SUBJECT: ACCEPTANCE OF PUBLIC IMPROVEMENT AND AUTHORIZATION TO
FILE THE NOTICE OF COMPLETION FOR THE FRONTIER PARK
WATER PLAY ELEMENT (CIP NO. 20074)
SUMMARY:
The Frontier Park Water Play Element has been completed and the project is ready for
acceptance and filing of the Notice of Completion.
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt Resolution No. 14 -36 accepting the Frontier Park Water Play Element (CIP
No. 20074), and
2. Authorize the City Clerk to file the Notice of Completion with the County
Recorder's office.
FISCAL IMPACT:
The Frontier Park Water Play Element (CIP No. 20074) was in the 2013 -2014 Capital
Improvement Program budget as a Community Development Block Grant (CDBG)
funded project. The final cost of the project was $152,450.
CORRELATION TO THE STRATEGIC PLAN:
This project addresses Goal A of the City of Tustin Strategic Plan regarding Economic
and Neighborhood Development. Specifically it relates to Strategy #6 in that the water
play element will expand the recreational opportunities for Southwest Tustin.
BACKGROUND:
The scope of work included the demolition and removal of the existing concrete and
block wall amphitheater at Frontier Park (1400 Mitchell Avenue), construction of a
concrete pad, ADA entry ramp, retaining wall, and installation of a 'Vortex' water play
system, guard rail, bench seating, and landscaping. Similar to the water play element at
Pioneer Road Park, this amenity will only be turned on during the hotter summer
months (June - September) each year. It also features an activation pad and timer that
will ensure that the system only runs during the daytime when park visitors are actually
using the amenity.
The project was completed on April ;24, 2014. The City has retained 10% of the contract
amount, which will be released no sooner than 35 days after the recordation of the Notice

RESOLUTION NO. 14-36
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN
CALIFORNIA ACCEPTING THE WORKS OF IMPROVEMENT AND
AUTHORIZING THE RECORDATION OF THE NOTICE OF
COMPLETION FOR THE FRONTIER PARK WATER PLAY ELEMENT
(CIP NO. 20074)
WHEREAS, International Computing Systems, Inc., having a contract with the
City of Tustin to construct the hereinafter described public works and improvement; and
WHEREAS, the Project Manager has duly certified to the construction and
completion of said public improvement hereinafter mentioned in a manner satisfactory
to the City Council of the City of Tustin; and
WHEREAS, the City Council finds that said contractor has completed said public
improvement hereinafter more particularly described in accordance with the provisions
of the contract documents and the Notice of Completion, and acceptance of said public
work and improvement should be filed and payment of the balance due said contractor
authorized in accordance with the contract documents;
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin
that said public work and improvement be accepted, and the same is hereby accepted.
Said public work and improvement is more particularly described as follows:

CIP No. 20074
BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin is
hereby authorized to execute and file a Notice of Completion for the acceptance of said
public works and improvement described herein as required by law.
