HUSTON, CITY MANAGER PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION FINAL ACCEPTANCE OF PUBLIC IMPROVEMENTS- ASPHALT CONCRETE REHABILITATION AND OVERLAY PROJECT, 1996-97 (PROJECT NO. 700001) SUMMARY: The City's Annual Asphalt Concrete Rehabilitation and Overlay Project has been completed to the satisfaction of the Public Works Department/Engineering DiviSion and is now ready for acceptance by the City Council. The project included repair and resurfacing or slurry sealing of various City streets between Irvine Boulevard and the north City limits and between the SR-55 Freeway and Newport Avenue; and includes First Street between the SR-55 FreeWay and Newport Avenue. RECO .MMENDATION It is recommended that the City Council, at their meeting of June 16, 1997, adopt Resolution No. 97- 55 accepting said work as complete and authorizing the recordation of the Notice of Completion, and direct the City Clerk to: 1. Release the IMx)r and Materials Bond not sooner than thirty-five (35) days after the date of recordation of the Notice of Completion; and 2. Release the Faithful Performance Bond not sooner than one year after the date of recordation of the Notice of Completion; and Assuming no claims or stop notices are filed, it is further recommended that 35 days after the date of recordation of the Notice of Completion, that the Council authorize payment of the final 10% retention in the amount of $52,336.56. This amount together with previous payment of $471,029.03 represents 100% of the final contract amount. FISCAL 1MPA .CT The final cost of the construction contract is $523,365.59 which includes one contract change order in the amount of $18,650.00. This project is mostly funded from the 1996-97 FY CIP Major Maintenance Program (account number 020-400-9999-9530-700001), with the exception of $19,000.00 funded from the 1996-97 FY Field Services operating budget for street and alley repair (account number 010-400-4030-6245). BACKGROUND The FY 1996-97 Major Maintenance Program combined the annual asphalt concrete rehabilitation/overlay and the slurry seal operation in one project. This project included repair and resurfacing or slurry sealing of various streets between the Irvine Boulevard and the north City limits and between the SR-55 Freeway and Newport Avenue; and includes First Street between the SR-55 Freeway and Newport Avenue as shown on the attached locations maps. This work has been completed to the satisfaction of the Enbfineering Division. The final contract amount of $523,365.59 represents an increase of 6.3 percent from the original contract amount of $492,494.92. The increase reflects final field measured quantities and additional rehabilitated streets that were added by a City initiated contract change order in order to help meet the County's Measure "M" Maintenance of Effort (MOE) requirements. I4 15 RESOLUTION NO. 97-55 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, ACCEPTING THE WORKS OF IMPROVEMENT AND AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR THE ASPHALT CONCRETE REHABILITATION AND OVERLAY PROJECT 1996-97 FY (CIP 700001) WI-IEREAS, R.J. Noble Company, having a contract with the City of Tustin to construct the hereinafter described public works and improvements; and WHEREAS, the City Engineer has duly certified to the construction and completion of said public improvements, hereinafter mentioned, in a manner satisfactory to the City Council of the City of Tustin; and WHEREAS, the City Council finds that said contractor has completed said public · improyement..hereinafter.more..p,3rti. 'cularly described, in accordance with the provisions of the contract documents ahd the Notice'of' C6mpletion, and' acceptance of said public' Work.and- improvement should be filed and payment of the balance due said contract authorized in accordance with the contract documents; NOW, TI-IEee, BE IT RESOLED by the City Council of the City of Tustin that said public work and improvement is found to be complete, and the same is hereby accepted.
