DISCUSSION: Under the statutes governing disability retirement, the City Council, or its designee, may apply to PERS for the disability retirement of an employee. This starts the disability retirement process; as the City Manager is the City's personnel officer it would be appropriate to delegate this authority to the City Manager. LOIS E. Huston, City Manager 1100-00012 44135_1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 1'9 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 97-32 A RESOLUTION OF THE CITY COUNCIL OF 'THE CITY OF TUSTIN, CALIFORNIA, DELEGATING AUTHORITY UNDER' GOVERNM]~IT~ CODE SECTION 21152 (C) TO THE CITY MANAGER W'~RREAS, Government Code Section 21152(c) allows the governing body of a contracting agency with the Public Employee Retirement System to apply to the Board for the disability retirement of a member, and permits the governing body to designate an official to make such applications; and Wn~RREAS, the City Council of the City of Tustin, desires to delegate its authority under Government Code Section 21152(c) to the City Manager. ; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUSTIN, 'CALIFORNIA, finds, determines and orders as follows: SECTION 1: That the City Manager of the City of Tustin is hereby designated to act on behalf of the governing body pursuant to Government Code Section 21152(c).
