The meeting was called 'to order by Mayor Thomas at 7:07 p.m. at the
Council Chambers, 300 Centennial Way, Tustin, California. The Pledge of
Allegiance was led by Councilmember Saltarelli.

The Invocation was given by Pastor Dane Counts, Kings Way Church.

PROCLAMATION
NATIONAL PARKS & RECREATION MONTH
Mayor Thomas read and presented a proclamation declaring July as
National Parks and Recreation Month.

thanked their fellow Commissioners, staff, and Council for the
support and assistance given to the Parks and Recreation
Commission.
PUBLIC INPUT
4TH OF JULY cELEBRATION
Helen Edgar, Tustin, commented on the wonderful 4th of July
Fireworks show; requested the City maintain the same fireworks

contractor for next year's show; and she stated the crowd was the
largest she had seen attending the annual event.
LEASE AGREEMENT - MARINE CORPS AIR STATION, TUSTIN
Councilmember Doyle remarked on the failed lease agreement between
the City and the U. S. Navy; voiced his displeasure regarding the
matter and the lost revenue to the City; requested residents
telephone Congressman Cox in support of his efforts to inquire
into the issue; and encouraged citizens to contact Senators Boxer
and Feinstein questioning the lack of cooperation by the
Government on the lease negotiations.
Mayor Pro Tem Saltarelli stated that the City had been completely
unaware that the lease would not be signed by the U.S. Navy; noted
the difficulty in negotiating with governmental entities; and was
hopeful of a resolution when Mayor Thomas, Councilmember Worley,
and staff meet with Washington, D.C. officials next week regarding
base closure issues.
Councilmember Worley said that she was shocked the lease was not
signed by the Navy; remarked on her upcoming meeting with
Washington, D.C. officials and assured residents that the lease
would be discussed; and stated that other movie companies were
interested in leasing the hangar.
Mayor Thomas noted his conversation with the Under Secretary of
the Navy regarding the rejection of the lease; commented on the
work involved by the negotiating parties and how the
administration ultimately rejected the .lease; and stated he was
optimistic that the upcoming meeting with officials would result
in resolution of the matter.
Councilmember Potts voiced his displeasure that Council had not
been immediately notified by staff of the lease rejection; stated
COuncil could have convened an emergency meeting to resolve the
matter; and said he was confident that a lease compromise could be
reached by all parties upon further negotiations.
William Huston, City Manager, explained that due to Walt Disney
Pictures' time constraints and the last minute'notification of the
lease rejection, additional negotiations to retain the lease with
Disney Pictures was not possible.
Council/staff discussion followed regarding ascertaining during
the Washington, D.C. meeting the lease issues unacceptable to the
Navy. ·

ORDINANCE NO. 1181 - AN AMENDMENT TO ARTICLE 5 OF THE TUSTIN CITY
CODE, PUBLIC SAFETY, ADDING PROVISIONS REQUIRING THE PAINTING OF
EXTERIOR MATERIALS USED TO SECURE OPENINGS WITHIN BUILDINGS
Elizabeth Binsack, Director of Community Development, reported
concerns expressed by the Tustin Pride Committee and the Planning

Commission regarding vacant buildings at several locations in the
City that appeared blighted due to large plywood panels used to
cover the doors and windows; the Tustin City Code did not contain
provisions requiring or regulating boarding of vacant buildings;
and the proposed ordinance required temporary Securing devices be
painted to match existing, colors of vacant and occupied buildings
on elevations visible from the public right-of-way.
Council/staff discussion followed regarding that the proposed
ordinance was directed at long,term nuisance conditions and could
be applied retroactively to existing structures.
Mayor Thomas opened the Public Hearing at 7:29 p.m. There were no
speakers on the subject and the Public Hearing was closed.
It was moVed by Saltarelli, seconded by Worley, to have first
reading by title only and introduction of Ordinance No. 1181.

