REGULAR MEETING OF THE CITY COUNCIL
CITY OF TUSTIN, CALIFORNIA
APRIL 15, 1991
I. CALL TO ORDER/PLEDGE OF ALLEGIANCE
The meeting was called to order by Mayor Edgar at 7:00 p.m. in the
City Council Chambers, 300 Centennial Way. The Pledge of Allegiance
was led by Councilmember Potts.

The Invocation was given by Rev. Alan Waterson of Aldersgate United
Methodist Church.

IV. PROCLAMATIONS
1. TUSTIN HIGH SCHOOL BASKETBALL STATE CHAMPIONSHIP RECOGNITION
Mayor Edgar read and presented a proclamation to the Tustin High
School Boys' Basketball Team and coaches in recognition of their
California State Championship Division II victory.
Coach McCluskey thanked the Council and the City for their
support of the team.
2. NATIONAL VOLUNTEER WEEK, APRIL 22-26
Mayor Edgar read and presented a proclamation recognizing
National Volunteer Week, April 22-26, 1991.
Margarete Thompson, accepted the proclamation on behalf of all
the Tustin volunteers, and thanked the Council for the
recognition.
V. PUBLIC HEARINGS
1. PROSPECT AVENUE UNDERGROUND DISTRICT NO. 12
^" Robert Ledendecker, Director of Public Works, reported Prospect
Avenue Underground District No. 12 was located on Prospect
Avenue between First Street and approximately 289 feet north of
Beneta Way. He stated no property owners were affected.
Mayor Edgar opened the public hearing at 7:10 p.m. There were
no speakers on the subject and the public hearing was closed.
It was moved by Puckett, seconded by Pontious, that Ordinance
No. 1064 have first reading by title only. Motion carried 5-0.
Following first reading by title only of Ordinance No. 1064 by
the City Clerk, it was moved by Potts. seconded by Pontious,
that the following Ordinance No. 1064 be introduced:

2. YORBA STREET UNDERGROUND DISTRICT NO. 13

Robert Ledendecker, Director of Public Works, reported the Yorba
Street Underground District No. 13 was located on Yorba Street
between First Street and 683 feet north of First Street. Eight
property owners would require underground service conversion.
Council/staff discussion followed regarding affected property
owners.
Mayor Edgar opened the public hearing at 7:12 p.m. There were
no speakers on the subject and the public hearing was closed.
It was moved by Puckett seconded by Pontious, that Ordinance
No. 1065 have first reading by title only. Motion carried 5-0.
Following first reading by title only of Ordinance No. 1065 by
the City Clerk, it was moved by Pontious seconded by Puckett,
that the following Ordinance No. 1065 be introduced:

VI. PUBLIC INPUT
1. MISS TUSTIN SCHOLARSHIP PAGEANT - APRIL 20, 1991
Margarete Thompson, 2251 Barberry Road, Tustin, invited the
Council and citizens of Tustin to the Third Annual Miss Tustin
Scholarship Pageant, Saturday, April 20, 1991, at St. Jeanne
Lestonnec School.
2. WATER RATIONING
Keith Albee, 13541 Diamond Head, Tustin, expressed concern
regarding the water rationing ordinance bill period and summer
allotment definitions.
Steve Chambers, 12452 Red Hill Avenue, Santa Ana, expressed
concern regarding the amount of water usage available without
penalty to large lot property owners.
Mayor Edgar replied that there was an appeal process contained
in the ordinance.
Councilmember Potts also clarified that the Tustin Ranch Golf
Course was watered with reclaimed/gray water which replenished
the ground water supply and prevented ocean water from polluting
the ground water.
3. REGGIE YATES CHARITY BASKETBALL GAME - APRIL 25, 1991
Students from Tustin High School reported tickets were on sale
for the Reggie Yates Charity Basketball game on April 25, 1991,
7:00 p.m., at Tustin High School, between the Tustin Tillers
Boys' Basketball Team and the Los Angeles Raiders.
S. LEFT -TURN TRAFFIC ARROWS
Anthony Trujillo, 2001 Kingsboro Circle, Tustin, expressed
concern that City left -turn traffic arrows created pollution.

