THE PROPOSED PROJECT WAS EVALUATED WITHIN THE PROGRAM EIR AND NO ADDITIONAL ENVIRONMENTAL ANALYSIS OR ACTION IS REQUIRED PRIOR TO CITY ACTION. RECOMMENDATION Staff recommends approval of Resolution No. 3856 amending the boundaries of the MCAS Tustin Redevelopment Project and approving an Amendment to the Preliminary Plan. Planning Commission Report MCAS Tustin Amended Preliminary Plan December 9, 2002 Page 2 BACKGROUND The Preliminary Plan for the MCAS Tustin Redevelopment Project ("Project") was considered and adopted by the Tustin Planning Commission by Resolution No. 3544 on September 8, 1997 (Attachment A and B). Resolution No. 3544 also established the boundaries for the proposed Redevelopment Project. The Tustin Community Redevelopment Agency received the Preliminary Plan on September 15, 1997 by adoption of Resolution No. RDA 97-4 (Attachment C). The Tustin Community Redevelopment Agency (the "Agency") proposes to amend the boundaries of the proposed Project Area to delete territory on the former MCAS Tustin that is within the boundaries of the City of Irvine and also to delete approximately 48 acres of the total 52+~- acres of non-base territory included within the Project Area as authorized under state law (the "Excluded Area"). The boundaries changes are illustrated in Exhibit A attached to the proposed Resolution. The Amendment to the Preliminary Plan is included as Exhibit B to the proposed Resolution. If the Resolution is adopted, the Amendment to the Preliminary Plan will be transmitted to the Redevelopment Agency for distribution to taxing agencies and for use in preparation of the Redevelopment Plan for the Project Area. The Resolution also allows minor, technical changes to the boundaries of the Project Area to be made for clarification purposes as long as such changes do not add or subtract territory or materially affect the boundaries selected. The Planning Commission does hereby resolve as follows: 1. The Planning Commission finds and determines as follows: Ao That by Resolution No. 3544, adopted on September 8, 1997, the Planning Commission of the City of Tustin (the "Planning Commission") selected and designated the existing boundaries of the MCAS-Tustin Redevelopment Project (the "Project") and approved a Preliminary Plan (the "Preliminary Plan") for the Project. B. The Agency has proposed to amend the boundaries of the Project Area to exclude territory (the "Excluded Area") as delineated in the "Map of the Excluded Area," attached hereto as Exhibit A and incorporated herein by reference. Co The Planning Commission finds that it is in the public interest to amend the Preliminary Plan in order to amend the boundaries of the Project Area to exclude the Excluded Area. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF TUSTIN DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Planning Commission hereby amends the boundaries of the Project to exclude the Excluded Area. In the event it is necessary for clarification purposes to make' minor, technical changes to the boundaries described in Exhibit A, which changes do not add or subtract area, the Planning Commission hereby finds and determines that any such minor, technical change for clarification purposes does not materially affect the boundaries selected and designated hereby for the preparation of the official Redevelopment Plan for the Project. Section 2. The Planning Commission hereby approves the Amendment to the Preliminary Plan (the "Amendment to the Preliminary Plan") for the Project in the form attached hereto as Exhibit B and incorporated herein by reference. The Chairman of the Planning Commission is hereby authorized and directed to submit the Amendment to the Preliminary Plan to the Tustin Community Redevelopment Agency. The first paragraph of the Introduction section is hereby amended to read as follows: This is the Preliminary Plan (the "Preliminary Plan") for the MCAS Tustin Redevelopment Project (the "Project"). The area within the Project (the "Project Area") includes all property within the Tustin Marine Corps Air Station which is located in the City of Tustin (the "MCAS Property") and certain property outside the Tustin Marine Corps Air Station which is located in the City of Tustin (the "Tustin Property"). 2. Section III shall be amended to read as follows: As a basis for the redevelopment of the Project Area, it is proposed that, in general, the land uses in the Project Area shall be residential, commercial, industrial and public uses as shall be permitted by the MCAS-Tustin Specific Plan/Reuse Plan (all of the property is regulated now by the Specific Plan) and as permitted by the General Plan of the City of Tustin (the "Applicable Plans"). 3. Substitute in place of the Map of the Project Area, Exhibit A to the Preliminary Plan, the Revised Map of the Project Area, attached hereto as Attachment No. 1. 4. All references in the Preliminary Plan to the Project Area shall mean and refer to the area shown on the Revised map of the Project Area. 5. The area within the Proiect (the "Project Area") includes all property within the Iustin Marine Corps Air Station which is located in both the territory of the City of Tustin and t_he City of Irvine (the "MCAS Property") and property outside the Tustin Marine Corps Air Station which is located in the City of Tust/n (the "Tustin Property"). This Preliminary l~lan has been prepared pursuant to the provisions of the Community Redevelopment Law (Health and Safety Code section 33000, et seq.)