' ' ~1 NO. 5 9-15-97 DATE: SEPTEMBER 15, 1997 Inter-Com TO: FROM: SUBJECT: WILLIAM P~ HUSTON, CITY MANAGER PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION STATE OF CALIFORNIA FISCAL 'YEAR 1998-99 TRANSIT CAPITAL IMPROVEMENT PROGRAM FUNDING APPLICATION SUBMITTAL AUTHORrZATION RECOMMENDATION: It is recommended that the City Council, at their meeting of September 15, 1997, adopt Resolution No. 97-93 authorizing the City Engineer to submit applications to the California Transportation Commission for FY 1998-99 Transit Capital Improvement (TCI) Program funds. FISCAL IMPACT: State approval of these applications will provide for an additional $1,543,000.00 in funds for construction of the Tustin Commuter Rail Station. BACKGROUND AND DISCUSSION: The California Department of Transportation is currently soliciting formal project applications for the Fiscal Year 1998-99 TCI Program. Funding for this program is made pursuant to Article XIX of the State Constitution, Section 199 and 199.2 of the Streets and Highways Code, and Sections 99317 and 99317.1 of the Public Utilities Code. The City is currently preparing two FY 1998-99 TCI Applications for partial funding of the Tustin Commuter Rail Station. One of the applications is in the amount of $1,390,000.00, which is intended to offset significant cutbacks in the TCI Program for FY 1997-98. The City received approval of the FY 1997-98 TCI Program application subject to approval of the State Budget, which contains a reduction in the TCI Program funds available for FY 1997-98. The other application is in the amoum of $153,000.00, which will offset the City's General Fund participation for construction of the station. The City's previous TCI Program funds in the amount of $1,007,500.00 for FY 1996-97 have been allocated to the City, and FY 1994-95 funds in the amount of $230,000.00 have been expended by the City as part of the right-of-way acquisition. Applications are due to Caltrans and. the Orange County Transportation Authority in early October 1997. Tim D. Seflet Director of Public Works/City Engineer TI)S:DA:eeg:TCI ~ 98 Douglas ~ Anderson ' Transportation Engineer 1 2 3 4 5 6 7 8 9 10 11 12 13 '14 15 16 17 18 19 2O 21 2,3 24 25 26 27 28 RESOLUTION NO. 97-93 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUST1N, CALIFORNIA, APPROVING THE APPLICATION FOR FISCAL YEAR 1998-99 TRANSIT CAPITAL IMPROVEMENT FUNDS WHEREAS, Article XIX of the constitution of the State of California, Sections 199 and 199.2 of the Streets and Highways Code and Sections 99317 and 99317.1 of the Public Utilities Code provide for the funding of the Transit Capital Improvement Program; and WHEREAS, the California Department of Transportation (Caltrans) has established the procedures and criteria for reviewing funding applications and is required to submit to the California Transportation Commission a list of recommended projects from which the funding recipients will be selected; and WHEREAS, said procedures and criteria established by Caltrans require the applicant to authorize the filing of the application for funding; and WHEREAS, the City of Tustin, as the applicant, will enter into an agreement with the State of California to carry out the Transit Capital Improvement project; NOW, THEREFORE, BE IT RESOLVED that the City Council: Approves the filing of an application for the Transit Capital Improvement Program for funding assistance. . Certifies that said applicant will make adequate pro.visions for operation and maintenance of the project. . Appoints the City Engineer, as agent of the City of Tustin to conduct all negotiations, execute and submit all documents, including, but not limited to applications, agreements, amendments and payment requests, which may be necessary for the completion of the aforementioned project.
