HUSTON LANDSCAPE AND LIGHTING DISTRICT CASTING OF BALLOTS SUMMARY: Proposition 218 requires that public agencieS also pay any special benefit assessments levied for a landscape and lighting district. Resolution No. 97-49 authorizes the City Manager to cast ballots in favor of the proposed assessments fOr City properties included within the landscape and iighting district. RECOMMENDATION: That the City. Council approve Resolution No. 97-49. FISCAL IMPACT: For 'all City properties (except public streets, parkways, drainage facilities, etc.) in Tustin Ranch, the annual assessment will be $6,111 per year. This cost will be budgeted in an operating account of the General Fund. DISCUSSION: Proposition 218 requires that all non-exempt properties owned by public agencies be assessed on the same basis as private properties. Exempt properties (i.e., those for which an assessment is not levied) include public streets, public medians and drainage facilities. The City's consultant engineer has computed the City's fair share assessments using comparable properties in Tustin Ranch. City properties to be assessed include all park sites and Fire Station 47. This will be a new cost to the City and included in the 1997-98 General Fund budget. RESOLUTION NO. 97-49 2 3 4 5 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AUTHORIZING THE CITY MANAGER TO CAST THE CITY'S ASSESSMENT BALLOTS FOR THE TUSTINLANDSCAPE AND LIGHTING DISTRICT IN FAVOR OF THE PROPOSED ASSESSMENTS, BEGINNING FISCAL YEAR 1997/98 6 WHEREAS, Article XIIID of the California Constitution, requires that public properties within an Assessment District be assessed if 7 the property is specially benefited by the improvements to be installed or maintained. 8 WHEREAS, the Engineer's Report for the Tustin Landscaping and 9 Lighting District indicates that certain City owned properties are specially benefited by the Tustin Landscaping and Lighting District 10 improvements; and 11 WSSREAS, the City Council desires to authorize the City Manager to complete and timely submit the City's Assessment Ballots in the 12 Assessment Ballot proceeding for the Tustin Landscape and Lighting District. 13 NOW, THEREFORE, THE CITY COUNCIL OF THE. CITY OF TUSTIN, 14 CALIFORNIA, finds, determines and orders as follows: SECTION 1: That the City Council approves the Assessments for City owned property for the Tustin Landscape and Lighting 18 District, beginning with fiscal year 1997/98. 17 SECTION 2~: That the City Manager is hereby authorized to complete each of the City's Assessment District Ballots, to mark the 18 ballots in favor of the proposed assessments, and to timely return them to the City Clerk on or before July 7, 1997. 19 PASSED AND ADOPTED at a regular meeting of the City Council of 20 the City of TuStin on the .... day of , 1997. 21 22 23 24 ATTEST: JEFFERY M.
