ORDINANCE NO. 1187, CHANGING DATE OF GENERAL MUNICIPAL
ELECTION
RECOMMENDATION:
Have first reading by title only and introduction of Ordinance No. 1187 requiring the
City's General Municipal Election to be consolidated with the statewide general
election held on the first Tuesday following the first Monday in November of even
numbered years.
FISCAL IMPACT:
The City's cost for conducting the November 3, 1998 General Municipal Election
will be approximately $18,264 (.70 per registered voter). This amount will be
budgeted during the 1998-99 fiscal year.
BACKGROUND:
At the September 15, 1997 meeting, the City Council approved a change in the
City's next General Municipal Election date. from April 1998 to November 1998.
Pursuant to Elections Code Section 1301, adoption of an ordinance is required by
the City Council to hold its general municipal election on the same day as the
statewide general election in November. The ordinance then becomes operative
upon approval by the Orange County Board of Supervisors.
Upon final adoption of Ordinance No. 1187, staff will submit the ordinance to the
Board of Supervisors for approval and subsequently send written notification to all
Tustin registered voters that the City's General ' Municipal Election date has been
changed.

ORDINANCE NO. 1187
AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, REPEALING ORDINANCE
NO. 1139 AND REQUIRING THAT THE CITY'S GENERAL
MUNICIPAL ELECTION, BEGINNING IN 1998,' SHALL BE
CONSOLIDATED WITH THE STATEWIDE GENERAL
ELECTION WHICH WILL BE HELD ON THE FIRST
TUESDAY AFTER THE FIRST MONDAY IN NOVEMBER
OF EVEN NUMBERED YEARS
The City Council of the City of Tustin does hereby ordain as follows:
Section 1:
The purpose and intent of this ordinance is to permit the consolidation of the
City's general municipal elections with the statewide general elections that will
be held on the first Tuesday after the first Monday in November of even
numbered years beginning in 1998.
Section 2:
Ordinance No. 1139 is hereby repealed.
Section 3:
Those elected city officeholders whose terms of office would have, prior to
adoption of this ordinance, expired on the Tuesday succeeding the second
Tuesday in April of even numbered years, shall instead have their terms of
office expire on a date to be determined in November following certification of
election results by the Orange County Registrar of Voters.
Section 4:
As a result of adoption of this ordinance, no term of office shall be increased
or decreased by more than twelve (12) months.
Section 5:
This ordinance shall be operative upon the approval of the Orange County
Board of Supervisors. Accordingly, the City Clerk is directed to transmit a
certified copy of this ordinance to the Orange County Board of Supervisors and
request approval of the ordinance by the Board of Supervisors.
Section 6:
Within thirty (30) days of the operative date of this ordinance, the City Clerk
shall cause a notice to be mailed to all registered voters informing the voters
of the change in election date and that as a result of the change in election
dates, elected city officeholders terms of office will be extended.

Section 7 (Severabilit¥):
If any sentence, clause, phrase, or portion of this ordinance, is for any reason
held to be invalid or unconstitutional by the decision of any court of competent
jurisdiction, such decision shall not affect the validity of the remaining portions
of this ordinance. The City Council of the City of Tustin hereby declares that
they have adopted this ordinance, and each section, sentence, clause, phrase
or portion thereof, irrespective of the fact that any one or more sections,
sentences, clauses, phrases or portions thereof be declared invalid or
unconstitutional.
PASSED AND ADOPTED at a regular meeting of the Tustin City Council held
on the 20th day of October, 1997.

Pamela Stoker, City Clerk and ex-officio Clerk of the City Council of the City of
Tustin, California, does hereby certify that the whole number of the members
of the City Council is five; that the above and foregoing Ordinance No. 1187
was introduced at a regular meeting of the City Council held on October 6,
1997, and was passed and adopted at a regular meeting of the City Council
held on October 20, 1997, by the following vote:
