Delegation of Authority Under PERS Law to Make Disability Retirement
Applications
RECOMMENDATION'
Adopt attached Resolution.
DISCUSSION:
Under the statutes governing disability retirement, the City Council, or its designee,
may apply to PERS for the disability retirement of an employee. This starts the disability
retirement process; as the City Manager is the City's personnel officer it would be
appropriate to delegate this authority to the City Manager.

RESOLUTION NO. 97-32
A RESOLUTION OF THE CITY COUNCIL OF 'THE CITY OF
TUSTIN, CALIFORNIA, DELEGATING AUTHORITY UNDER'
GOVERNM]~IT~ CODE SECTION 21152 (C) TO THE CITY
MANAGER
W'~RREAS, Government Code Section 21152(c) allows the governing
body of a contracting agency with the Public Employee Retirement
System to apply to the Board for the disability retirement of a
member, and permits the governing body to designate an official to
make such applications; and
Wn~RREAS, the City Council of the City of Tustin, desires to
delegate its authority under Government Code Section 21152(c) to the
City Manager. ;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUSTIN,
'CALIFORNIA, finds, determines and orders as follows:
SECTION 1: That the City Manager of the City of Tustin is
hereby designated to act on behalf of the governing body pursuant to
Government Code Section 21152(c).
PASSED AND ADOPTED at a regular meeting of the City Council of
the City of Tustin on the ?]st day of April , 1997.
