JAMBOREE ROAD BOUNDARY REORGANIZATION
SUMMARY: As part of the City of Irvine's application to annex the Lower Peters
Canyon area, the easterly right-of-way of Jamboree Road north of Interstate 5 is
proposed to be annexed to the City of Tustin. The Council is requested to support the
boundary adjustment and 'adopt a resolution stating there will be no exchange of
property tax.
RECOMMENDATION
That the City Council:
(1)
Support a boundary reorganization between the City of Tustin
and the City of Irvine along Jamboree Road between Interstate
5 and the northerly city limits by transmitting a Letter of
Support to the Local Agency Formation Commission (LAFCO); and
(2) Adopt Resolution No. 97-26 approving a Property Tax Transfer
between the City of Tustin and the City of Irvine.
FISCAL IMPACT
Reorganization Application LAFCO fees, County fees and preparation
of the legal maps and description will be provided by the City of
Irvine. Future maintenance of sidewalk and landscape maintenance
on the east side of Jamboree Road will be provided by the.City of
Irvine. The City of Tustin will incur additional roadway
maintenance and street lighting costs on the east side of Jamboree
Road. The City of Tustin currently maintains all traffic signals
north of I-5 freeway with a fair share reimbursement agreement with
County of Orange. The reorganization will transfer the fair share
reimbursement agreement obligation from the County of Orange to the
City of Irvine. The City of Tustin also currently maintains all
the landscape medians north of I-5 freeway, the reorganization will
not affect the maintenance obligation. The City will also incur
all liability associated with the area within the City's
reorganized boundaries.
Since there is presently no property tax assessed or collected on
the area to be reorganized between the Cities of Tustin and Irvine,
the Property Tax Transfer Agreement will have no fiscal impact.

BACKGROUND
In April 1995 the Orange County Board of Supervisors approved the
Lower Peters Canyon Specific Plan. Lower Peters Canyon consists of
a 1,400 acre project site in the unincorporated County bounded by
Interstate 5 on the south, Portola Parkway on the north, Culver
Drive to the east and Jamboree Road on the west.
On November 26, 1996, the Irvine City Council adopted a Resolution
initiating application to the Local Agency Formation Commission
(LAFCO) for the annexation of Lower Peters Canyon from the County
of Orange to the City of Irvine. On February 10, 1997, the City of
Irvine submitted an application to LAFCO for Reorganization and
annexation of Lower Peters Canyon to the City of Irvine and a
boundary clean-up along Jamboree Road. The Reorganization would
adjust the easterly boundary between the Cities of Tustin and
Irvine along Jamboree Road .north of Interstate 5 to facilitate
logical public safety and maintenance of the roadway. To proceed
with the Reorganization application, LAFCO is requiring a letter
from Tustin supporting the reorganization of the Jamboree Road
boundary.
BOUNDARY REORGANIZATION
With the present configuration, portions of Jamboree Road are in
Tustin and the County (Lower Peters Canyon) area. During the City
of Tustin's review of the Lower Peters Canyon Specific Plan and
subsequent Tentative Tract Map review for Lower Peters Canyon, the
Engineering Division identified that there should be an adjustment
to the City/County boundary to coincide with the easterly right-of-
way line of Jamboree Road. A boundary adjustment would allow for
improved operation of the roadway and improvements and for policing
of the area.
The boundary reorganization would involve annexation of 5.94 acres
of presently unincorporated territory to the City of Tustin and
detachment of 0.220 acres from City of Tustin to the City of Irvine
(future jurisdiction). Under the boundary reorganization the City
of Tustin will acquire all street lights, traffic signals, curbs,
gutters, sidewalks, intersection curb returns and a portion of the
landscape lots within the Jamboree Road right-of-way south of Bryan
Avenue to the I-5 Freeway (see Attachment 1). Currently, all of
Jamboree Road north of Bryan Avenue is within the City of Tustin's
boundary. The reorganization will include the addition of right-
of-way at access locations, bus turnouts, additional turn lanes,
pedestrian facilities and a portion of landscape lots in this area.
Sidewalk and landscape maintenance on the east side of Jamboree
Road will be performed by the City of Irvine funded through an

identifies the proposed Jamboree Road right-of-way and new proposed
City of Tustin boundary. The reorganization will also require
LAFCO to process Sphere of Influence amendments to reflect the
jurisdictional change.
PROPERTY TAX TRANSFER
The Cortese Knox Local Government Act requires that any
reorganization, incorporation or annexation must include an
exchange of revenue and responsibilities of service delivery
between the jurisdictions. As part of the LAFCO process, the
County Auditor determines the portion of property tax revenues
attributable to each local agency affected. Revenue and Taxation
Code Section 99 requires that the local agencies involved in the
jurisdictional change must negotiate the property tax revenues and
adopt resolutions agreeing to accept the exchange of property of
tax revenues.
In the case of this Reorganization, there will be zero property tax
exchange since there is no assessed value and no property tax
revenues to negotiate on the public right-of-way areas being
exchanged. As part of the LAFCO application for the boundary
reorganization, the Tustin City Council is requested to adopt a
resolution stating that there will be no exchange of property tax
revenues as a result of the boundary reorganization.

Dear Ms. Smith:
The City of Tustin supports 'Reorganization No. RO 97-01
which will annex 5.94 acres of Unincorporated territory
along the easterly Jamboree Road right-of-way into the
City of Tustin and detach 0.220 acres from the City of
Tustin to the City of Irvine.
The City of Tustin shall not incur any expenses
associated with Reorganization No. RO 97-01, including
but not limited to, LAFCO fees, County fees, and exhibit
and map preparation costs.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN AGREEING TO ACCEPT NO EXCHANGE OF PROPERTY
TAX REVENUES FOR PROPOSED REORGANIZATION NO.
RO97-01, WHICH INCLUDES DETACHMENT OF .220 ACRES
FROM THE CITY OF TUSTIN TO THE CITY OF IRVINE AND
ANNEXATION OF 5.94 ACRES TO THE CITY OF TUSTIN.
WHEREAS, Section 99 of the Revenue Taxation Code
requires jurisdictions involved in any jurisdictional
change to agree to a property tax redistribution prior-to
the change becoming complete; and
WHEREAS, an annexation and detachment is proposed for
the Jamboree Road right-of-way between Interstate 5 to
approximately 900 feet north of Tustin Ranch Road; and
WHEREAS, the City of Tustin and the County of Orange
have agreed to a Master Property Tax Transfer Agreement
dated November 3, 1980, establishing formula for said
redistribution; and
WHEREAS, the property will become the jurisdiction of
the City of Irvine as part ~of Reorganization No. RO97-01;
and
WHEREAS, a new Property Tax Transfer Agreement with
the City of Irvine is required by the Revenue Taxation Code·
as part of the condition to exchange property; and
WHEREAS, this Property Tax Transfer Agreement shall
only apply to the Jamboree Road right-of-way between
Interstate 5 to approximately 900 feet north of Tustin
Ranch Road; and
WHEREAS, any future reorganizations between the Cities
of Tustin and Irvine will require a new Property Tax
Transfer Agreement; and
WHEREAS, there is no assessed value for the property
being exchanged, no exchange of property tax is necessary.
NOW, THEREFORE BE IT RESOLVED, that the City Council
of the City of Tustin does hereby agree to accept no
exchange of property tax revenues.
