BACKGROUND: The following Ordinance No. 1187 had first reading and introduction at the October 6, 1997 City Council meeting: ORDINANCE NO. 1187 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, REPEALING ORDINANCE NO. 1139 AND REQUIRING THAT THE CITY'S GENERAL MUNICIPAL ELECTION, BEGINNING IN 1998, SHALL BE CONSOLIDATED WITH THE STATEWlDE GENERAL ELECTION WHICH WILL BE HELD ON THE FIRST TUESDAY AFTER THE FIRST MONDAY IN NOVEMBER OF EVEN NUMBERED YEARS Valerie Crabill Chief Deputy City Clerk 1 :ORDMEMO 1 3 4 5 6 7 8 9 10 11 12 13 14' 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 ORDINANCE NO. 1187 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, REPEALING ORDINANCE NO. 1139 AND REQUIRING THAT THE CITY'S GENERAL MUNICIPAL ELECTION, BEGINNING IN 1998, SHALL BE CONSOLIDATED WITH THE STATEWIDE GENERAL ELECTION WHICH WILL BE HELD ON THE FIRST TUESDAY AFTER THE FIRST MONDAY IN NOVEMBER OF EVEN NUMBERED YEARS The City Council of the City of Tustin does hereby ordain as follows: Section 1: The purpose and intent of this ordinance is to permit the consolidation of the City's general municipal elections with the statewide general electionS that will be held on the first Tuesday after the' first Monday in November of even numbered years beginning in 1998. Section 2: Ordinance No. 1139 is hereby repealed. Section 3: Those elected city officeholders whose terms of office would have, prior to adoption of this ordinance, expired on the Tuesday succeeding the second Tuesday in April of even numbered years, shall instead have their terms of office expire on a date to be determined in November following certification of election results by the Orange County Registrar of Voters. Section 4: As a result of adoption of this ordinance, no term of office shall be increased or decreased by more than twelve (12) months. Section 5: This ordinance shall be operative upon the approval of the Orange County Board of Supervisors. Accordingly, the City Clerk is directed to transmit a certified copy of this ordinance to the Orange County Board of Supervisors and request approval of the ordinance by the Board of Supervisors. Section 6: Within thirty (30) days of the operative date of this ordinance, the City Clerk shall cause a notice to be mailed to all registered voters informing the voters of the change in election date and that as a result of the change in election dates, elected city officeholders terms of office will be extended. 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 27 28 Ordinance No. 1,87 Page 2 Section 7 (Severability): If any sentence, clause, phrase, or portion of this ordinance, is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Tustin hereby declares that they have adopted this ordinance, and each section, sentence, clause, phrase or portion thereof, irrespective of the fact that any one or more sections, sentences, clauses, phrases or portions thereof be declared invalid or u nco n stit utio nal.
