HUSTON, CITY MANAGER FROM: COMMUNITY DEVELOPMENT DEPARTMENT SUBJECT: ORANGE COUNTY FIRE AUTHORITY FIRE PREVENTION FEE RESOLUTION RECOMMENDATION That the City Council adopt Resolution .No. 97-82, amending and restating Resolution No. 91-56, which establishes the Orange County Fire Authority as the responsible agency for setting fire prevention fees for the City. FISCAL IMPACT Adoption of Resolution No. 97-82 will not create any new City fees. This resolution will preserve the City administration fees related to the processing of plans and projects by the City for the Fire Authority' These administration fees are restated from Resolution No. 91-56 and do not exceed the estimated reasonable cost of providing such services. BACKGROUND/DISCUSSION On May 20, 1991, the City Council adopted Resolution No. 91-56, which enacted fees for fire prevention services provided by the Orange County Fire Department. Resolution No. 91-56 also established a City of Tustin Administration Fee applicable to fire projects and plans the City processed on behalf of the Fire Department. The Orange County Fire Department was transformed into the Orange County Fire Authority effective March 1, 1995. The Orange County Fire Authority continued to operate under the fee schedule adopted in Resolution No. 91-56 until July 1, 1997. That fee study resulted in the revised fee schedule that became effective July 1, 1997, for fire prevention services. As such, it would be appropriate for the City to adopt Resolution No. 97-82 restating and reaffirming the provisions of Resolution No. 91-56 and acknowledge the change in legal authority from Orange County Fire Department to Orange County Fire Authority. The City Council of the City of Tustin does hereby resolve as follows: I. The City Council finds and determines.as follows: a. The City of Tustin is authorized to perform fire services pursuant to California Constitution Article XI, Section 7, Government Code Section 38611 and the Health and Safety Code Section 13146; and Government Code Section 54980 characterizes these services as "municipal services and functions"; and B . Government Code Section 54981 provides that the legislative body of a local agency may contract with any other local agency for performance of municipal' services or functions within the territory of the former; and C . The City of Tustin has agreed to delegate its authority to provide fire services to the Orange County Fire Authority ("Authority") in a Joint Powers Agreement effective March 1, 1995; and D . Article IV, Paragraph 4(n) of the Joint Powers Agreement specifically empowers the Authority to "levy and collect payments and fees for services, provided that paramedic or ambulance user fees shall be approved by the member(s) affected"; and E . The City of Tustin has adopted Resolution No. 91-56 which contains language inconsistent with the delegation to the Authority of the City's power to set fees related to fire services; 'and F · In the interest of efficiency, effectiveness, and public convenience, the City of Tustin wishes to delete the inconsistent language from Resolution No. 91-56. G. Resolution No. 91-56 as provided in Exhibit "A" attached hereto and incorporated by this reference is amended and restated to acknowledge the change 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Resolution No. 97-82 Page 2 in legal authority from Orange County Fire Department to Orange County Fire Authority (Authority). II. The City Council hereby designates the Authority as the agency responsible for setting fees related to all services it provides within the jurisdiction of the City of Tustin with the exception of the setting of fees for paramedic and ambulance services. III. The Orange County Fire Authority is hereby authorized to administer the fee schedule shown in Exhibit "B" and take said collection and enforcement action as may be necessary, with the exception that the City of.Tustin shall collect plan check and new construction inspection fees only for the Orange County Fire Authority, plus a 14.5% administrative fee to defray costs incurred by the City of Tustin for this service. Collection of permit, reinspection, false alarm and miscellaneous fees shall remain the responsibility of the Orange County Fire Department. Fire Alarm fees can not be collected until and unless authorized by ordinance of the City of Tustin. IV. The Orange County Fire Authority Fee Schedule may be adjusted as approved by the Authority Board of Directors (Board). The City of Tustin administrative fee shall be adjusted to reflect any changes within 60 days of the effective date of the Board's action. The City Council of the City of Tustin does hereby resolve as follows: I. FEE SCHEDULE FIRE PREVENTION FEE PROJECT, 7-1-97 Facts and Figures BA CKGR 0 UND The Board of Directors of the Orange County Fire Authority (OCFA) directed staff to work with the cbnsulting firm of David M_ Griffith and Associates (DMG) in order to .revise fire prevention fees. The objective is to recover only the costs of providing the user fee-related services. As a result of the fee study, the Board adopted a new fee schedule, to be effective July 1, 1997. The last schedule of fire prevention fees was adopted in 199 l, and there have been no adjustments made since that time. In the future, the OCFA fee schedule will be reviewed and revised every three years, during the adoption process for the Uniform Fire Code.. DMG made a number of recommendations to OCFA to maximize the recovery of fire prevention user fees. The Board adopted these recommendations, including a change in how Planning and Development fees are recovered~ Instead of collecting fees AFrER plans have been reviewed, these fees will be recovered IN ADVANCE. This will help to eliminate the plans which OCFA reviews but are NEVER PICKED UP (estimated at about 1 $% of all plan reviews). No fees were Collected on those plans, even though the work was performe& This has adversely affected turnaround times, overall revenue collected and, as a result, ability to hire or contract for additional staff to get the work done. We need the helpof all member jurisdictions in implementing this aspect of the new fee schedule. A comerstone of the new fees is that they are based on actual costs for the services. Costs have been documented based on many improvements in our automated systems and records since the old fee schedule was developed in 1991. Interestingly, not all the fees will increase under the new schedule-over 10% of the fees will decrease.. Many of the decreases are in'the area of Uniform Fire Code Permits. A brief summary of- the planning and Development fees is outlined below. pLANNING AND DEVELOPMENT New Fees: · For 3,300 plans annually, new fees will range from :5;82 to I;174. Examples include CEQA documents, conditional use permits, tract maps and fuel modifications. · For an estimated 985 second plan re-submittals, at a $60 hourly rate. Fee Increases: · 990 plans annually for hazardous materials and high piled storage, from $438 to $524.