He also questioned the placement of a stop sign at Darsy
Circle/Devonshire Avenue.
Mayor Edgar replied that the stop sign was placed at Darsy
Circle/Devonshire Avenue due to increased traffic through Tustin
Meadows.
6. MARINE CORPS AIR STATION, TUSTIN

Al Shifberg-Mencher, 16282 Main Street #3B, Tustin, commented on
continued support for the Breaking Bread program; tax
preparation assistance for the military; and possible closure of
the Marine Corps Air Station, Tustin.
VII. CONSENT CALENDAR
Item No. 12 was removed from the Consent Calendar by Councilmember
Potts. It was moved by Puckett, seconded by Pontious, to approve the
remainder of the Consent Calendar. Motion carried 5-0-
1.
APPROVAL OF MINUTES - APRIL 1, 1991 REGULAR MEETING
Approved the City Council Minutes of April 1, 1991.
2.
APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL
Approved Demands in the amount of $841,766.13 and ratified
Payroll in the amount of $296,772.09. 50
3.
AWARD OF CONTRACT FOR PARK LIGHTING IMPROVEMENTS AT MAGNOLIA
TREE PARK
Awarded contract in the amount of $28,700.00 to Building
Energy Consultants for Park Lighting Improvements at Magnolia
Tree Park.

Rejected subject claim for personal injury damages of an

RESOLUTION NO. 91-48 - A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, APPROVING PLANS AND SPECIFICATIONS
FOR THE MODIFICATION OF TRAFFIC SIGNALS AND INTERCONNECT AT
VARIOUS LOCATIONS (PROJECT NO. 800043) AND DIRECTING THE CITY
CLERK TO ADVERTISE FOR BIDS
Adopted Resolution No. 91-48 approving plans and
specifications for subject project and directed the City Clerk
to advertise for bids.

AUTHORIZATION TO SOLICIT BIDS FOR RE -ROOFING CITY YARD BUILDINGS
Authorized the Public Works Department to solicit bids to
repair and re -roof the buildings at the City Yard. 86
7.
AUTHORIZATION TO SOLICIT PROPOSALS TO INITIATE A $'HAZARD
COMMUNICATION STANDARDIN FOR THE CITY OF TUSTIN
Authorized the Director of Public Works to solicit proposals
to establish a Hazard Communication Standard for the City as
required by CAL/OSHA.

RESOLUTION NO. 91-47 - A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, APPROVING THE PUBLIC WORKS MUTUAL
AID PROGRAM FOR EMERGENCY SERVICES
Adopted Resolution No. 91-47 approving the Agreement for
Public Works Mutual Aid Program for Emergency Services. 45

RESOLUTION NO. 91-50 - A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, APPROVING FINAL TRACT MAP NO. 14188
Approved Final Tract Map No. 14188 by the adoption of
Resolution No. 91-50. 99
10. EL MODENA-IRVINE CHANNEL FROM LA COLINA-RED HILL CHANNEL TO RED
HILL AVENUE
Approved the County of Orange project for construction of
improvements to the E1 Modena -Irvine Channel between the La
Colina -Red Hill Channel and Red Hill Avenue, with said channel
improvements designed to convey 100 -year storm flows. 107

11. RESOLUTION NO. 91-52 - A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, APPROVING PLANS AND SPECIFICATIONS
FOR ASPHALT CONCRETE REHABILITATION AND OVERLAY PROJECT, AND
WATER MAIN REPLACEMENT ALONG NISSON ROAD BETWEEN NEWPORT AVENUE
AND RED HILL AVENUE, AND AUTHORIZING ADVERTISEMENT OF BIDS
Adopted Resolution No. 91-52 approving plans and
specifications for the Nisson roadway improvements and water
main improvements between Newport Avenue and Red Hill Avenue,
and authorized the removal and replacement of twelve trees
along the southerly side of Nisson Road. 86B
CONSENT CALENDAR NO. 12 - RESOLUTION NO. 91-51
Councilmember Potts questioned if construction on Red Hill Avenue
from Barranca Road to Warner Avenue would conflict with the I-5
Freeway widening.
Robert Ledendecker, Director of Public Works, replied that no
interference with the I-5 Freeway construction was anticipated and
stated there would be two lanes of traffic in each direction
throughout the construction period.
It was moved by Potts seconded bV Puckett, to adopt the following
Resolution No. 91-51:
RESOLUTION NO. 91-51 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TUSTIN, CALIFORNIA, APPROVING PLANS AND SPECIFICATIONS FOR THE
IMPROVEMENT OF RED HILL AVENUE FROM BARRANCA ROAD TO WARNER AVENUE,
AND AUTHORIZING ADVERTISEMENT FOR BIDS

