CITY COUNCIL REGULAR MEETING
CITY OF TUSTIN
JULY 21, 1997 - 7:00 P.M.
CALL TO ORDER / PLEDGE OF ALLEGIANCE
INVOCATION- The InvocatiOn will be given by Rev. Christopher Heath, St. Cecilia's
Catholic Church.
ROLL CALL
PROCLAMATIONS- 1) 1996 Man of the Year - Donald Saltarelli; 2) 1996 Woman of

PRESENTATION- Orange County Vector Control by Fabie Combs
PUBLIC INPUT- At this time members of the public may address the City Council regarding
any items not on the agenda and within the subject matter jurisdiction of the City Council
(NO ACTION can be taken on off-agenda items unless authorized by law). If you wish to
address the City Council on any matter, please fill out one of the blue forms located on the
speaker's podium and submit to the City Clerk so that your remarks on the tape recording
of the meeting can be attributed to you. When you start to address the City Council,

PUBLIC HEARING (ITEMS1 THROUGH 2)
1. PUBLIC HEARING TO CONSIDER A FEE ADJUSTMENT FOR SOLID WASTE
COLLECTION FOR THE FISCAL YEAR 1997/98
This is the first of two Public Hearings required to place the trash fees on the
1997/98 Tax Roll. Waste Management of Orange County, Inc. is proposing a revised
rate of $12.52 per unit per month, an increase of $0.78 or 5.03%.
Recommendation· Open and continue the Public Hearing to the August 4, 1997 City
Council meeting to consider adoption of Resolution No. 97-69, placing assessments
for Solid Waste Collection on the Tax Roll for Fiscal Year 1997/98 as recommended
by the Finance Department.

APPROVAL OF ADVERTISING BUS SHELTER LOCATIONS PURSUANT TO TUSTIN
CITY CODE SECTION 9404
Recommendation' Approve eleven additional locations proposed for advertising bus
shelters as recommended by the Public Works Department/Engineering Division.
APPROVAL OF SPECIFICATIONS AND AUTHORIZATION TO BID FOR HVAC
SERVICES
Recommendation: Approve the specifications for Heating, Ventilating, Air
Conditioning Systems (HVAC) Maintenance and Repair Programs, and authorize staff
to solicit bids from qualified vendors to provide this service as recommended by the
Public Works Department/Field Services Division.

Recommendation' Receive and file as recommended by the Community SerVices
Department.

RESOLUTION NO 97-74 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN, CALIFORNIA, FINDING AND DETERMINING THE INDUSTRIAL DISABILITY
OF CHARLES CARVAJAL
Recommendation: Approve Resolution. No. 97-74 finding and determining the
industrial disability retirement of Charles Carvajal as recommended by Personnel
SerVices.

PLANNING COMMISSION ACTION AGENDA- JULY 14, 1997
All actions of the Planning Commission become final unless appealed by the City
Council or member of the public.
Recommendation: Ratify the Planning Commission Action Agenda of July 14, 1997.

ORDINANCE NO. 1184, ADDING CHAPTER 9 TO ARTICLE 5 RELATED TO THE
ABATEMENT OF NUISANCE SHOPPING CARTS AND AMENDING SECTION 1132
RELATED TO CITATION PROCEDURES
Ordinance No. 1184 had first reading by title only and introduction at the july 7,
1997 City Council meeting. The City Attorney recommended approval of Resolution
No. 97-70, establishing fees to track, retrieve, and/or abate shopping carts,
subsequent to adoption of Ordinance No. 1184.

RESOLUTION NO. 97-70 - A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, ESTABLISHING NUISANCE ABATEMENT FEE
UNDER THE CITY'S SHOPPING CART NUISANCE ABATEMENT REGULATIONS
ORDINANCE NO. 1181, PAINTING OF EXTERIOR MATERIALS USED TO SECURE
OPENINGS WITHIN BUILDINGS
Ordinance No. 1181 had first reading by title on and introduction at the July 7, 1997
City Council meeting.
Recommendation: Have second reading by title only and adoption of the following
Ordinance No. 1181 as recommended by the City Clerk's Office (roll call vote):

STANDARDS, SECTION 5502 OF THE'TUSTIN.CITY CODE
15. SERVICE AUTHORITY FOR THE ABATEMENT OF ABANDONED VEHICLES (SAAV)
PROGRAM
The 'O.range CountY Transportation Authority as the Service Authority for the
Abandoned Vehicle (SAAV) program has additional funds available to cities who
participate in the Statewide Vehicle Abatement Program. This request is for Council
authorization to allow the Community Development Department to apply for funds
to purchase a new code enforcement vehicle to support the City's Code Enforcement
Abandoned Vehicle effort.
Recommendation:. Authorize the Community Development Department to apply to
the Orange County Transportation Authority (OCTA) through the service Authority
Abandoned Vehicles (SAAV) program for 'funding' for the purchase of a new code
enforcement vehicle to support the City's Abandoned Vehicle Program; and to
approve appropriation, of funds to the Community Development Department
Passenger Vehicle Account if the funds are received as recommended by the
Community Development Department.

Recommendation. Receive and file subject report as recommended by the City
Treasurer.

COMMITTEE REPORTS- City Council
CLOSED SESSION - The City Council shall convene in closed session to confer with the
City Attorney regarding: (1) pending litigation to whiCh the City is a party; W.D. Franks vs.
City of Tustin, et..al. (WCAB-AHM 0040436); and (2) the claims of Gloria Young, Claim
No. 97-26 and D.S. Richards (Claim No. not assigned). The claims may be reviewed at the
City Clerk's Office.
ADJOURNMENT - The next regular meetirug of the CitY Council is scheduled for
Monday, August 4, 1997, at 7:00 p.m. in the Council Chambers at 300 Centennial Way.