STANDARDS, SECTION 5502 OF THE TUSTIN CITY CODE
TABULATION OF ASSESSMENT BALLOTS AND CONSIDERATION OF THE LEVY OF
ANNUAL ASSESSMENTS FOR THE TUSTINLANDSCAPEAND LIGHTING DISTRICT
BEGINNING .WITH THE 1997-98 FISCAL YEAR
Tim Serlet, City Engineer, reported that in conformance with
Proposition 218 requirements, a Public Hearing must be conducted
to receive testimony on the proposed levy of annual assessments
for the Tustin Landscape and Lighting District beginning with
Fiscal Year 97-98; written protests and assessment ballots could
be submitted until the end of the Public Hearing; at the
conclusion of the Public Hearing, Council direction was necessary
to count ballots and report the tabulation results; if a majority
protest was not received, staff recommended.adoption of Resolution
No. 97-62 confirming the annual assessments beginning with Fiscal
Year 97-98; Proposition 218 required assessments within the Tustin
Landscape and Lighting District be ratified by property owner
ballot; ballots were mailed to propertY owners on May 23, 1997; an
informational meeting with homeowner association presidents was
held on May 21, 1997; supplemental flyers were mailed to all
property owners the ~last week in June to clarify questions
regarding the Assessment District; the District was formed in 1985
and assessments were first levied in Fiscal Year 85-86; at
formation the District had 15 parcels, currently it had 4,361
parcels; the District was responsible for the operation and
maintenance of 46.8 acres of parkway and slope landscaping and
approximately 894 street lights; the District was divided into 3
zones, one zone paid for arterial and collector street lighting,
one zone paid for arterial street lighting, parkway and slope
maintenance, and one zone paid for arterial street lighting,

parkway landscaping, and local street lighting; and during the
last 45 days since ballot mailing, staff received approximately 20
phone calls and no written protests.
Mayor Thomas opened the Public Hearing at 7:34 p.m. There were no
speakers on the subject, no ballots or written protests were
submitted, and the Public Hearing was closed.
Council concurred to direct the City Clerk to tabulate the
assessment ballots and report the results to the City Council.
William Huston, City Manager, explained the tabulation process
including that the mailed-in ballots were opened earlier in the
day; each ballot contained bar code information on the
proportionate shares of the property assessment; and because
ballots were not submitted during the Public Hearing, results of
the tabulation were available immediately.
The City Clerk announced results of the Landscape and Lighting
District for the City of Tustin as follows:

following Resolution No. 97-62 confirming the annual assessments

PLANNING COMMISSION ACTION AGENDA - JUNE 23, 1997
Ail actions of the Planning. Commission become final unless

Recommendation: Ratify Planning Commission Action Agenda of June

RESOLUTION NO. 97-61 - A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, APPROVING FINAL TRACT MAP NO. 15350
Recommendation: Adopt Resolution No. 97-61 approving Final Tract
Map No. 15350 as recommended by the Community Development
Department
VAN PURCHASE
Recommendation: Authorize purchase of prior-approved van from
California Comfort Vans, 15040 Goldenwest Circle, Westminster, in
the amount of $26,484 plus tax, license, and associated costs as
recommended by the Police Department.
AUTHORIZATION TO CONTINUE OPERATION FOR FISCAL YEAR 1997-98
Recommendation: Authorize the City Manager to continue fiscal
operations for 1997-98 at an appropriation level not to exceed
that of 1996-97, until such time as the budget process can be
completed (since the 1997-98 budget will not be approved until
after July 1, 1997, the. City Council needs to authorize
expenditures for operations; this includes capital improvement
projects approved in fiscal year 1996-97, and would not include
new capital improvement projects or services) as recommended by
the Finance Department.
ANIMAL CONTROL/SHELTER CONTRACT FOR FISCAL YEAR 1997-98
Recommendation: Authorize the Mayor to execute the Animal
Control/Shelter Contract for fiscal year 1997-98 in the amount of
$94,494.00 as recommended by the Finance Department.
RESOLUTION NO. 97-67 - A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, AMENDING THE CLASSIFICATION PLAN
Recommendation: Adopt Resolution No. 97-67 amending the
Classification Plan by adding the position of Accounting
Supervisor and approving placement of the monthly salary on the
salary schedule as follows: ~tep A - $4006; Step B - $4206; Step
C - $4416; Step D - $4637; and Step E - $4869 as recommended by
Personnel Services.
RESOLUTION NO. 97-64 - A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, APPROVING FINAL PARCEL MAP NO. 94-149,

