HUSTON, CiTY MANAGER PUBLIC WORKS DEPARTMENT/ENGINEKRING DMSION FINAL ACCEPTANCE OF PUBLIC IMPROVEMENTS - WALNUT AVENUE REHABILITATION PROJECT BETWEEN NEWPORT AVENUE AND RED HILL AVENUE, COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) (PROJECT NO. 700152) RECOMMENDATION It is recommended that the City Council, at their meeting of June 2, 1997, adopt Resolution No. 97 - 36, accepting said work as complete and authorize the recordation of the Notice of Completion, and direct the City Clerk to: 1. Release the Labor and Materials bond not sooner than thirty-five 05) days after the date of recordation of the Notice of Completion. 2. Release the Faithful Performance bond not sooner than one year after the date of recordation of the Notice of Completion. Assuming no claims or stop notices are filed, it is further recommended that 35 days after the date of recordation of the Notice of Completion the City Council authorize payment of the final 10% retention in the amount of $12,687.58 to R.J. Noble Company. This amount together with previous payments totaling $114,188.19 represent 100% of the final contract amount. FISCAL IMPACT The final cost of the construction contract for the Walnut Avenue Rehabilitation Project is $126,875.77, which includes one Contract Change Order to R.J. Noble Company. The Contract Change Order, in the amount of $4,312.00 was for crack sealing and traffic signal detector work. The City's Capital Improvement Program/Budget for 1996-97 FY provided $153,000.00 for this project. BACKGROUND This project provided for rehabilitation of Walnut Avenue between Newport Avenue and Red Hill Avenue which included removal and reconstruction of asphalt concrete pavement failure areas, crack routing and traffic signal detector work and construction of an asphalt concrete wearing course. The work on this project has been completed by R.J. Noble Company to the satisfaction of the Engineering Division. im . Noble Company having a contract with the City of Tustin to construct the hereinafter described public works and improvements; and . WltEREAS, the City Engineer has duly certified to the construction and completion of said PubliC-improvements hereinafter mentioned .in a'manner satisfactory to the City .Council. of City of Tustin; and ' ~ ...... WltEREAS, the City Council finds that said contractor has completed said improvement hereinafter more particularly described in accordance with the provisions of the contract documents and the Notice of Completion, and acceptance of said public work and improvement should be fried and payment of the balance due said contract authorized in accord~ce with the contract documents; NOW, THE~~~, BE IT RESOLVED by the City Council of the City of Tustin thai said public work and improvement is found to be complete, and the same is hereby accepted. Said public work and improvement is more particularly described as follows: Walnut Avenue Rehabilitation Between Newport Avenue and Red Hill Avenue, Community Development Block Grant (CDBG) (Project No. 700152) AND BE IT FURlltER RESOLVED that the City Engineer of the City of Tustin is hereby authorized to execute and file a Notice of Completion for the acceptance of said public works am improvement described herein as required by law.
