TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT.
RECOMMENDATION
That the Planning Commission adopt Resolution No. 3855 determining that the right-of-way
acquisitions involved with the Red Hill Avenue Widening at the I-5 (CIP 7133), Irvine
Boulevard/Newport Avenue Intersection Enhancement (CIP 7118), Newport Avenue/SR55
RamP Reconfiguration (CIP 7130) and the Newport Avenue Extension - Phase II (CIP
7131) are in conformance with the Tustin General Plan.
BACKGROUND
Section 65402 (a) of the California Government Code (State Planning and Development
Law) requires cities to inform and obtain General Plan conformity from local planning
agencies prior to acquisition or disposition of real property. The City of Tustin is proposing
to acquire right-of-way for certain projects included in the Fiscal Year (FY) 2002-03 Capital
Improvement Program. These projects include:

On August 5, 2002, the City Council adopted the FY 2002-03 Capital Improvement
Program. Included in the program are the four projects and each project requires
acquisition of right-of-way for street purposes.

All four projects will widen existing roadways and the Newport Avenue Extension - Phase II
Project will. extend Newport Avenue to Edinger Avenue. All street widening proposed in the
four projects and the extension of Newport Avenue to Edinger Avenue is in conformance
with the Circulation Element of the General Plan. A copy of General Plan Figure C-2,
Arterial Highway Plan is attached as Exhibit A.
A description of each project is as follows:
Red Hill Avenue Wideninq at the I-5 Freeway (CIP 7133)
This project proposes to widen Red Hill Avenue between El Camino Real and Nisson Road
to meet six (6) lane Major Arterial standards and relieve traffic congestion. The General
Plan designation for this segment of Red Hill Avenue is a six (6) lane Major Arterial. The
improvements will i~iclude three (3) through lanes in each direction on Red Hill Avenue,
adding a right turn lane to both freeway on-ramps and adding bicycle lanes on Red Hill
Avenue within the project limits. Exhibit B-1 is a right-of-way exhibit for the proposed
project and Exhibit C-1 is a listing of the rights-of-way required for the project.
Irvine Boulevard/Newport Avenue Intersection Enhancement (CIP 7118)
This project proposes to widen the intersection of Irvine Boulevard and Newport Avenue
and both arterials beyond the intersection in order to relieve congestion and meet traffic
demand. The limits of the widening on Irvine Boulevard are from the west side of Holt
.Avenue to 100 feet east of Elizabeth Way and on Newport Avenue from First Street to
Wass Street. The General Plan designation for this segment of Irvine Boulevard is a six (6)
lane Modified Major Arterial and the designation for this segment of Newport Avenue is an
Augmented Primary Arterial Roadway. On Irvine Boulevard, the improvements will include
three (3) through lanes in each direction with double left turn lanes in each direction at
Newport Avenue. On Newport Avenue, the improvements will include three (3) through
lanes in each direction between Holt Avenue and the north side of Old lrvine Boulevard.
Double left turn lanes will be provided for southbound Newport Avenue at Old Irvine
Boulevard and for northbound Newport Avenue at Holt Avenue. Exhibit B-2 is a right-of-
way exhibit for the proposed project and Exhibit C-2 is a listing of the rights-of-way required
for the project.
Newport Avenue/SR-55 Ramp Reconfiguration (CIP 7130)
This project proposes to reconfigure the on and off ramps to the northbound SR-55
Freeway at Edinger Avenue and extend Newport Avenue from Edinger Avenue to Valencia
Avenue. The project will also connect Del Arno Avenue to the reconfigured on and off
ramps. Newport Avenue is proposed to meet six (6) lane Major Arterial standards and Del

Amo Avenue is proposed to meet four (4) lane Secondary Arterial standards. These are
the designations for both roadways shown in the General Plan. Once the proposed on and
off ramps are constructed, the existing on and off ramps at Edinger Avenue will be
abandoned. Exhibit B-3 is a right-of-way exhibit for the proposed project and Exhibit C-3 is
a listing of the rights-of-way required for the project.
Newport Avenue Extension- Phase ii (CIP 7131)
Newport Avenue currently ends north of the F-10 Orange County Flood Control District
Channel and the Orange County Transportation Authority. (OCTA)/Southern California
Regional Rail Authority (SCRRA) right-of-way. This project.proposes to extend Newport
Avenue over a re-routed F-10 channel and under the rail' facility and connect with Edinger
Avenue. Newport Avenue will be constructed to six (6) lane Modified Major Arterial
standards between Edinger Avenue and Sycamore Avenue which conforms to the General
Plan designation for this segment of Newport Avenue. Exhibit B-4 is a Possible Partial
Right-of-way Property Acquisition exhibit for the proposed project. A listing of the rights-of-
way to be acquired is currently not available because the project is currently in the design
phase and detailed right-of-way required is in the process of being determined.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
TUSTIN DETERMINING THAT THE RIGHT-OF-WAY ACQUISITIONS
FOR THE RED HILL AVENUE WIDENING PROJECT AT THE I-5
FREEWAY (CIP 7133), THE IRVINE BOULEVARD/NEWPORT
AVENUE INTERSECTION ENHANCEMENT PROJECT (CIP 7118),
THE NEWPORT AVENUE/SR-55 RAMP RECONFIGURATION
PROJECT (CIP 7130) AND THE NEWPORT AVENUE EXTENSION
PROJECT - PHASE II (CIP 7131) CONFORM WITH THE TUSTIN
GENERAL PLAN
The Planning Commission does hereby resolve as follows:
I. The Planning Commission finds and determines as follows:
A,
That the right-of-way acquisitions for street and highway purposes are
required for the Red Hill Avenue Widening Project at the I-5 Freeway (CIP
7133), the Irvine Boulevard/Newport Avenue Intersection Enhancement
Project (CIP 7118), the Newport Avenue/SR-55 Ramp Reconfiguration
Project (CIP 7130) and the Newport Avenue Extension Project - Phase I!
(CIP 7131).

That California Government Code Section 65402 (a) provides that a City shall
not acquire or dispose of real property until the location, purpose, and extent
of the project has been reported upon by the local planning agency as to the
conformity with the applicable adopted General Plan.
C.
That the projects listed in Subsection I.A above were approved by the City
Council on August 5, 2002, as part of the FY 2002-03 Capital Improvement
Program and in accordance with the Tustin General Plan.
That General Plan conformity determinations required by GOvernment Code
Section 65402 (a) are not "projects" requiring environmental review pursuant
to the California Environmental Quality Act.
II.
The Planning Commission hereby determines that the location, purpose, and
extent of the rights-of-way to be acquired by the projects listed in Subsection I.A
above by the City of Tustin for street and highway purposes conforms with the
Tustin General Plan.