RESOLUTION NO. 97-68 - A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, APPROVING FINAL TRACT MAP NO. 15475
Recommendation: Adopt Resolution No. 97-68 approving Final Tract
Map No. 15475 as recommended by the Community Development
Department.
RESOLUTION NO. 97-63 - A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, ACCEPTING THE WORKS OF IMPROVEMENT AND
AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR 'ANNUAL
SIDEWALK AND CURB AND GUTTER REPAIR PROJECT, FY 1996-97 (PROJECT
NO. 4020-6235)
Recommendation: AdoPt Resolution No. 97-63 accepting said work as
complete and authorize the recordation of the Notice of Completion
and direct the City Clerk to: (1) Release the Labor and Materials
Bond not sooner than thirty-five (35) days after the date of
reCordation of the Notice of Completion and (2) Release the
Faithful Performance Bond not sooner than one year after the date
of recordation of the Notice of Completion as recommended by the
Public Works Department/Engineering Division.
RESOLUTION NO. 97-60 - A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, TO VACATE A PORTION OF AN EXISTING
PUBLIC RIGHT-OF-WAY WITHIN THE NORTHERLY CUL-DE-SAC OF RAWLINGS
WAY, TRACT NO. 12870, AS DEDICATED ON AMENDED MAP NO. 1, FILED IN
BOOK 647, PAGES 1 THROUGH 7, INCLUSIVE OF MISCELLANEOUS MAPS,
RECORDS OF ORANGE COUNTY, CALIFORNIA
Recommendation: Adopt Resolution No. 97-60 which vacates a
portion of Rawlings Way street right-of-way in Tract 12870 as
recommended by the Public Works Department/Engineering Division.
RESOLUTION NO. 97-51 - A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, AUTHORIZING AN APPLICATION BY THE CITY
OF TUSTIN TO THE STATE OFFICE OF HISTORIC PRESERVATION FOR A
CERTIFIED LOCAL GOVERNMENT GRANT
Recommendation: (1) Adopt Resolution No. 97-51 authorizing staff
to file an application with the State Office of Historic
Preservation for a Certified Local Government grant (the grant
will be used for attendance at one workshop and one annual
conference by members of the Cultural Resources Advisory Committee
and suppQrt staff); (2) Authorize the Community Development
Director or designee as the agent for the City to coordinate,
process and execute all documents within the scope of the grant
.project; and (3) Agree that all required local matching funds or
in-kind services be provided by the city for the proposal as
recommended by the Community Development Department.
RATIFICATION OF NEW TUSTIN COMMUNITY FOUNDATION BOARD MEMBERS
Recommendation: Ratify six new board members and reappoint two
existing members as recommended by the Community Services
Department.
RESOLUTION NO. 97-66 - A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, MODIFYING SPORTS FIELD USE FEES FOR
THE DEPARTMENT OF COMMUNITY SERVICES
Recommendation: Adopt Resolution No. 97-66 modifying sports field
use fees for tournaments and private leagues to include a $12.00

per team fee dedicated to the Field Fund as recommended by the
Community Services Department.

CONTRACT AMENDMENT FOR FRONTIER PARK RESTROOM REHABILITATION
Recommendation: Authorize the City Manager to negotiate and
execute the amendments to the Frontier Park Restroom
Rehabilitation to include architectural services for Pinetree and
Magnolia Tree Parks for fees not-to-exceed $13,255.00 and
$23,215.00 respectively as recommended by the Community Services
Department.