(the "CRL").. This Preliminary Plan conforms with the general provisions for the preparation of a Preliminary Plan contained irt sections 33322 tO 33325 of the CRL, except as modified by special legislation pertaining' to the realignment and closure of the Tustin Marine Corps Air Station contained in section 33492.100, et seq. CMC-AS-Tustin Legislation").. The MCAS-Tustin Legislation allows for the adoption .of this Preliminary Plan and a final redevelopment plan without cordorm/ty with or findings 'of consistency with the appticable . general pl~s for the a_rea. The MCAS-Tustin Legislation does require that prior to .implementation of any redevelopment activities within the Projec'b the applicable general plans for the Project be in' place .and that findings of consistency be made. GENERAL STATEMENT OF PROPOSED LAYOUT OF PRINCIPAL STREETS As a basis £or the redevelopment of the Project Area, it is proposed that, in general, the layout of principal streets be as shown and described in the Applicable Plans. GENER.AL STATEMENT_ OF PROPOSED BU'fLD~G INTENS~ES As a basis for the redevelopment of the Project Area, it is proposed that, in general, building intensities be controlled by limits on: (1) the percentage of ground area covered by. buildings (land coverage); (2) the ratio of the total floor area for all stories of the buildings to areas of the building sites (floor area ratio); (3) the size and location of the buildable azeas on. build'rog sites; and (4) the heights of buildings. The land coverage, sizes, and location of buildable areas should be limited as feasible to provide adequate open space. VII. GENERAL STAT~EM~NT OF PRO,POSED BUILDING ST~A.RDS · . As a basis/or the. rede. velopment of the Project Area, it is proposed that building standards should generally conform to the bUiiding requirements of applicable state statutes and local codes. VIII. ATTAXNME, bFF OF THE PURPOSES OF THE____CALIFOKNIA 'COMM~ i~EDEVELOPMENT LAW The pnrposes of the California Community RedeveloPment law would be attained by the proposed redevelopment through: (1) the elimination of blighting influences and the correction Of environmental deficiencies, incl. uding, among others: (i) buildings in which it is unsafe or unhealthy' for persons to live or work, buildings TU$/MCAS/.PrelirrOhrt 0~/26/97 'I1.~ 17:05 F.-L.T, 916 444 3826 M'H & A ~006 on land t.hat, whefi subdivided or when infrastruCtUre is installed, would not comply with community subdivision, zoning or planning regulations, and buildings that, when built, did not conform to the then-effective building, plumbing, mechanical, or' electrical codes adopted by the applicable jurisdiction; (ii) factors that prevent or substantially hinder.., the econom/cally viable reuse or capadty of buildings or areas; (iii) adjacent or nearby incompatible, and uneconomic land uses; (iv) properties currently served by infrastructure that do not meet existing adopted utility or community infrastructure standards; (vi) land containing materials or facilities that will have to be removed to allow for development, such as runways and landing pads; and (vii) properties containing hazardous wastes; (2) the assembly of land into parcels suitable for modem, integrated development with improved pedestrian and vehicular circulation; (3) the rep]ahning, redesign~ reuse and redevelopment of areas which are stagnant or improperly utilized; (4) the strengthening of the economic base of the Project Area'by stimulating new investment; (6) the creation of employment opportunities; (7) the provision of an environment for social, and economic growth; (8) the expansion and improvement of housing /or low- and moderate-income persons; and (9) the installation o£ new or replacement of ex/sting public improvements, facilities, and utilities in areas which 'are currently inadequately served with .regard to' such improvements, fadlities, and utilities. GENERAL IMP. ACT OF TH2E PROJECT UPON THE RESID .EIb_. S TH'EREOF AND__ UPON SURRO~DING NEIGHBORHOODS All occupants within 'the MCAS Property will be relocated by the U.S. Department of Defense in connection with the realignment and closure of the Tustin Marine Corps Air Station, therefore, there is no impact due to the proposed Project on occupants of the MCAS Property. In addition,' there are no existing residential occupants within the Tustin .Property. Pursuax~t to sect. ion 33492.102(b) of the CRL, no p.roperty w/thin the Tustin Property may be acquired by condemnation by the Agency. Because proposed activities in the P~oject Ar~a may include property acquisition, relocation, demolition of structures, the installation of new' or replacement of ex/sting public improvements, and the replanning, redesign, reuse and/or redevelopment of land for public facilities or for disposition for private development, the impact of the proposed Project upon future residents and upon surrounding neighborhoods of the Proiect Area may, in general, be in the areas of traffic circulation, public facilities and services, relocation, environmental quality, 'employment oppor .tunity, and economic development. The .Planning Commission finds .and determines as follows: I o The Marine Corps Air Station, Tustin ("MCAS- Tustin") is scheduled for realignment and closure by the U.S. Department