HUSTON, EXECUTIVE DIRECTOR REDEVELOPMENT AGENCY STAFF PRELIMINARY PLAN FOR THE MCAS-TUSTIN REDEVELOPMENT PROJECT RECOMMENDATION Adopt Resolution No. 97-4 receiving the Preliminary Plan for the MCAS-Tustin Redevelopment Project; establishing 1997-1998 as the Base Year Assessment Roll; authorizing transmittal of a project description to taxing agencies and payment of filing fees to the State Board of Equalization. FISCAL IMPACT The initial fee to the State Board of Equalization is approximately $1,600. MCAS-Tustin project costs have been appropriated in the Agency's 1997-1998 fiscal year budget. BACKGROUND The Planning Commission at their., meeting on September 8, 1997 selected the MCAS-Tustin Redevelopment Project boundaries and approved a Preliminary Plan for the MCAS-Tustin Redevelopment Project (Resolution No. 3544 is included as Attachment A). Pursuant to California Community Redevelopment Law, the Agency is required to receive the Preliminary Plan, provide a description of the project area to the County Assessor and to each affected taxing entity and file a map and legal description with the State Board of Equalization. Within sixty to ninety (60 - 90) days the county officials will deliver to the Redevelopment Agency and affected taxing entities a report on the assessed value of taxable property, the assessed value in the project area in prior years, the amount of tax revenue to be derived from each taxing entity, and related information. After receiving this report, if the Redevelopment Plan provides for tax increment financing, the Redevelopment Agency must prepare and submit to each affected taxing agency a preliminary report specifying the reasons for Selection of the project area, a description of the conditions in the project area, an assessment of the economic feasibility of the project, a description of the projects to be undertaken, and how such projects will alleviate the conditions in the Redevelopment Project Area. Huston Preliminary Plan for MCAS-Tustin Redevelopment Project September 15, 1997 Page 2 The actual Redevelopment Plan woUld then be drafted and presented to the Planning Commission and subsequently to the Irvine City Council and Tustin City Council and Redevelopment Agency. The Plan will need to conform with elements required by California Redevelopment Law. As a consequence of procedures required by law it is estimated that the Redevelopment plan would be adopted sometime in March or April of 1998. A more detailed schedule of actions is included as Attachment B. DISCUSSION Based upon a staff evaluation and the recommendation of' the Agency's rede. velopment. consultants, the finn of Katz-Hollis, a proposed Project Area is attached as well as a Preliminary Plan for the MCAS-Tustin Redevelopment Project. The Project Area would include property within the Marine Corps Air Station (MCAS-Tustin). In addition, special base closure legislation for MCAS~TUStin permits the inclusi°n of 52 acres Outside bf MCAS-TuStin within' the Project provided that the 52 acres outside of MCAS-Tustin are contiguous to the base and necessary for effective redevelopment. The provisions also state that the 52 acre area must be blighted under standard Redevelopment Plan adoption definitions not those in the MCAS-Tustin special legislation. As a note, the Agency is not permitted to use eminent domain within the 52 acre area. As shown on the MCAS Tustin Redevelopment Project Area boundary map, the 52 acre area is divided among a number of individual parcels. These parcels can be grouped into three separate areas. The largest group of parcels are located at the intersection of Edinger and Red Hill Avenues... The majority of this area is 'developed as a business park' and storage facility located at the southwest comer of Red Hill Avenue and Edinger Avenue. The business park contains 92 tenant spaces, of which seven are currently vacant. The tenants include a wide variety of light manufacturing, distribution, and business office uses. Across the street from the business park is four-acre triangular parcel developed with "The Barn Restaurant" and vacant land area to the east. · Another major grouping of parcels is located at the northwest comer of Edinger Avenue and Jamboree Road. The majority parcels in this area are vacant. Eight automobile repair businesses and a fast food restaurant have recently located