FINAL ACCEPTANCE OF PUBLIC IMPROVEMENTS - DEMOLITION OF EL CAMIO

RECO~NDATION
It is recommended that the City Council, at their meeting of April 21, 1997 adopt Resolution No. 97-29
accepting said work as complete and authorize the recordation of the Notice of Completion, and direct the
City Clerk to:
1. Release the Labor and Materials Bond not sooner than thirty-five (35) days after the date of
recordation of the Notice of Completion.
2. Release the Faithful Performance Bond not sooner than one year after the date of recordation of
the Notice of Completion.
Assuming no claims or stop notices are filed, it is further recommended that 35 days after the date of
recordation of the Notice of Completion the City Council authorize payment of the final 10% retention in
the amount of $1,830.00 to Environmental Control Systems, Inc. This amount, together with previous
payments totaling $16,470.00, represents 100% of the final contract amount.
FISCAL IMPACT
The final cost of the construction contract is $18,300.00.

BACKGROUND
The project consisted of the demolition and disposal of a 10 unit single-story apartment complex consisting
of three buildings, parking lot, trees and shrubs. Additionally, perimeter security fencing was installed.
As part of the E1 Camino Real Widening Project between Red Hill Avenue and east of Browning Avenue,
the City purchased the property, provided relocation assistance to tenants, and completed removal and
disposal of asbestos from the vacant buildings.

WHEREAS, Environmental Control Systems, Inc., having a contract with the City of Tustin
to accomplish the hereinafter described public works and improvements; and
WltEREAS, the City Engineer has duly certified to the completion of said public
improvements hereinafter mentioned, in a manner satisfactory to the City Council of the City of
Tustin; and
wHEREAS, "the" City council. findg that said contm~t0r"has completed said public'
improvement hereinafter more particularly described in accordance with the provisions of the
contract documents and the Notice of Completion, and acceptance of said public work and
improvement should be filed and payment of the balance due said contract authorized in
accor~ce with the contract documents;
NOW, TH]gREFORE, BE IT RF~OLVED by the City Council of the City of Tustin that
said public work and improvement is found to be complete, and the same is hereby accept.

AND BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin is hereby
authorized to execute and file a Notice of Completion for the acceptance of said public works and
improvement described herein as required by law. -
PASSED AND ADOPTED at. a regular meeting of the City Council of the City of Tustin held
on the 21" day of April, 1997.
