Binsack, Zoning Administrator PUBLIC CONCERNS: (Limited to 3 minutes per person for items not on the agenda) CONSENT CALENDAR: No Items on Consent Calendar PUBLIC HEARING: 1. CONDITIONAL USE PERMIT 2014-02: A request to authorize a micro-winery, tasting room and ancillary brewery within an eating establishment in an existing 1,052 square-foot tenant space. APPLICANT: ENRICO POZZUOLI POZZUOLI WINERY, INC. 15481 RED HILL AVENUE, SUITE C TUSTIN, CA 92780 PROPERTY OWNER: PHILLIP K. COX COX’S MARKET PLAZA P.O. BOX 6069 BROOKINGS, OR 97415 PROJECT LOCATION: 140 E. MAIN STREET ENVIRONMENTAL STATUS: THIS PROJECT IS CATEGORICALLY EXEMPT (CLASS 1) PURSUANT TO SECTION 15301 OF THE CALIFORNIA ENVIRONMENTAL QUALITY ACT. RECOMMENDATION: That the Zoning Administrator adopt Zoning Administrator Action No. 14-001 approving Conditional Use Permit 2014-02 to establish and operate a micro- winery, tasting room and ancillary brewery within an eating establishment located in an existing 1,052 square-foot tenant space at 140 E. Main Street. Zoning Administrator Action Agenda May 20, 2014 Page 2 The Zoning Administrator called the meeting to order. The Zoning Administrator stated she had reviewed the staff report and conditions of approval and had no concerns at this time. The Zoning Administrator asked the applicant if he had reviewed the conditions of approval and understood them. The public hearing was opened at 10:41 a.m. The applicant, Enrico Pozzuoli, property owner, Phillip K. Cox, and residents, Peter Jahangiri and Jim Shumar (representing property owner, Margaret Pottinger, 434 El Camino Real) were present. Mr. Pozzuoli stated he had reviewed the conditions of approval and had no questions or concerns at this time. Mr. Cox, Mr. Jahangiri and Mr. Shumar had favorable comments regarding the project. Mr. Jahangiri’s questions generally included: Outdoor seating and location of the wood burning fire. Ms. Binsack’s response generally included: There will be minor outdoor seating along Main Street and the primary outdoor seating will be towards the rear of the parking lot area; with a license and appropriate ABC barriers, alcohol could be served in the outdoor seating area. She stated the wood burning fire would be indoors. The public hearing closed at 10:46 a.m. The Zoning Administrator approved Zoning Administrator Action (ZAA) 2014- 001 thereby approving Conditional Use Permit 2014-02. REGULAR BUSINESS: None ADJOURNMENT: 10:48 a.m. The date of the next meeting of the Zoning Administrator will be scheduled when items are set for hearing.
