RECOMMENDATION
Adopt Resolution No. 97-53 modifying the Appendix, Designated Positions, contained in the
City's Conflict of Interest Code to add the positions of Building Technician, Assistant Planner,
and Tustin Community Foundation Executive Director, and to delete the position of Water
Board.

BACKGROUND
The Appendix (Designated Positions) defines those officials and employees who are required
to file Statements of Economic Interests (Form 700). Annually, the Designated Positions
should be modified to reflect changes that have occurred in the City's Classification Plan or to
reflect the addition or deletion of positions as determined by the City Attorney.
The positions of Councilmember, City Manager, City Attorney, City Treasurer, Finance Director
and Planning Commissioner, are required to file Form 700 pursuant to Government Code
Section 87200 and, therefore, are not included as Designated Positions in the Appendix. The
positions of Redevelopment Program Manager and Redevelopment Project Manager are
Designated Positions pursuant to Resolution No. RDA 95-1 adopted by the Redevelopment
Agency on March 20, 1995.

With the adoption of Resolution 'No. 97-53, the positions of Building Technician, Assistant
Planner, and Tustin Community Foundation Executive Director will be added to Appendix,
Designated Positions, of the Conflict of Interest Code; 'and the Water Board positions will be
deleted due to dissolution of the Water. Corporation Board.

RESOLUTION NO. 97-53
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN, CALIFORNIA, MODIFYING THE DESIGNATED
POSITIONS CONTAINED IN THE CONFLICT OF INTEREST CODE
OF THE CITY OF TUSTIN
The City Council of the City of Tustin does hereby resolve:
A,
That the Appendix of the Conflict of Interest Code of the City of Tustin,
approved by the City Council with the adoption of Resolution No. 96-7,
should be modified and uPdated to reflect the following additional positions,
which involve the making or participation in the making of decisions which
may foreseeably have a material effect on a financial interesl~ of the
employee' Building Technician, Assistant Planner, and Tustin Community
Foundation Executive Director.

That the Appendix of the Conflict of Interest Code of the City of Tustin,
approved by the City Council with the adoption of Resolution No. 96-7,
should be modified and updated to delete the Water Board from those
positions required to file a Statement of Economic Interests.

That the revised Appendix, attached hereto, be approved and the Conflict
of Interest Code be modified accordingly.

That pursuant to Section 4 of the Conflict of Interest Code. of the City of
Tustin, the City Council, as the Code-reviewing body, hereby instructs all
persons occupying a newly designated position to file with the City Clerk's
office an initial Statement of Economic Interests and an annual Statement
thereafter.
PASSED AND ADOPTED by' the City Council of the City of Tustin at a regular
meeting held on the 16th day of June, 1997.

* The City COuncil, City Manager, City Attorney, City Treasurer, Finance Director, and Planning
Commissioners are required to file Statement of Economic Interests Form 700 pursuant to
Government Code Section 87200 and are, therefore, not included as designated positions in
this Appendix.
** The City Manager shall determine on a case-by-case basis whether a particular consultant
is required to comply .with the disclosure requirements listed above. If the City Manager
determines that a particular consultant must comply with the above disclosure requirements,
the City Manager shall notify the consultant in writing. The written notification shall include a
description of the consultant's duties and, based upon those duties, a statement of the extent
of the disclosure requirements. The City Manager's notification is a public record and shall be
retained for public inspection by the City Clerk in the same manner and location as this Conflict
of Interest Code..
