HUSTON, CITY MANAGER COMMUNITY DEVELOPMENT DEPARTMENT FINAL TRACT MAP 15350 (IRVINE APARTMENT COMMUNITIES) RECOMMENDATION That the City Council adopt Resolution No. 97-61 approving Final Tract Map 15350. FISCAL IMPACT The Final Map is an applicant initiated project. The applicant has paid application fees to recover the cost of processing this application. DISCUSSION On October 28, 1996, the Planning Commission adopted Resolution No. 3482 recommending that the City Council approve Tentative Tract Map 15350. The City Council approved Tentative Tract Map 15350 on November 18, 1996, by adopting Resolution No. 96-124. These approvals included numerous conditions to be met prior to approval of the Final Map. Council Report Final Tract Map 15350 July 7, 1997 Page 2 Tentative Tract 15350 includes 14 numbered lots and 12 lettered lots to accommodate the development of 316 condominium dwelling units, which are to beleased as apartments, on a 19 gross acre site. The subject site is located in Sector 11 of the ETSP on the south side of Irvine Boulevard opposite the Robinson Drive intersection. The site is bordered by existing apartments (Rancho Mariposa) on the east, proposed single family detached homes (Tract 15316) on the south, and proposed single family detached homes (Tract 15427). Staff has determined that the Final Map is in substantial conformance with the Tentative Tract Map approvals, the City's Zoning. Code and Subdivision Code, and the State Subdivision Map Act. Basedupon this conformance, staff recommends that the City Council approve Final Tract Map 15350. Attachments: Final Tract Map 15350 Resolution No. 97-61 Elizabeth A. AMD 1 RESOLUTION NO. 97-61 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 A RESOLUTION OF THE cITY COUNCIL OF THE CITY OF TUSTI'N, CALIFORNIA, APPROVING FINAL TRACT MAP 15350. The City Council of the City of Tustin does hereby resolve as follows: I. The City Council finds and determines as follows: no That Final Tract Map 15350 has been submitted by Irvine Apartment Communities ("the Subdivider"); B . That. a public' hearing was held by the Planning Commission on October 28, 1996. At this hearing, the Planning Commission recommended that the City Council approve Tentative Tract Map 15350. Subsequently, the City Council approved Tentative Tract Map 15350 on November 18, 1996; C. The Final Map is considered ministerally exempt pursuant to Section 15268(b) of the' California Environmental Quality Act. D , That the proposed subdivision is in substantial conformance with the Tustin General Plan, the Tustin Zoning Code and Subdivision Map Act; E . The 2.0856 acres of parkland required for this development was previously dedicated with recordation of Tract 15055; F o That the City has reviewed the status of the School Facilities Agreements between the Irvine Company and the Tustin Unified School District for the impact of Tentative Tract 15350 on School District facilities, and changes in state law. Impacts associated with this approval on School District facilities are adequately addressed; G. That the site is physically suitable for the type of development proposed; H. That the site is physically suitable' for the prgposed density of development; That the design of the subdivision or the proposed improvements are not likely to cause subs[antial environmental damage or substantially and avoidably injure fish or wildlife in their habitat; 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 Resolution No. 97-61 Page 2 J. That the design of the subdivision or the type of improvements proposed' will not conflict with easements acquired by the public-at-large, for access through or use of the property within the proposed subdivision; That the design of the subdivision or the types of improvements proposed are not likely to cause serious public health problems; and, That the Final Map is in substantial conformance with the Tentative Tract Map. II. The City Council hereby approves Final Tract Map 15350, subject to final approval 'by the City Engineer.
