(ALL MATTERS LISTED UNDER CONSENT CALENDAR ARE CONSIDERED ROUTINE AND WILL BE ENACTED BY ONE MOTION. THERE WILL BE NO SEPARATE DISCUSSION OF THESE ITEMS PRIOR TO THE TIME OF THE VOTING ON THE MOTION UNLESS MEMBERS OF THE COMMISSION, STAFF OR PUBLIC REQUEST SPECIFIC ITEMS TO BE DISCUSSED AND/OR REMOVED FROM THE CONSENT CALENDAR FOR SEPARATE ACTION.) 1. Minutes of the September 22, 1997 Planninq Commission Meetinq. Commissioner Davert moved, Pontious seconded, approval of the Consent Calendar. Motion carried 5-0. PUBLIC HEARINGS: 2. Code Amendment 97-001, Amendment to Tustin City Code Section 9224b, Planned Development District. APPLICANT: LOCATION: CITY OF TUSTIN PLANNED DEVELOPMENT (PD) ZONING DISTRICTS, CITYWIDE Planning Commission Action Agenda October 13, 1997 Page 2 ENVIRONMENTAL STATUS: IN ACCORDANCE WITH THE CALIFORNIA ENVIRONMENTAL QUALITY ACT, AN' ENVIRONMENTAL CHECKLIST AND NEGATIVE DECLARATION CITING NO SIGNIFICANT IMPACTS HAS BEEN PREPARED. REQUEST: AMENDMENT TO TUSTIN CITY CODE SECTION 9224b TO IDENTIFY HOME OCCUPATIONS AS OUTRIGHT PERMITTED USES WITHIN THE PLANNED DEVELOPMENT ZONING DISTRICT 'CONSISTENT WITH OTHER RESIDENTIAL ZONING DISTRICTS. Recommendation- That the Planning Commission: , Adopt Resolution No. 3547 approving the environmental determination for the project; and . Adopt Resolution No. 3548 recommending that the City Council approve CA 97-001. Rita Westfield, Assistant Director presented the subject report. Commissioner Davert moved, Commissioner Pontious seconde~, to adopt Resolution No. 3547 approving the envirorunental determination for the project. Motion carried 5-0. Commissioner Davert moved, Commissioner Pontious seconded, to adopt Resolution No. 3548 recommending that the City Council approve CA 97-001. Motion carried 5-0. REGULAR BUSINESS: No regular business STAFF CONCERNS: · Report on Actions taken at the October 6, 1997 City Council Meetinq. The Assistant Director asked if there were any questions on the subject agenda. Commissioner Kozak moved, Commissioner Pontious secondea, to receive and file the subject report. Motion carried 5-0. COMMISSION CONCERNS: Commissioner Browne Noted that there was graffiti on a building south of MicroCenter. ' Staff noted that code enforcement would check on that site. Planning Commission Action Agenda October 13, 1997 Page 3 Commissioner Kozak Inquired about the restaurant moving into the former Chuy's site. Staff indicated that the western themed restaurant is currently in design review and'would not open for a couple months. Commissioner Pontious - Noted that the shrubs on the IRWD property on Nisson between Red Hill and Newport are dying and she would like to see new plantings. Staff stated that they would notify the IRWD. Chairman Mitzman Inquired about policy regarding residential properties in disrepair, noting specifically properties on Red Hill between Mitchell and Nisson. Staff stated that the City's code enforcement is proactive on property maintenance issues and staff would look at the properties on Red Hill. ADJOURNMENT: Commissioner Davert moved, Commissioner Pontious seconded, to adjourn the meeting at 7:10 p.m. Motion carried'5-0. An MCAS, Tustin Specific Plan, Chapter 3 Workshop is scheduled for 6:00 p.m. followed by the next regularly scheduled meeting of the Planning Commission on October 27, 1997 beginning at 7:00 p.m., City Council Chambers, 300 Centennial Way,.