ORDINANCE NO. 1184 - ADDING CHAPTER 9 TO ARTICLE 5 RELATED TO THE
ABATEMENT OF .NUISANCE SHOPPIN~ CARTS AND AMENDING SECTION 1132
RELATED TO CITATION PROCEDURES
Steve Foster, Acting Chief of Police, reported that at ,the April
7, 1997 meeting, Council directed staff to examine the issue of.
abandoned shopping carts in the City, and noted the joint effort
by staff, Tustin Pride, and Tustin Effective Managers Association
to resolve the shopping cart problem. He stated a multi-faceted
approach would be implemented including community education by
distribution of bilingual informational fliers and posters to
local schools, shopping centers, and multi and single-family
residences; staff would contact the cart retrieval company to
collect abandoned shopping carts; pOlice officers would contact
individuals removing shopping carts from store properties and
advising them that removal of a shopping cart from a business'
premises was illegal; abandoned carts had been located in the
flood control channels and the Flood Control District supported
City removal of the carts from the channels; unidentified carts in
the public right-of-way would be removed, stored, and released at
a fee; development of a Loaner Carts Program for apartments with
16 or more units; total community involvement was necessary for a
successful program; and owner identified abandoned carts could not
be removed by the City for a period of 72 hours.
Council/staff discussion followed regarding that State law
prohibited charging a nuisance abatement fee on owner-identified
abandoned shopping~carts.
Steve Foster stated that adoption of the proposed ordinance would
allow the Police Department, Code Enforcement Officers, and other
identified staff to issue infraction citations to individuals
removing shopping carts outside of a store's property; abandoned
carts would be tagged for either immediate or 72-hour removal; and
staff had developed a tracking system to allow identification of
repeat violators for appropriate enforcement action.
Council/staff discussion followed regarding that the City's
program was modeled after the City of Orange shopping cart policy;
the success of the City of Orange shopping cart program; the
ordinance could be modified in the future if necessary; and the
ordinance was a necessary tool to abate the abandoned shopping

cart problem in the City.
Lois Jeffrey, City Attorney, recommended that the proposed
Resolution No. 97-70, establishing fees to track, retrieve, and/or
abate shopping carts, be approved at the July 21, 1997 Council
meeting, subsequent to adoption of Ordinance No. 1184.
It was moved by Potts, seconded by Doyle, to have first reading by
title only and introduction of Ordinance No. 1184; and aPpropriate
$4,500.00 from the Unappropriated Reserve Fund to fund the
implementation of a Loaner Carts Program.
Motion carried 5-0.

OTHER BUSINESS
4TH OF JULY CELEBRATION
Councilmember Doyle stated he had a great time at the Tustin
Meadows 4th of July Parade.
Councilmember Worley commended staff on the 4th of July Fireworks
show held at Tustin High School.
Councilmember Worley commended Joanna Marconi and Kathy McKenzie
for organizing the Tustin Meadows Parade and Carnival.
Mayor Thomas remarked on the outstanding Tustin Meadows Parade and
Carnival; stated he received comments from residents that the 4th
of July Fireworks show at Tustin High School was the best in
Orange County; and commended the contractor, Fireworks America.
COMMENDATION - TUSTIN SCHOOLS FUNDRAISER
Councilmember Potts commended Tustin Meadows for using the 4th of
July Carnival as a fundraiser for local schools.
TUSTIN HIGH SCHOOL GRAD NITE
Councilmember Potts commended the parents who worked the Tustin
High School Grad Nite; and recommended recognition of-individuals
who regularly volunteer 'their time for the benefit 'of the
community and local schools.
I-5 FREEWAY TRAFFIC - RED HILL AVENUE EXIT
Councilmember Potts reported heavy traffic congestion on the

Mayor Pro Tem Saltarelli stated that it had been difficult to vote
on the Commission/Committee candidates; congratulated the
successful candidates;'and thanked outgoing Commission/Committee
members.
Mayor Thomas thanked outgoing Commission/Committee members for
their service to the city and welcomed the newly appointed

Mayor Pro Tem Saltarelli commended Tustin Ranch residents for
supporting the Tustin Landscape and LightingDistrict assessment.
CEDAR GROVE PARK GROUND BREAKING
Mayor Thomas commended staff on the recent Cedar Grove Park ground
breaking. ~
PEDESTRIAN/TRAFFIC CONCERN - PIONEER WAY
Mayor Thomas reported residents' concern regarding children
walking to the Peter's Canyon Elementary School and possible
installation of crosswalks/traffic controllers, and changing the
posted speed limit on Pioneer Way.
TUSTINWS 70TH ANNIVERSARY
Mayor Thomas encouraged incorporating Tustin's 70th anniversary in
this year's Tiller Days festivities..
COMMITTEE REPORTS
TRANSPORTATION CORRIDOR LANDSCAPING
Councilmember Potts reported that an agreement was close' to
resolution regarding the corridor landscaping.
SENATE BILL 500
Mayor Thomas reported on receiving a letter from Senator Polanco
encouraging the City's support of Senate Bill 500 hand gun
control. '
ORANGE COUNTY FIRE AUTHORITY
Councilmember Worley reported that the Orange County Fire
Authority contract negotiations had reached impasse.
