MOUNTAIN VIEW DRIVE RECONSTRUCTION FROM FIRST STREET TO IRVINE BOULEVARD (PROJECT NOS. 700145 & 700146) SU/VIMARY: Correct the contract .award amount stated in the Recommendati°n Section °fthe Septemberl 15,1997 Council Rel~ort from $437,845.27 to $447,333.87. RECOMMENDATION It is recommended that the Tustin City Council, at their meeting of October 6, 1997, authorize award of the construction contract to GMC Enterprises in the corrected amount of $447,333.87. FISCAL IMPACT No change. The corrected contract award of $447,333.87 is within the amount budgeted. BACKGROUND On September 15, 1997 the City Council authorized award of the contract for the reconstruction of "A" Street and Mountain View Drive to GMC Enterprises. The contract amount stated in the Background Section of the Council Report (copy attached) was correct at $447,333.87; however, the amount in the Recommendation Section was incorrectly stated as $437,845.27. Council is hereby requested to acknowledge this clerical error and authorize award to GMC Enterprises in the corrected amount of $447,333.87. It is recommended that the City Council, at their meeting Of September 15, 1997 consent to relieve the low bidder, Damon Construction Company, of their bid (due to a clerical error) and release Damon's Bid Bond accordingly. The second 10w bidder, SiMa ConstructiOn, has been disqualified due to their failure to return the signed addendum. It is ~erefore recommended to award the subject contract to GMC Enterprises, in the amount of $437,845.27. . FISCAL IMPACT · , The City's Capital Improvement Program'Budget for 1997-98 FY provides $336,000 for the reconstrumion of"A" Street and $258,000 for Mountain View Drive from the Capital Improvement Program (CIP) funds. GMC Enterprises' bid is approximately 3.8% above the engineer's estimate but is still within the apPropriated project budget ' · BACKGROUND Bids for th/s subject project were opened on August 25, 1997. Griffith Company, Santa Ana $389,944.50 $436,761.80 $447,333.87 $456,567.00 $466,912.50 $489,404.00 $495,104.00 $509,326.20 This project will provide for the complete reconstruction of street pavement, curb, gutter, sidewalk and park~ay landscaping along w/th construction of storm drain-improvements for both "A" Street and MountainView Dr/ye between First Street and Irvine Boulevarc[ Award of Contract tbr "A' Street and Mountain View Drive Reconstruction September 15, 1997 Page 2 , On August 27, 1997, two days after bid opening, Damon Construction Company (Damon) requested relief of their bid proposal due to a clerical error in their unit price for disposal fees which mater/ally affected their bid by approximately $85,000. The Public Works Department and the City Attorney have reviexved and evaluated the support information that was submitted by Damon regarding the subject bid item and find that Damon Construction has satisfied the requirements for bid relief. It is hereby recommended to relieve Damon of their bid and release their bid -bond. The second low bidder, Silvia conStruction, was disqualified because they did not acknoxvledge Addendum No. 1 to the contract as required by the bid process~ Therefore, staff requests that City Council authorize award of the contract to GMC Enterprises, the third lowest bidder and the second lowest responSive bidder. In the event that GMC fails to execute the contract documents in the time prescribed, or does not provide the required bonds and insurance, it is recommended that the Council determine .that the bidder has abandoned the contract and that the posted bid security shall be thereby forfeited to the City. : ~__ Tim D.
