AWARD OF CONTRACT FOR RECONSTRUCTION OF "A" STREET AND MOUNTAIN
VIEW DRIVE BETWEEN FIRST STREET AND IRVINE BOULEVARD (PROJECT NOS.
700145 AND NO. 700146)
SUMMARY: Bids have been received and the construction contract ,is ready for award. The award of the]
construction contract will provide for the complete reconstruction of A" Street and Mountain view Dr/vel
between First Street and Irvine Boulevard.
RECOMMENDATION
It is recommended that. the City Council, at their meeting of September 15, 1997 consent to relieve the low
bidder, Damon Construction Company, of their bid (due to a clerical error) and release Damon's Bid Bond
accordingly. The second low bidder, Silvia Construction, has been disqualified due to their failure to return
the signed addendum. It is therefore recommended to award the subject contract to GMC Enterprises, in the
amount of $437,845.27.
FISCAL IMPACT
The City's Capital Improvement Program Budget for 1997-98 FY provides $336,000 for the reconstruction
of"A" Street and $258,000 for Mountain View Drive from the Capital Improvement Program (CIP) funds.
GMC Enterprises' bid is approximately 3.8% above the engineer's estimate but is still within the
appropriated project budget.
BACKGROUND
Bids for this subject project were opened on August 25, 1997. There were eight (8) bids received and the
results were as follows:

This project will provide for the complete reconstruction of street pavement, curb, gutter, sidewalk and
parkway landscaping along with construction of storm drain improvements for both "A" Street and
MountainView Drive between First Street and Irvine Boulevard.

On August 27, 1997, two days after bid opening, Damon Construction Company (Damon) requested relief of
their bid proposal due to a clerical error in their unit price for disposal fees which materially affected their
bid by approximately $85,000.
The Public Works Department and the City Attorney have reviewed and evaluated the support information
that was submitted by Damon regarding the subject bid item and find that Damon Construction has satisfied
the requirements for bid relief. It is hereby recommended to relieve Damon of their bid and release their bid
bond.
The second low bidder, Silvia Construction, was disqualified because they did not acknowledge Addendum
No. 1 to the contract as required by the bid process. Therefore, staff requests that City Council authorize
award of the contract to GMC Enterprises, the third lowest bidder and the second lowest responsive bidder.
In the event that GMC fails to execute the contract documents in the time prescribed, or does not provide the
required bonds and insurance, it is recommended that the Council determine that the bidder has abandoned
the contract and that the posted bid security shall be thereby forfeited to the City.
