HUSTON, CITY MANAGER PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION SUMMARY VACATION OF A PORTION OF THE EXISTING STREET RIGHT- OF-WAY, IN RA'WLINGS WAY, A PUBLIC STREET IN TRACT NO. 12870 SUMMARY: The Irvine Community Development Company, a subsidiary of The In/ine Company and owner of a portion of Tract No. 12870, has requested that the City vacate a portion of the public street right- of-way in Rawlings Way, which is generally located between Tustin Ranch Road and Township Drive (formerly Fairgate Drive). The section is excess street right-of-way with no public utility facilities located thereir~ RECOMNIENDATION It is recommended that the Tustin City Council, at their meeting of July 7, 1997 adopt Resolution No. 97-60 which vacates a portion of Rawlings Way street right-of-way in Tract 12870. FISCAL IMPACT No fiscal impact. BACKGROUND The street dedication, as shown on the origfinal Map of Tract 12870, identified Rawlings Way as a through street. Map Amendment No. 1 converted the northern end of Rawlings Way into a cul-de-sac. However, the as-built improvements are not in alignment with the dedicated right-of-way as shown on Map Amendment No. 1. The Irvine Community Development Company, a subsidiary of The Irvine Company and the owner of the affected portion of this residential tract, has requested that the street right-of-way of record be made to conform to the existing cul-de-sac improvements. This will necessitate the City's vacation of two certain portions of the original street right-of-way, and the concurrent dedication, by two adjacent property owners (the Irvine Community Development Company and the Tustin Ranch Community Association llI), to the City for street right-of-way purposes, of certain adjacent properties. The portion of existing street right-of-way to be vacated, designated as Parcel Nos. 1 and 2 as shown on Exhibits "A" and "B" attached hereto and incorporated here by reference, is no longer needed for street purposes. No public utilities are located within this portion of the fight-of-way. The Irvine Community DeveloPment Company and the Tustin Ranch Community Association III have delivered fully executed Easement Deeds to the City, pursuant to which the required adjacent properties will be dedicated to the City on acceptance and recordation. Copies of the Easement Deeds are attached hereto and incorporated herein by reference as Exhibits "C" and "D". The following is an anticipated schedule for this vacation procedure: July 7, 1997 City Council adopts Resolution No. 97-60 vacating the prescribed portions of the right-of-way in the public street known as Rawlings Way. July 8, 1997 City Manager executes the acceptances of the Easement Deeds from the Irvine Community Development Company and the Tustin Ranch Community Association III. Later, per Map Amendment No. 1, the northern end of Rawlings Way was converted into a cul-de-sac. However, the as-built cul-de-sac improvements are out of alignment with the cul-de-sac as shown on Map Amendment No. 1. The Irvine Community Development Company, a subsidiary of The Irvine Company and the owner of the affected portion of this residential tract, has requested that the street right-of-way of record be made to conform to the existing cul-de-sac improvements. Parcels 1 and 2 are now excess street right-of-way; and WIt~REAS, Section 8334, of the California Streets and Highways Code permits the summary vacation of excess right-of-way; and WHEREAS, there are no public utilities located within the portions of the street right-of-way to be vacated; and WHEREAS, the Irvine Community Development Company and the Tustin Ranch Community Association III have delivered, to the City, fully executed Easement Deeds, pursuant to which the required adjacent properties will be dedicated to the City, on acceptance and recordation. Copies of the Easement Deeds are attached hereto and incorporated herein by reference as Exhibits "C' and "D'. That the project is categorically exempt from the California Environmental Quality Act requirements. (Category 1506 l(b)(3). That those portions of the existing right-of-way generally described as one parcel on the northeast, and the other on the northwest side of the Rawlings Way cul-de- sac, of Tract 12870 as described in Exhibit "A" and shown on Exhibit "B" are hereby vacated. 3. That this vacation resolution is adopted pursuant to Division 9, Part 3, Chapter 4 of the Streets and Highways Code. . That from and after the date this resolution is recorded, those portions of the public street right-of-way vacated' no longer constitute a public street right-of- way. That the City Clerk shall cause a certified copy of this resolution of vacation attested by the Clerk under seal, to be recorded without ac 'knowledgrnent in the office of the Orange County Recorder. o That the City Manger shall accept the Easement Deeds from the Irvine Community .Development Company and the Tustin Ranch Community Association 1/I. That the City Clerk shall cause the Easement Deeds to be recorded in the office of the Orange County Recorder, concurrently with the certified copy of this resolution of vacation.
