Hutter, Senior Planner Ryan Swiontek, Senior Planner Adrianne DiLeva- Johnson, Sr. Management Assistant Vera Tiscareno, Executive Assistant None PUBLIC CONCERNS Approved CONSENT CALENDAR APPROVAL OF MINUTES — MAY 27, 2014, PLANNING COMMISSION MEETING. RECOMMENDATION: That the Planning Commission approve the minutes of the May 27, 2014 meeting as provided. 2. DRAFT TUSTIN PIONEERS RECOGNITION PROGRAM The proposed City of Tustin Pioneers Recognition Program would enable various community organizations and individuals to honor Tustin Pioneers by providing funding for bronze busts and plaques that would be placed on pedestals in public locations. The Guidelines provide an introduction, the goals and objectives, and the purpose of the proposed program before discussing eligibility, criteria, the nomination process, budget and the accompanying recognition plaque. Motion: It was moved by Kozak, seconded by Lumbard to approve the Consent Calendar. Motion carried 4 -0 -1. Commissioner Smith had an excused absence. PUBLIC HEARING: Adopted 3. CONDITIONAL USE PERMIT 2014 -09, A REQUEST TO ESTABLISH Resolution A PRIVATE, INDOOR RECREATIONAL USE (PERFORMING ARTS No. 4260. STUDIO) WITHIN AN EXISTING INDUSTRIAL OFFICE SPACE A request to establish a private indoor recreational use within an existing 3,560 square -foot office space located within a light industrial office complex. APPLICANT: Diem Thu Pham Performing Arts Guild of Orange County 3002 Dow Avenue, Suite 106 Tustin, CA 92780 PROPERTY OWNER: LBA Realty Fund II — WBP II, LLC 3002 Dow Avenue, Suite 302 Tustin, CA 92780 LOCATION: 3002 Dow Avenue, Suite 106 ENVIRONMENTAL: This project is categorically exempt pursuant to the California Environmental Quality Act (CEQA) Section 15301, Class 1. RECOMMENDATION: That the Planning Commission adopt Resolution No. 4260, approving the establishment of a private indoor recreational use within an existing 3,560 square -foot office space located at 3002 Dow Avenue, Suite 106. Reekstin Provided a presentation of the item. Thompson Thompson asked if the term "visual arts ", listed under Condition 2.2 of the proposed Resolution 4260, is defined in the Tustin City Code (TCC). Reekstin In response to Thompson's question, Reekstin stated the term is not listed in the TCC, but in general would fall under performing arts and could include painting, drawing, etc. Minutes — Planning Commission — July 8, 2014 — Page 2 of 5 7:11 p.m. Public Hearing opened. Strombeck Steven Strombeck, Director of the Performing Arts Guild of Orange County and Guitar Instructor, spoke on behalf of the applicant, Diem Thu Pham, in favor of the project. Mr. Strombeck stated the project is a non - profit organization for mentally /physically challenged children and has been in business for 12 years. Kozak Kozak had favorable comments for the project. He asked Strombeck if he understood and agreed with the Conditions of Approval. Strombeck Mr. Strombeck stated he understood and agreed with the Conditions of Approval. 7:13 p.m. Public Hearing closed. Kozak Kozak had favorable comments for the project, along with the staff report. Altowaiji Altowaiji had favorable comments regarding the staff report; however, questioned staffs concern of "industrial tenant spaces diminishing" and noted that the market should dictate use. Binsack Binsack's response to Altowaiji's concern generally included: Intent of the district is industrial /light use and manufacturing; the City's traditional goal is to provide more protections for the more sensitive uses; however, sensitive uses are conditionally permitted uses in this district; offices are allowed as a primary use; however, the zone is not intended primarily for recreational and educational uses. The reason these uses are drawn to these zones is because rents are cheaper. In the future and if desired, the City may look at re- zoning the district when comparing light/industrial and sensitive uses (general plan and zoning analysis). Lumbard Lumbard had favorable comments for the project. He asked staff, in the future, to provide data comparison with regard to light/industrial uses and sensitive uses to find out where businesses are headed. Thompson Thompson concurred with his colleagues on topics raised. Motion: It was moved by Altowaiji, seconded by Kozak. Motion carried 4 -0 -1 REGULAR BUSINESS: Received and 4. SUMMARY OF PROJECTS filed. The following report provides a summary of projects and activities since the last report which was presented at the March 25, 2014, Planning Commission meeting. The report focuses on the status of projects that the Planning Commission, Zoning Administrator, or staff approved; major improvement projects; Certificates of Appropriateness; Code Enforcement activities; and, other items which may be of interest to the Commission. Minutes — Planning Commission — July 8, 2014 — Page 3 of 5 RECOMMENDATION: That the Planning Commission receives and files this item. DiLeva- Johnson Provided a presentation of the item. Lumbard Lumbard questioned the trend in decrease of graffiti incidents over the last 3 years. Stonich Stonich stated there was a reduced cost for services over the last 3 years, due to the decrease and she is hopeful it will continue. Binsack Binsack commended Stonich for negotiating contract so that the cost for graffiti removal decreased and incidents decreased. Thompson Thompson commended staff for the quick turnaround time for graffiti removal. STAFF CONCERNS: Binsack Binsack's updates to the Commission generally included: The City's new contract with MIG (for Downtown Commercial Core Plan) and plans for a kick off meeting with staff and the Commission in the near future; and the City and City Council approved staff to engage with Page & Turnbull to conduct an analysis on Hangar No. 29 for interim and long -term uses. COMMISSION CONCERNS: Kozak Kozak commended DiLeva- Johnson on the Summary of Projects, Stonich on her dedication to graffiti removal and Binsack for the information on Hangar No. 29. Kozak attended the following events: • 6/1 - Chili Cook -Off — Kozak was a judge • 6/16 - Tustin Police Department Open House • 7/4 - Tustin High School — 4t' of July • Wednesdays - Concerts in the Park • 7/22 - Tustin Pioneers Program presentation Altowaiji Altowaiji commended DiLeva- Johnson on the Summary of Projects. Altowaiji attended the following: • 6/1 - Chili Cook -Off • 6/5 - State of the City • 7/4 -Tustin High School -4 th of July Lumbard Lumbard commended staff on the Summary of Projects and the Graffiti map.
