger Avenue), large vacant'parcels of residentially-zoned land .to the east, and light 'industrial u'ses to the north" (across the r~iiroad tracks): .The portion of Jamboree Plaza that has been completed includes the' area between the eastern access road and Jamboree Road. SUMMARY OF FINDINGS FROM PREVIOUS STUDY The following is a summary of the key findings and conclusions prese.nted in the Traffic Impact Study prepared for the 'original Jamboree Plaza development plan: Existing traffic volumes recorded at nine intersections within the vicinity of the site (taken in February, 1991) were used to determine existing intersection levels of service (LOS). The LOS calculations found that all intersections, with the exception of the' intersections of Edinger Avenue/Redhill Avenue, and Edinger Avenue/Harvard Avenue were operating at LOS "C" or better during both A.M. and P.M. peak hours. All studied roadway segments were found to operate within LOS "A". ' Based on the preferred development alternative (which includes retail, business park, restaurant, and car wash land uses), the original project was estimated to generate a total of 7,878 vehicle trip ends per average weekday. During the A.M. and P.M. peak. hours, 608 and 637 vehicle trip ends, respectively, were projected to be generated by the. original development (see. Table I). '. Empirical analysis indicates that the peak on-site parking demand will require, at most, 489 spaceS -leaving 198 spaces (or 28.8%) as a reserve parking SuPply..¥herefore, adverse parking impacts were not anticipated. UPDATE OF EXISTING CONDITIONS Since the original study was completed in 1991, there have been numerous improvements made to roadways and intersections within the vicinity of Jamboree Plaza. The most significant improvement Was the opening of Jamboree Road,' between Edinger Avenue and Barranca Parkway. Other improvements include: the 'creation of the Edinger Avenue/Plaza Entrance and Edinger Avenue/Jamboree Road intersections; and widening, raised medians, and acceleration and deceleration lanes on Edinger Avenue as part of the Jamboree Plaza development. · , Updated daily traffic volume counts (taken in October 19~6) for segments of Edinger Avenue and Jamboree Plaza near the project site, reflect some changes over the five-year period. Volumes on Edinger AvenUe, between Jamboree Road and Harvard Avenue, increased from .16,200 to 19,352 vehicles per day (approximately 12 percent increase). Edinger Avenue, between Jamboree Road and Red Hill Avenue decreased from 16,700 to 15,975 vehicles per day (app.roximately 4 percent decrease).' Traffic volume " counts sheets for these locations are attached to this report. Applying these more recent volumes toward the roadway capacity for these segments (i.e., .four lane divided highw, ay at 35,500 vehicles per day) results in LOS "A" for both segments. . · JambOree ROad, between Edi~ger Avenue and Walnut Avenue increased from 13,300 to 44,113 vehicles'per day (more than 300 percent increase). The significant increase in traffic volumes on. jamboree Road is primarily due to the opening of jamboree Road between Edinger Avenue and Barranca Parkway~ Jamboree ROad, between Edinger Avenue and Warner A~enue recorded 38,344 vehicles per day. For comparison Mr. Gregory Butcher October 6, 1997 Page # 4 purposes between the originaI plan and the new development plan, trip generation estimates under the original scenario were updated with the completed facilities subtracted out of the trip estimate totals. Estimates of business park square footage, as well as a restaurant, a car wash, and one service station were discounted in the updated estimate. The updated trip generation estimate can then be compared to the new proposal. Table II lists the updated trip generation estimate under the original development plan. NEW DEVELOPMENT PLAN -TRIP GENERATION The new development plan includes much of the same land uses as the original plan (i.e., retail and office use), however, there are some differences in building square, footage, plus the inclusion of a · future train station. Additionally, the new development plan includes an option of using 59,270 square feet for either business park use, or retail use. Retail use typically generates more traffic than business Park'use and was therefore used t0 r~present "worst case" conditions. Table II! lists the new land us.es, square footage, and estimated trip generation from each PrOPosed land use. · . Applying the new estimate of trips generated during the P.M. peak hour to the turn. movement assumptions presented in the 1991 study resulted in an acceptable estimate of LOS "B" for this intersection during the P.M. peak hour. The ICU calculation sheet is attached to this report. P.M. peak hour trips generated by the proposed development were then distributed through the various movements of the Jamboree Road/Edinger Avenue intersection, based upon regional roadway network conditions and existing turn count data. The existing plus project traffic volumes were then used to calculate the projected LOS of this intersection during the P.M. peak hour with project buildout. The ICU calculation sheet (attached to this report) indicates that even with the