of Defense pursuant to the federal Base Realignment and Closure Act; and II. Boundaries of the MCAS-Tustin overlap the territorial jurisdictions of the Cities of Tustin and Irvine, and both communities desire to cooperate in the use of the redevelopment process to assist in the transition of the MCAS-Tustin from military to civilian uses; and III. California Community Redevelopment Law (Health and Safety Code Section 33000 et seq.) provides in Section 33213 that the legislative body .of one community may by ordinance authorize the redevelopment of an area within its territorial jurisdiction by another community; and IV. City Council of the City of Irvine has by Ordinance No. 96-05, adopted February 27, .1996, authorized the Tustin Community Redevelopment Agency (~Agency") to include the portion of the MCAS- Tustin which is within the territorial jurisdiction of the City of Irvine within the Redevelopment Plan being prepared by the Agency for the MCAS-Tustin; and V° California Legislature has amended the Health and Safety Code to add Article 7 (commencing with Section 33492.100) to Chapter 4.5 of Part 1 of Division 24 (Chapter 165, 1996 Statutes), to provide a legal framework for the redevelopment of the MCAS-Tustin; and VI. Following the recommendation of the Planning Commission of the City of Tustin Resolution 3337, adopted on February 27, 1995, the City' Council of the City of Tustin, by Resolution 95-31, adopted March 6, .1995, designating the Tustin Marine Corps Air Station Survey Area (~Survey Area") for 'redevelopment study purposes and further amended this Survey Area by Resolution 96-11, adopted November 4, 1996, after a recommendation by the Tustin Planning Commission, in Resolution 3417, adopted February 26, 1996; and VIII. Health and Safety Code Section 33222 provides for the Tustin Planning Commission to select a redevelopment project area from within the boundary of the Survey Area, and to formulate a preliminary plan for the redevelopment of the selected project area. IX. The Planning Commission hereby 'selects and designates as the Project Area for the MCAS-Tustin Redevelopment Project the area within the Redevelopment Survey Area shown on the "Project Area Map," attached .hereto as Exhibit A and incorporated by reference herein, 'and as more particularly described in the "Legal Description of Project Area," attaChed hereto as Exhibit B and incorporated .by reference herein. In the event that it is necessary for clarification purposes to make minor, technical changes to the boundary shown in Exhibit A and described .in Exhibit B, the· Planning Commission hereby finds and determines that any such minor, technical change for clarification purposes does not materially a~fect the boundary selected and designated hereby. X . The Planning Commission hereby approves the ~Preliminary Plan for the MCAS-Tustin Redevelopment Project" in the form attached hereto as Exhibit C and incorporated by reference herein. RDA 97-4 A RESOLUTION OF THE TUSTIN COMMUNITY REDEVELOPMENT AGENCY RECEIVING THE PRELIMINARY PLAN FOR THE MCAS- TUSTIN REDEVELOPMENT PROJECT; ESTABLISHING THE PROPOSED BASE YEAR ASSESSMENT ROLL; AUTHORIZING THE TRANSMITTAL OF A MAP, BOUNDARY DESCRIPTION AND A STATEMENT TO TAXING OFFICIALS AND AGENCIES; AND AUTHORIZING PAYMENT OF A FILING FEE TO THE STATE BOARD OF EQUALIZATION The Tustin Community Redevelopment Agency does hereby resolve as follows. I. The Tustin Community Redevelopment Agency finds and determines as follows: A, Bo The Planning Commission of the City of Tustin has by resolution selected the MCAS-Tustin ("MCAS-Tustin") Redevelopment Project and has approved and adopted the Preliminary Plan formulated therefor and submitted said Preliminary Plan to the Redevelopment Agency; and ... Section 33327 of the California Community Redevelopment Law (Health and Safety Code Section 33000 et seq.) provides that the Agency, after receipt of a preliminary 'plan for a project area from the Planning Commission, shall transmit to certain taxing officials and agencies and the State Board of Equalization, a map and description of the boundary of the project area, together with a statement that a plan for the redevelopment of the area is being prepared; and C. Section 33328 of the Community Redevelopment Law requires the Agency to advise such taxing officials and agencies of the base year assessment roll which the Agency proposes to use for the allocation of taxes pursuant to Section 33670 of the'Community Redevelopment Law. II. The Tustin Community Redevelopment Agency does hereby receive the Preliminary Plan for the MCAS-Tustin Redevelopment Project, as attached hereto. III. The Tustin Community Redevelopment Agency does hereby determines that the 1997-98 assessment roll is the Base Year Assessment Roll the'. Redevelopment Agency proposes to use for the allocation of taxes pursuant to Section 33670 of the Community Redevelopment Law. IV. In the event the 1997-98 Base Year Assessment Roll is not captured, the Tustin Redevelopment Agency designates the 19.98-99 assessment roll as the Base Year Assessment Roll proposed to be used for the allocation of taxes pursuant to Section 33670 of the Community Redevelopment Law, and the Executive Director is authorized and directed to notify the taxing officials, affected taxing agencies, and the State Board of Equalization of the change in base year assessment rolls.
