SU_M~t4,RY: The au~ached Resolution No. 97~r will approve the proposed Cib: of Irvine
Re~lution No. 97-15 for the formation of proposed City, of Irvine Assessment District No. 97-16;
will ~mve consent for the Ciw of Irvine to work in and assume jurisdiction over that portion of land
within the proposed Assessment District No. 97-16 within the Civ.' of TLLqtin for Assessment District
proceedings.
RECOMMENDATION: It is recommended that the Ciw Council of the Ci~' of Turin, at their
scheduled meeting of June 2, 1997. approve the creation of Assessment District No. 97-16 as
proposed by the Ciw of Irvine and adopt Resolution No. 97-47 which Wes the Ciw of Irvine
jurisdiction over that portion of land vdthin proposed Assessment District No. 97-16 which lies
within the Cib' of TLLstin for the purpose of constructing assessment district improvements.
FISCAL EMPACT: No fiscal impact to the Ciw of Tustin as the City of ~'ine x'~ll expend
assessment district bond proceeds for said improvement work which will be performed within the
Civ_' of Tustin boundaries, and the City of Irvine will assume all liability, for such work.
DISCUSSION: The City Council has been requested to consent to the City of Irvine constructing
improvements for Irvine's Assessment District No. 97-16 within the City of Tustin boundaries. The
improvement work generally consists of street widening and related traffic signal modifications,
drainage, utilities and off-site mitigation.
BACKGROUNI): The Cib' of Irxdne is proposing to form an assessment district to be desi~ated
"City of Irvine Assessment District No. 97-16", which will be located along Jamboree Road and
immediately adjacent to the City of Tustin boundary in the Lower Peters Canyon/Walnut Village
area. More specifically, the project area lies along Jamboree Road between Portola Parkway to the
north and the Santa Ana Freeway (I-5) to the south (as shown on the map attached as Exhibit C).
The proposed project includes the construct/on of improvements, such as street w/dth alterations,
traffic sigmal, drainage and mitigation improvements, a portion of which lie w/thin the City of Tust/n
boundaries. In order for the Ci.ty of Irvine to perform the proposed work as part of one complete
projeCt and to expend assessment district bond proceeds for such work within the City of Tustin
boundar/es, the Tustin City Cotmcil l~t give jurisdictional consent to the City of Irvine. Therefore,
v/a the attached Resolution' No. 97-,3;~, the City of Tustin grants, to the City of Irvine, jurisdiction
over that portion of the project which lies within the incorporated area of the City of Tustin for the
benefit of the proposed Ci.ty of Irvine Assessment District 97-16.

~:3IEREAS, the City. of Irvine proposes that an Assessment District, to be designated
· "Assess,rnent Distri.ct No. 97-16",.wi!1 be created pursu .ant to the Municipal Improvement Act of
1913 and 'bonds related'to the 'f:orma~on 'of' said distridt 'will'be issued 'pursuant to the'
Improvement Bond Act of 1915; and
V~,ItEREAS, portions of the Proposed improvements for AD 97-16 will be within the
incorporated boundaries of the City. of Tustin and outside the boundaries of the City of Irvine;
and
WHEREAS, the plan review, construction and inspection of said proposed
improvements within the City of Tustin boundary will be done'in accordance with current City
of Tustin design standards, policies, practices and procedures and that the cost of related permit,
plan review and field inspection fees xvill be reimbursed in full to the City of Tustin; and
WHEREAS, the Irvine City Council has determined that the improvements relating to
Assessment District 97-16 can best be acc.~mplished as a single comprehensive work scheme
and that pursuant to Sections 10103 and 5115 of the Streets and Highways Code, the Irvine City
Council has the power and authority, after reci~iving the required consents, to extend the
boundaries of Assessment District No. 97-16 beyond the City of Irvine territorial limits to
include improvement works within the City of Tustin area; and
WHEREAS, pursuant to Sections 10103 and 5117 through 5119 of the Streets and
Highways Code, the Ix'vine City Council has adopted its resolution of intention on March 11,
1997 (Resolution No. 97-15 attached hereto as Exhibit A) stating that a portion of the project
contains certain improvement work being contemplated within the incorporated boundaries of
the City of Tusfin and that the consent of the Tustin City Council is required prior to ordering
such work; and
WHEREAS, Sections 5115 through 5119 of the Stree{s and Highways Code, authorize
a city to: (i) perform the work of an Assessment District containing lands outside said city's.
territorial limits.; (ii) lexg', collect and enforce assessments to pay the expenses of such work;
and (iii) assume jurisdiction over the lands outside /ts territorial limits for purposes of the
assessment proceedings, after submitting the proposed resolution of intention to the city whose
lands the assessment district v,411 include if the city proposing the assessment district receives
the approval and consent of such city to the resolution of intention, the work and the assessment;
and

~,¥1tEREAS, the City of ln, ine has submitted Resolution 97-15, together with a map
setting forth the proposed boundaries of proposed Assessment D/strict 97-16 and a detailed
description of the proposed work and improvements relating to said district, to the City Council
of the City of Tustin.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Tustin does hereby find and determine as follows:

That the proposed City of Irvine resolution of intention is hereby approved in the form
submitted and attached hereto as Exhibit A.
That in accordance w/th Sections 5118 and 10103 of the Sweets and Highways Code,
consent is hereby given to: (i) the format/on of Assessment District No. 97-16, (ii) the
proposed work and improvements w/thin the proposed D/strict and (iii) the assumption
ofjur/sdiction by the City of Irv/ne over that portion of land w/thin AsSessment District
No. 97-16, representing territory of the City of Tustin, for the purposes of the district
format/on and assessment d/strict proceedings.

That approval is hereby given to the City of Irvine to perform certain construction
improvements, as described in the proposed Description of Work attached hereto as
Exhibit "B", w/thin the City of Irvine Assessment D/strict 97-16 boundaries and City of
Tustin incorporated boundaries under the i~rovisions of the Municipal Improvement Act
of 1913. Such approval is conditioned upon the City oflrvine's agreement in writing to
defend, indemnify and hold the City of Tustin harmless fi.om all claims, damages,
1/ability and penalties arising from the design and construct/on, except in the event of
Tustin's sole negligence or willful misconduct.

That the City of Tustin w/Il retain a.uthor/ty over the plan rex4exv, inspection and
construction phases to ensure that all work within the City of Tustin limits is planned
and performed in accordance with current City of Tustin minimum design standards,
policies, procedures and acceptable field practices.

CERTAIN PROCEEDINGS PURSUANT TO THE MUNICIPAL
IMPROVEMENT ACT OF 1913 FOR THE FORMATION OF