slight increase in traffic volumes, the intersection is projected to continue to Operate at LOS "D" with existing plus Project conditions. The lCU calculation sheet is attached to this report. Long-range projections of traffic Volumes traveling through the Jamboree Road/Edinger Avenue intersection were used to estimate the future "long-range" plus project operating conditions of this intersection dudng the P.M. peak hour. Long-range operating conditions and traffic volumes are affected by the future grade separation improvements of this intersection. Trips generated by the proposed development were added to the long-range volumes, supplied by the City, to estimate the LOS under this condition. The ICU'calculation sheet (attached to this report) indicates a projected ICU value of .872 under long-range plus project' conditions, which is slightly higher than the City's IongLrange projection of .84, This slight increase does not represent a significant impact and the intersection is projected to continue to operate at LOS "D" with long-range plus project conditions. The lCU calculation sheet is attached to this report. " · · . CONGESTION MANAGEMENT PROGRAM Jamboree Road and Edinger Avenue are within the Orange County Transportation Authority's Congestion Management Program (CMP) which means that future projects that contribute a significant amount of traffic onto-these roadways require a detailed CMP Traffic Impact Analysis (TIA). Projects exempt from the TIA requirement.will not add more than 2,400 trips total to a CMP roadway, or' more than 1,600 trips directly onto a CMP highway.. CMP policy also states that a TIA is not required for prOjects approved prior to. the effective date of CMP TIA requirements (i.e., January 1992).-Furthermore,. intersections' of 'roadways within the CMP (i.e., Jamboree RoadlEdinger Avenue) are 'permitted to operate a LOS "E", or better without requi'r!ng a traffic study. The origi'nal jamboree Plaza development plan was prepared and' approved .in 1991, and therefore only .the net increase in veliicle trips generated by' the new development plan are evaluated for TIA requirements. As'show in Table's !1 and Iil, 3,801 daily trips W~re estimated for the o¢iginai plan, and 5,052.daily trips were estimated with the new deVelOpment plan - a net increase of 1,251 daily trips. .The 1,251 additional trips iS less.than the.TIA requirement threshold of 1,600 .trips per day, and therefore th~ new Jamboree Plaza development plan does not'require a CMP TIA. · · ~ . : .-, . · ;. ; ~. -. . Although additional trips will be generated by the new development plan, the current roadway network surrounding the property should adequately carry the estimated increase in traffic. Exhibit A TPM 97-164 Resolution No. 3556 Page 3 (5) 2.6 In addition to the normal- full size plan submittal process, all final development plans including, but not limited to: tract maps, parcel maps, right-of-way maps, records of survey, public works improvements, private infrastructure improvements, final grading plans, and site plans are also required ~o be submitted to the Public Works Department/Engineering Division in computer aided design and drafting (CADD).format. The acceptable formats shall be Integraph DGN or AutoCad DWG file format, but in no case less than DXF file format. The City of Tustin CADD conventions shall be followed in preparing plans in CADD, and -these guidelines are available from the Engineering Division. The CADD files shall be submitted to the City at the time the plans are approved, and updated CADD files reflecting "as built" conditions shall be submitted once all construction has been completed. The "as built'" CADD files will be required prior to release of the subdivision bonds. (5) 2.7 The Subdivider shall submit two (2) copies of the Notice of Intent for the NPDES construction permit, as submitted to the State of California Water Resources COntrol Board (one copy to Community Development Department/Building Division and one to the Public Works Department/ Engineering Division). (5) 2.8 The proposed storm drain connection to the Santa Ana- Santa Fe F-10 Flood Control Channel will require a permit from the Orange County Flood Control District. DEDICATIONS/RESERVATIONS/EASeMENTS (1) 3.1 The subdivider shall satisfy dedication and/or (2) reServation requirements as applicable, including but not (5) limited to dedication, of all required street and flood control right-of-way easements, vehicular access rights, sewer easements and water easements defined and approved as to specific location by the City Engineer and 'other agencies. (1) 3.2 Landscape maintenance shall be the responsibility of the (5)~ Jamboree Plaza Property Owners' Association. The City of Tustin will not be responsible for maintenance of private streets, storm drains, street lights, landscaping, irrigation, slopes or perimeter walls. Prior to recordation of the final map, subdivider shall (2) post with the Community Development Department a minimum (5) $2,500 cash deposit or letter of credit to guarantee the sweeping of streets and clean-up of streets affected by construction activities. In the event this 'deposit is depleted prior to completion of development or City