ORDINANCE FOR INTRODUCTION
1. ORDINANCE NO. 1067 - DISORDERLY CONDUCT
It was moved by Prescott seconded by Puckett, that Ordinance
No. 1067 have first reading by title only. Motion carried 5-0.
Following first reading by title only of Ordinance No. 1067 by
the City Clerk, it was moved by Pontious seconded by Prescott,
that the following Ordinance No. 1067 be introduced:
ORDINANCE NO. 1067 - AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, AMENDING SECTION 6330 OF PART 3 OF
CHAPTER 3 "DISORDERLY CONDUCT" OF TITLE 6 "PUBLIC WELFARE" OF
THE MUNICIPAL CODE RELATING TO INDECENT CONDUCT

ORDINANCE FOR ADOPTION
1. ORDINANCE NO. 1062 - TRANSPORTATION DEMAND
REQUIREMENTS FOR SPECIFIED NEW DEVELOPMENT PROJECTS
It was moved by Potts seconded by Pontious, that Ordinance No.
1062 have second reading by title only. Motion carried 5-0.
Following second reading by title only of Ordinance No. 1062 by
the City Clerk, it was moved by Puckett seconded by Pontious,
that the following Ordinance No. 1062 be passed and adopted:
ORDINANCE NO. 1062 - AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, AMENDING ARTICLE 9 OF THE TUSTIN
CITY CODE BY ADOPTING TRANSPORTATION DEMAND MANAGEMENT
REQUIREMENTS FOR SPECIFIED NEW DEVELOPMENT PROJECTS
Motion carried 5-0 (roll call vote).

XI. NEW BUSINESS
1. SELECTION OF MAYOR AND MAYOR PRO TEM
Mayor Edgar stated he enjoyed serving as mayor and supported the
annual rotation of the mayor's position.
It was moved by Edgar, seconded by Prescott, to nominate Charles
Puckett as Mayor.

Mayor Puckett presented a plaque to former Mayor Edgar in
recognition of his term as mayor from April 17, 1990, to April
15, 1991.
It was moved by Potts, seconded by Prescott, to nominate Leslie
Anne Pontious as Mayor Pro Tem.
Motion carried 5-0.
Mayor Puckett dedicated his mayoral term to his daughter,
Denise, and her husband, Sean; and to a friend, Carl Bergquist,
who passed away April 15, 1987.
The Mayor stated his major projects and activities for the
coming year would be: Monitor status of the Marine Corps Air
Station, Tustin; implement recycling program; complete design of
Columbus Tustin Park gymnasium; implement the Southwest
Neighborhood Preservation Program; coordinate with Tustin School
Unified District in providing anti-drug/anti-gang youth
programs; continue efforts with other cities to influence cost
of county fire services; commence design of the Newport Avenue
underpass to Edinger Avenue; continue to work with State and
regional agencies in preparing City plans required by Measure M,
Proposition 111, and Federal clean air regulations; continue the
Old Town Tustin study; proceed with comprehensive review of the
City's General Plan; execute a development agreement with the
Catellus Company for the Pacific Center East project; consider
the proposed alignments and EIR for the Eastern Foothill
Transportation Corridor; strive to maintain fiscal stability of
the City; prepare a financial plan for major water system
capital improvement projects; consider a plan for financing
unfunded parks and recreation facilities; and consider the Ad
Hoc Child Care Committee report. The Mayor also outlined major
capital improvement projects for the coming year.
XII. REPORTS
1. PLANNING COMMISSION ACTION AGENDA - APRIL 8, 1991
It was moved by Pontious, seconded by Edgar, to ratify the
Planning Commission Action Agenda of April 8, 1991.

XIII. PUBLIC INPUT - None

1. CONSTRUCTION OF TELEVISION ANTENNA ON PROSPECT AVENUE
Councilmember Edgar stated there was continuing difficulty with
the construction of the television antenna on Prospect Avenue.
He requested all parties involved comply with procedures and
staff provide assistance as needed.
2. MAYOR PRO TEM TERM
Mayor Pro Tem Pontious said she was looking forward to a
challenging year as Mayor Pro Tem.

3. RESTAURANT GUIDE
Councilmember Potts questioned if the restaurant guide would be
included in the next Tustin Today brochure.
William Huston, City Manager, replied the guide would be
included in the brochure.
4. CONGRATULATIONS TO MAYOR PUCRETT
Councilmember Prescott congratulated Mayor Puckett on his
selection as Mayor.
S. DEAD OLIVE TREE ON FIRST STREET
Councilmember Prescott stated there was a dead olive tree in
front of the Post Office on First Street and requested it be
replaced.

Mayor Puckett adjourned the meeting at 7:45 p.m. The next regular
meeting of the City Council was scheduled for Monday, May 6, 1991 at