in new development in the southern end of the area. The vacant parcels are located at the northern end of the area adjacent to the proposed MetroLink Station site. The last grouping of parcels consiSts of two parcels that border Harvard Avenue adjacent to the City of Irvine. Both these parcels are vacant and have been designated in the MCAS, Tustin Specific Plan/Reuse Plan ("Specific Plan/Reuse Plan") for furore residential development. Christine A. A RESOLUTION OF THE TUSTIN COMMUNITY REDEVELOPMENT -AGENCY RECEIVING THE PRELIMINARY PLAN FOR THE MCAS- TUSTIN REDEVELOPMENT PROJECT; ESTABLISHING THE PROPOSED BASE YEAR ASSESSMENT ROLL; AUTHORIZING THE TRANSMITTAL OF A MAP, BOUNDARY DESCRIPTION AND A STATEMENT TO TAXING OFFICIALS AND AGENCIES; AND AUTHORIZING PAYMENT OF A FILING FEE TO THE STATE BOARD OF EQUALIZATION The Tustin Community Redevelopment Agency does hereby resolve as follows. II. III. IV. The Tustin Community Redevelopment Agency finds and determines as follows: A. The Planning Commission of the City of Tustin has by resolution selected the MCAS-Tustin ("MCAS-Tustin") Redevelopment Project and has approved and adopted the Preliminary Plan formulated therefor and submitted said Preliminary Plan to the Redevelopment Agency; and -.. Bo Section 33327 of the California Community Redevelopment Law (Health and Safety Code Section 33000 et. seq.) provides that the Agency, after receipt of a preliminary 'plan for a project area from the Planning Commission, shall transmit to certain taxing officials and agencies and the State Board of Equalization, a map and description of the boundary of the project area,.. together with a statement that a plan for the redevelopment of the area is being prepared; and Co Section 33328 of the .Comn_~_unity Redevelopment Law requires the Agency to advise such taxing officials and agencies of the base year assessment roll which the Agency proposes to use for the allocation of taxes pursuant to Section 33670 of the'Community Redevelopment Law. The Tustin Community Redevelopment Agency does hereby receive the Preliminary Plan for the MCAS-Tustin Redevelopment Project, as attached hereto. The Tustin Community Redevelopment Agency does hereby determines that the 1997-98 assessment rOll is the Base Year Assessment Roll the: Redevelopment Agency proposes to use for the allocation of taxes pursuant to Section 33670 of the Community Redevelopment Law. VI. advice of the base year assessment roll which the Tustin Community Redevelopment Agency proposes to use for the allocation of taxes pursuant to Section 33670 of the Community Redevelopment Law, to the taxing officials and agencies, and to the State Board of Equalization, in the 'form and manner required by law. " The Executive Director of the Tustin Redevelopment Agency is hereby authorized to pay to the State Board of Equalization and the Orange County fees for filing and processing said statement and map as may be required pursuant to the Community Redevelopment Law. In the event the 1997-98 Base Year Assessment Roll is not captured, the Tustin Redevelopment Agency designates the 1998-99 assessment roll as the Base Year Assessment Roll proposed to be used for the allocation of taxes pursuant to Section 33670 of the Community Redevelopment. Law, and the Executive Director_is authorized and directed to notify the taxing officials, affected taxing agencies, and the state Board of Equalization of the change in base year assessment rolls. The Planning Commission finds and determines as follows: I o The Marine CorPs Air Station, Tustin (~MCAS- Tustin") is scheduled for realignment and closure by the U.S. Department of Defense pursuant to the federal Base Realignment and Closure Act; and· II. Boundaries of the MCAS-Tustin overlap the territorial jurisdictions of the Cities of Tustin and Irvine, and both communities desire to cooperate in the use of the redevelopment process to assist in the transition of the MCAS-Tustin from military to civilian uses; .and III. California Community Redevelopment Law (Health and · Safety Code Section 33000 et seq.) provides in Section 33213 that .the legislative body of one community may by ordinance authorize the redevelopment of an area within its territorial jurisdiction by another commUnity; and IV. City Council of the City of Irvine has by Ordinance No. 96-05, adopted February 27, 1996, authorized