appearance of'public streets, an additional incremental deposit will be required. Final s~reet elevations at key locations. Both horizontal and vertical, intersection sight lines shall be shown on the landscape plan in compliance with OCEMA Standard No. 1117 for the interior streets. All landscaping within the limited use areas shall comply with OCEMA Standard No. 1117. Final pad/finished floor elevations and key elevation for all site grading. Ail pad elevations to be a minimum of 1..0 foot above base flood elevation as defined by' FEMA. A note shall be placed on the grading plan requiring Community Development Department approval of rough grading prior to final clearance for foundations. A note shall be placed on the plans 'that a qualified paleontologist~archaeologist, as appropriate shall be present during rough grading operations. .If resources are found, they shall~be excavated or preserved as deemed appropriate or as recommended by the paleontologist/ archaeologist subject to review and approval by the Departments of Public Works and Community Development. Ail "finds" shall be reported immediately to the Department of Community Development. The paleontologist/ archaeologist shall attend the pregrade construction meeting to ensure that this condition and necessary procedures in the event of a "find" are explained. Co The applicant shall prepare a sedimentation and erosion control plan for all construCtion work related to the subject tract including a method of control to prevent dust and windblown earth problems. Said plan shall be reviewed and approved by the Community Development Department. D. Submittal of a construction traffic routing plan for review and approval by the Director of Public Works. E , The applicant shall prepare a hydrology and hydraulic calculations for this subject property. Said plan shall be reviewed and approved by the Public Works Department and Community Development Department/Building Division. (1) 5.2 Ail earthwork shall be performed'in accordance with the (3) Tustin City Code and Tustin Grading Manual. (1) 5.3 Prior to the recordation of a final map, the applicant (5) shall submit for approval by the-Community Development and Public Works. Departments, a Water Quality Management Plan (WQMP) that identifies the application and incorporation of those routine structural and non- structural Best Management Practices (BMPs) and detailing implementation of the BMPs not dependent on specific land uses. Or (5) paving permits, the applicant shall obtain coverage under the NPDES Statewide Industrial Storm water Permit for General Construction Activities from the State Water Resources Control Board. Evidence that this has been obtained shall be submitted to the Building~Official. (1) 5.5 Applicant shall submit a 'construction Phasing Schedule. Construction phasing shall occur in a logical and sequential, pattern and as identified on 'the approved phasing schedule. The Community Development Director may make minor modifications to the phasing schedule provided 'that such modifications result in orderly and sequential development, minimizing construction impacts to the greatest extent possible on the occupied portion of the development. FIRE AUTHORITY (5) 6.1 Prior to the recordation of a subdivision map, a note shall be placed on the map stating that all structures to be built on lots shall be protected by an automatic fire sprinkler system, in a manner meeting the approval of the Fire Chief. (5) 6.2 Prior to the approval of any use/site permits for site planning, issuance of any grading permits, or building permits, whichever occurs first, the applicant shall submit to the Fire Chief a list.of the quantities of all hazardous, flammable and combustible materials, liquids or gases. These liquids and materials are. to be classified according to the "Orange County Fire Authority Chemical classification Handout". The submittal shall provide a summary sheet listing each hazard class, the total quantity of chemicals stored per class and the total quantity of chemicals used in that class. All forms of materials are to be converted to 'units of measure in pounds, gallons and cubic'feet. (5) 6.3 Prior to approval of a site development/use permit, or the issuance' of a building permit, whichever occurs first, the applicant shall submit plans for the review and approval of the Fire Chief. The applicant shall include information on the plans required by the Fire Chief. Contact the Orange County Fire Authority Plans Review Section for the Fire Safety Site/Architectural Notes to be placed'on the plans. Exhibit A TPM 97-164 Resolution No. 3556 Page 8 (5) 6.4 Prior to'recordation of a subdivision map, the subdivider shall submit water improvement plans to the Fire Chief for review and approval to ensure adequate fire protection and financial security is ~posted for the installation. The water system design, location of valves, and thedistribution of the fire hydrants will be evaluated and approved by the Fire Chief. (5) 6.5 Prior to the recordation of any subdivision map or the issuance of any building permits, whichever occurs first, the applicant shall submit to the Fire Chief evidence of the on-site fire hydrant system and indicate