MEMORANDUM
NO. 6
7-7-97
TO:
Honorable Mayor and Members of the City Council
City of Tustin
FROM: City Attorney
DATE: June 30, 1997
RE:
Claim of USAA Insurance Company; Claim NO. 97-15
RECOMMENDATION
After investigation and review by this office and the City's Claims Administrator, it'
is recommended that the City Council deny the claim, and direct the City Clerk to give
notice thereof to the claimant and to the claimant's attorneys.
DISCUSSION
USAA is the insurance carrier for an individual that lives at 12591 Redhill Avenue.
This property is located outside the City of Tustin city limits. The insurance comPanY is
attempting to collect from the City of Tustin for insurance proceeds that it paid to the
property owner due to a fire that occurred on or about October 21, 1996 at the subject
address. The attorney for USAA has been notified of the property's location outside the
city limits of the City of Tustin. If the claimant persists and files an action against the City
of Tustin, the City will seek sanctions under Code of Civil Procedure Section 1038.
Because there is no possible liability on the part of the City of Tustin, it is recommended
that the City Council deny this claim.

our principal as defendant, fUlly informing your client of the provisions of CCP Section 1038,
