HUSTON, CITY MANAGER · PUBLIC WORKS DEPARTMENT/FIELD SERVICES DIVISION CONTRACT RENEWAL FOR CUSTODIAL MAINTENANCE SERVICES RECOMMENDATION: It is reco~ended that the City Council, at their meeting of September 15, 1997 approve an amendment to the agreement between Pacific Building Care and the City of Tustin for Custodial Maintenance Services. This contract amendment would extend the agreement from August 1, 1997 to July 30, 1998 and would grant the contractor a 5.6% increase in the yearly cost of the contract. This action is conditioned upon ,City Attorney approval of the contract language. FISCAL IMPACT: The State of California has adopted three minimum wage increases in the period March 1, 1997 to March 1, 1998. These adjustments will raise the minimum wage from $4.75/hour to $5.75/hour, an increase of 21%. Pacific Building Care employs a number of individuals at this pay scale, and the ability of this firm to maintain service levels without an increase in the monthly contract cost is not possible. Staff has negotiated adjustments to the contract effective October 1,1997, and March 1, 1998. These adjustment~ provide for a 3.7% or $494.95/mo. increase effective October 1,1997, and a 5.2% or $732.58/mo. increase March 1, 1997. Both of these increases combine for a 5.6% increase in the contract price over a twelve-month term. Because this increase was projected prior to the budget there are sufficient funds available in the 1997/98 Budget to absorb this increase. DISCUSSION: The City has cc~ntracted with Pacific Building Care since August 1, 1994 for custodial maintenance services. The original agreement was for a two-year period with an allowance of two one-year extensions. This would be the last extension of this agreement, with the city seeking new proposals for cumxtial maintenance the next fiscal year. Pacific Building Care has done a good job of providing custodial services the last two years. They have been responsive to the city's needs and have not hesitated to respond when maintenance is not up to city standards. The request of Pacific Building Care for an adjustment to the contract above the C.P.I. is within reason given the increases in minimum wage. Pacific Building Care had requested an increase effective March 1, 1997, at the time of the first wage increase, but staff would not consider this near the end of a contract term. The overall increase in the contract price over a 12-month period is 5.6%, or $8,611.14. For this increase the City will receive 12 months of quality maintenance services at all public buildings and city park restrooms. This Amendment is made with reference to the following: RECITALS Ao WHEREAS, City and Contractor entered into an Agreement dated August 30, 1994, the "Agreement" wherein Contractor agreed to perform maintenance services for City buildings and facilities pursuant to Section C, Attachments F and G, Pages C-21 and C-22; g. WHEREAS, the terms of the Agreement was for two years, initially, with the ability to be extended by written agreement of each of the parties; Co WHEREAS, City and Contractor desire to exercise the extension clause pursuant to Section C, Page C-11, Paragraph 9, Item A, to extend the Agreement for one year; Do WHEREAS, City and Contractor desire to exercise the extension clause pursuant to Section C, Page C-11, Paragraph 9, Item A for one year; TERM of the Agreement shall be amended to read as follows: The Term of this Agreement shall be for a period of one year, commencing September 1, 1997, unless terminated pursuant to Section B, Paragraph 5 and Section C, Page C-11, Paragraph 9, Items A and B of this Agreement. Attachment 'A' CUSTODIAL PROPOSAL SHEET shall be amended as indicated to include additional areas and revised Contract costs. Except as expressly amended by this Amendment to Agreement, all other terms and conditions of the August 30, 1994, Agreement and all Exhibits thereto, shall remain in full force and effect. City shall pay Contractor the following sums for the periods indicated: From August 1, 1997 to .September 30, 1997, the City shall pay the Contractor, on a monthly basis, an amount equal to $12,728.00. From October 1, 1997 to February 28, 1998, the City shall pay the contractor, on a monthly basis, an amount equal to $13,222.94 From March 1, 1998 to July 31, 1998, the City shall pay the Contractor, on a monthly basis, an amount equal to $13,955.52. City shall pay the Contractor a sum not to exceed $161,348.48 for the period from August 1, 1997 to July 31, 1998.