the Tustin Community Redevelopment Agency ("Agency") to i~clude the portion of the MCAS- Tustin whiCh is within the territorial jurisdiction of the City of Irvine within the Redevelopment Plan being prepared by the Agency for the MCAS-Tustin; and V. California Legislature has amended the Health and Safety Code to add Article 7 (commencing with Section 33492.100) to Chapter 4.5 of Part 1 of Division 24 (Chapter 165, 1996 Statutes), to provide a legal framework for the redevelopment of the MCAS-Tustin; and VI. Following the recommendation of the Planning Commission .of the City of Tustin Resolution 3337, adopted on February 27, 1995, the City Council of the City of Tustin, by Resolution 95-31, adopted March 6, 1995, designating the Tustin Marine Corps .fAir Station Survey Area (~Survey Area") for redevelopment study purposes and further amended this Survey Area by Resolution 96-11, adopted November 4, 1996, after a recommendation by the TUstin Planning Commission, in Resolution 3417, adopted February 26, 1996; and VIII. Health and Safety Code Section 33222 provides for the Tustin Planning Commission to select a redevelopment project area from' within--the- boundary of the Survey Area, and to formulate a preliminary plan for the redevelopment of the selected project area. IX. The Planning Commission hereby selects and designates as the Project Area for the MCAS-Tustin Redevelopment Project the area within- the Redevelopment Survey Area shown on the ~Project Area Map," attached hereto as Exhibit A and incorporated by reference herein, and as more particularly described in the ~Legal Description of Project Area," attached hereto as Exhibit B and~ incorporated .by reference ~herein. In the event that it is necessary for clarification purposes to make minor, technical changes to the boundary shown in Exhibit A and . described in Exhibit B, the Planning C0m~iss~on ~hereby finds and determines that any such minor, technical change for clarification purposes does not materially a~fect the boundary selected and designated hereby. X. The Planning Commission hereby approves the ~Preliminary Plan for the MCAS-Tustin Redevelopment Project" in the form attached hereto as Exhibit C and incorporated by reference herein. The purposes of the California Community Redevelopment would be attained by the proposed, redevelopment through: (1) the elimination of blighting influences and the. correction of environmental deficiencies, including, among others: (i) buildings in wl'dch it is unsafe or unhealthy' for persons to live or work, buildings 29z71/001 2 8/26/97 TUB 17-05 F..!~ 916 -"~ 3826 ~ E & A ~005 on land that, wheiX subdivided or when infrastruCtUre is installed, would not comply with community 'subdivision, zoning or pIarming regulations, and buildings that, when built, did not conform to the then-effective building, plumbing, mechanical, or' electrical codes adopted by the applicable jurisdiction; (ii) factors that prevent or substantially hinder.~ the economically' viable reuse or capadty of buildings or areas; (iii) adjacent or nearby incompatible, and uneConomic land uses; (iv) properties currently served by infrastructure that do not meet existing adOPted utility or community infi:astructure standards; (vi) land containing materials or facilities that will have to be removed to allow for development, such as runways and landing pads; and (vii) properties containing hazardous wastes; (2) the assembly of land into parcels suitable for modem, integrated development with improved, pedestrian and vehicular circulation; (3) the replahning, redesign, reuse and redevelopment of areas which are stagnant or improperly utilized; (4) the strengthening of the economic base of the Project Area'by stimulating new investment; (6) the creation of employment opportunities; (7) the provision of an environment for sodaI-and economic growth; (8) the expansion and improvement of housing for low- and moderate-income persons; and (9) the installation of new or replacement of existing public improvements, facilities, and utilities in areas which are currently inadequately served with .regard to such improvements, fadlities, and utilities, GENERAL IMPACT OF ~ PRO__IECT UPON ~ RESIDENTS 'I-HEREOF AN]~.. Pursuant to section 33492.102(b) of the CRL, no prope .rty .within the Tustin Property may be acquired by condemnation by the Agency.