whether it is public or private. If the system is.private, the system shall be reviewed and approved by the Fire Chief prior to the isSuance of building permits. Provisions shall be made by the applicant for the repair and maintenance of the system, in a manner meeting the approval of the Fire Chief. (5) 6.6 Prior to the issuance of any grading permits, the applicant shall Submit and obtain approval of preliminary plans for all streets and courts, public or private, from the Fire Chief in consultation with the Manager, Traffic Engineering. The' plans shall include the plan view, sectional view, and indicate the width of the street or court measured flow line to flow line. All proposed fire apparatus turnarounds shall be clearly marked when a dead-end street exceeds 150 feet or when other conditions require it. (5) 6.7 Prior to the issuance of any grading permits, the applicant.shall submit and obtain approval from the Fire Chief for street improvement plans.with fire lanes shown. The plans shall indicate the locations of red curbing and signage. A drawing of the proposed signage with the height, stroke and color of lettering and the contrasting background color shall be submitted to and approved by the Fire Chief. (5) 6.8 Prior to issuance of the certificate of use and occupancy the approved fire lane making plan shall be installed. The CC&R's shall contain a fire lane map and provisions which prohibit parking in the fire lanes. A method of enforcement shall be included. Exhibit A TPM 97-164 Resolution No. 3556 Page 9 (5) 6.9 Prior to the issuance of any building permits for combustible construction,~ the developer shall submit and obtain the Fire Chief's approval of a letter and plan stating that water for fire fighting purposes and an all weather fire access road shall be in place and operational as required by the Uniform Fire Code before any combustible materials are placed on the site. (5) 6.~10 Prior to the issuance of any building permits, an ©range County Fire Authority Water Availability Form shall be submitted to and approved by the Plan Review Section of the Orange County Fire Authority.~ If sufficient water to meet fire flow requirements is not available, an automatic fire extinguishing system shall be installed in · each structure, in a manner meeting the approval of the Fire Chief. (5) 6.11 Prior to the issuance of building permits plans for the automatic fire sprinkler system shall be submitted to and approved by the Fire Chief prior to installation. This system shall be operational prior to the.issuance of a certificate of use and occupancy. (5) 6.12 Prior to the issuance of any building permits, the applicant shall submit a detailed letter of intended use for each building to the Fire Chief for review and approval.' (5) 6.13 Prior to the issuance of any building permits, the applicant shall contact the Orange County Fire Authority Hazardous Materials Disclosure Office to obtain a "Hazardous Materials Business Information and Chemical Inventory Packet". This shall be completed and submitted to the Fire Chief before~ the. issuance of any building permits. (5) 6.14 Prior to the issuance of any certificates of use and occupancy, all fire hydrants shall have a "Blue Reflective Pavement Marker" indicating its location on the street or drive per the Orange County Fire Authority Standard and approved by the Fire Chief. On private property these markers are to be maintained in good condition by the property owner. Payment shall be required based upon those rates in effect at the time of payment and are ·subject to change. a . Building plan check and permit-fees to the Community Development Department based on the most current-schedule. b · Orange County Fire Authority plan check and inspection fees to the Community .Development Department based upon the most current schedule. lc. New development fees in the amount of $.10 per .square foot of ' floor area to the Community Development Department. d. (5) 7.2 Within forty-eight (48) hours of approval of the subject project, the applicant shall deliver to the Community Development Department, a cashier's check payable to the COUNTY CLERK in the amount of $38.00 (thirty-eight dollars) to enable the City to file the appropriate environmental documentation for the project. If within such forty-eight (48) hour period that applicant has not delivered to the Community Development Department the above-noted check, the statute of limitations for any Exhibit A TPM 97-164 Resolution No. 3556 Page 11 interested party to challenge the environmental determination under the provisions of the California Environmental Quality Act could be significantly lengthened. 'In addition, should the Department of Fish and .Game reject the Certificate of Fee Exemption filed with the Notice of Determination and require paYment of fees, the applicaht shall deliver to the Community Development Department, within forty-eight (48).. hours of notification, a cashier's check payable to the COUNTY CLERK in the amount of $1,250 (one thousand two hundred fifty, dollars) pursuant to Fish and Game Code Section 711.4. If this fee is imposed,'the subject project shall not be operative, vested or final unless and until the fee is paid.
