RECOMMENDATION: their meeting of September 15, 1997 approve an amendment to the

landscape maintenance of the water facilities (i.e. wells & reservoirs), and would grant the contractor a 5% increase
in the monthly price of the contract, effective September 1, 1997. This action is conditioned upon City Attorney
approval of the contract language.

maintain service levels without an increase in the monthly contract cost is not possible. In addition,
escalation of fuel costs, insurance premiums, and equipment replacement have eroded anY gain they received from a
CPI adjustment. Staffhas negotiated an adjustment to the contract of 5% effective September 1,1997, which will
increase the monthly contract price by $462.00/month. The increase in the monthly service fee was anticipated, and
this was incorporated into the 1997/98 Budget.
In addition, the City is proposing to add the landscape maintenance of the water facilities to the contract with Plant
Control. This will increase the contract by a total of$1,315.00/month for nine months, and will add an additional
$! 1,835 to the total yearly contract Price- The funding for this work will come from the Water Services Fund, and
will be funded out of salary savings obtained through the retirement of a maintenance worker.
The twelve-month contract, including all items will amount to a total of $130,000.
1996 for landscape
DISCUSSION-:
~he City has contracted with Plant Control Landscape Maintenance Inc. since August 1,
maintenance of the Civic Center and center islands throu~o~ the city. During this first twelve-month period we
have added the maintenance of the Tustin Family Youth Center and center islands along Edinger Avenue to their
scope of work. The original agreement was for a one-year period, with one (1) year term extensions that may be
granted for (3) additional years. Plant Control has provided consistent service of a reasonably hig~ quality, and has
been very responsive to corr~ areas when ma~ance is not up to city standards.

The maintenance of the water sites will increase the contract by $1,315.00 per month, effective October 1, 1997.
The funding for this work will come from the Water Services Fund.
The overall increase in the contract price over a 12-month Period is $20,358.00, of which $4,568.00 is due to the
5% increase in contract price, $3,230.00 for the addition of the Tustin Family Youth Center and the Edinger Island
median to the maintenance agreement, and $12,560.00 for the addition of the landscape maintenance at the water
faCilities. The implementation of this increase will a/Iow the contractor to continue to provide the quality and
responsiveness the City has received in the previous twelve months.

AMENDMENT TO
CONTRACT AGREEMENT
THIS SECOND AMENDMENT is entered into this day of ,1997,
by and between the City of Tustin, a Municipal Corporation (herein referred to as "City"), and Plant
Control Landscape Maintenance, Inc., whose address is 2200 S. Fairview, Santa Ana, California, 92704
(herein referred to as "Contractor").
This Amendment is made with reference to the following:
RECITALS
h.
WHEREAS, City and Contractor entered into an Agreement dated November 11, 1996,
the "Agreement" wherein Contractor agreed to perform landscape maintenance services at
City facilities and on center medians pursuant to Section C, Attachments F and G, Pages
C-21 and C-22; -

WHEREAS, the terms of the Agreement was for one year, initially, with the ability to be
extended by written agreement of each of the parties; a total of 3, one year periods; and

WHEREAS, City and Contractor desire to exercise the extension clause pursuant to
Section B, Page B-2, Paragraph 4, Item B, to extend the Agreement for one year;

WHEREAS, City and Contractor desire to add the landscape maintenance of additional
areas to the contract;
TERM of the Agreement shall be amended to read as follows:
The Term of this Agreement shall be for a period of one year, commencing July 1, 1997, unless
terminated pursuant to Section B, Page B-32, Paragraph 48 of this Agreement.
The Agreement for Landscape maintenance Services shall be amended to include the following
additional areas:
Edinger Island Center Median (Jamboree to Harvard)
Tustin Family Youth Center
City of Tustin Water Facility which includes the yard, reservoir, and water well site
Except as expressly amended by this Amendment to Agreement, all other terms and conditions of
the November 11, 1996, Agreement and all Exhibits thereto, shall remain in full force and effect.
City shall pay Contractor the following sums for the periods indicated:
From July 1, 1997 to August 31, 1997, the City shall pay the Contractor, on a monthly basis, an
amount equal to $9,393.25.
From September 1, 1997 to September 30, 1997, the City shall pay the contractor, on a monthly
basis, an amount equal to $9,862.91.
From October 1, 1997 to June 30, 1998, the City shall pay the Contractor, on a monthly basis, an
amount equal to $11,177.91.
City shall pay the Contractor a sum not to exceed $130,000.00 for the period from July 1, 1997 to
June 30, 1998.
IN WITNESS WHEREOF, the parties have hereunto set their hands and seals the year and date
first above written.
