HUSTON, CITY MANAGER COMMUNITY DEVELOPMENT DEPARTMENT FINAL TRACT MAP 15475 (BAYWOOD DEVELOPMENT GROUP) RECOMMENDATION That the City Council adopt Resolution No. 97-68 apprOving Final Tract Map 15475. FISCAL IMPACT The Final Map is an applicant initiated project. The applicant has paid application fees to recover, the cost of processing this application. DISCUSSION On April 28, 1997, the Planning Commission adopted Resolution No. 3522 recommending that the City Council approve Tentative Tract Map 15427. The City Council approved Tentative Tract Map 15427 on May 5, 1997, by adopting Resolution No. 97-35. These approvals included numerous conditions to be met prior to approval of the Final Map. Tentative Tract 15427 includes 53 numbered lots and 23 lettered lots to accommodate the development of 53 single family detached dwelling units on a 5.9 gross acre site. The subject site is located in Sector 11 of the ETSP on the southeast comer of Irvine Boulevard and Tustin Ranch Road. The site is bordered by future apartments (Tract 13530) on the east, a future park City Council Report Final Tract Map 15475 July 7, 1997 Page 2 on the south across Kinsman Circle, existing single-family detached dwellings to the west across Tustin Ranch Road and the Tustin Ranch Golf Course to the north across Irvine Boulevard. As permitted by the Subdivision Map Act, the developer intends to record the subdivision in three (3) phases for financing purposes. Each phase will be recorded as a separate Final Tract Map in the following sequence: Phase 1 - Tract 15475 Phase 2- Tract 15474 Phase 3 - Tract 15427 Final Map 15475' consists of 2.723 acres and includes 21 numbered lots and 12 lettered lots. Final Map 15475 (Phases 1 and 2) is shown in context with the overall project on the attached Phasing Plan. Staff has determined that the Final Map is in substantial conformance with the Tentative Tract Map approvals, the City's Zoning Code and Subdivision Code, and the State Subdivision Map Act. The City Council finds and determines as follows. Ao That Final Tract Map 15475 has been submitted by Baywood Development Group ("the Subdivider"); That a public hearing was held by the Planning Commission on April 28, 1997. At this hearing, the Planning Commission recommended that the City Council approve Tentative Tract Map 15427. Subsequently, the City Council approved Tentative Tract Map 15427 on May 5, 1997; C . That, pursuant to Section 66456.1 of the Subdivision Map Act, the Subdivider intends to file multiple final maps in relation to approved Tentative Tract Map 15427. Final Tract Map 15475 is the first such final map; m o Pursuant to Section 15268(b) (Ministerial Projects) of the California Environmental Quality Act (CEQA), the Final Map is considered statutorily exempt from the requirements of CEQA. E o That the proposed subdivision is in substantial. conformance with the Tustin General Plan, the Tustin Zoning Code and Subdivision Map Act; F o The 0.4452 acres of parkland required for this development were previously dedicated with recordation of Tract 15055; Go That the City has reviewed the status of the School Facilities Agreements between the Irvine Company and the Tustin Unified School District for the impact of Tentative Tract 15427 on School District facilities, and changes in state law. Impacts associated with this approval on SchoOl District facilities are adequately addressed; H, That the site is physically suitable for the type of development proposed; I .
